Whereas the culture of Rice upon the lands around lira
city of Savannah which by contract are subject fr dry
culture, Is a violation of ill* 1 true intent and meaning of
Uie said contract, nnd Is prohibited by the ordinances of
the rBy, and la manifestly Injurious to the health of Uis
citizens; and where a* power l.i vested in the Mayor and
Aldermen of tho city of Savannah nnd tho hand, t* there

tracts, to serve a notice upon the owner, tenant, or cult! •
valor of the sold land, or any person having the chares of

tald Rice if growing,.or to appear before Council at a time
and place in such nntlce to be specified, not exceeding

have, why the said growing Rice should not bo removed

Soc. 2. And be it further ordained, That If tha saJJ
owner, tenant, culUvator or other person, shall not, upoa
the said notice, comply with the terms of the same, or
shall fall to appear before Council, or if having appeared,
no sufficient cause should be shown why the said Rice
should not be removed, and Its culture abandoned, that la

City Marshal forthwith to remove Ute said Illce and to
destroy tha same effectually, wherever it may be planted

Sec. 3. And be it further ordained, That the expanses

which tbe nuisance shall be removed, and shall be col

Fee. 4. And be it further ordained, That nothing in Uds
ordinance aboil be to construed as to prevent nn action
for and recovery of damage* for violation of tlia dry cul
ture contracts between the owners of lands and th* so/-
poraUon of Savannah.
Sec. 5. And bo It further ordained, That all ordinances
or parts thereof militaUng with the provisions of thl* or-
dlnnnce, be, and the same are hereby repealed.
