William Armstrong, of the »wd City, being duly
■worn, doth depose end ny that he is a practical
Druggist and Chemist. That some time in the latter
part of May, or firat of June, 1848, a man by the name
of Jacob Townsend, wbo at that Ume wu a book and
pamphlet peddler, called utwn daponent, at the home
of Mr. Thompson, No. 49 lludson-street, where depo.
nent boarded, end requested deponent to write him *
recipe by which to make a Syrup of Banaparilla.
Deponent further say*, that ha became acquainted
with aaid Townsend at the office of Theodore Foater.
Ksn., Book Publisher, with whom sold Townsend
dealt That laid Townsend had had frequent conversa
tions with deponent respecting the manufacture of an
article of 8arsaparille to he aohl under the name of Dr.
Jacob Townsend.
That said Townsend atated he was an old man, and
poor, and wu not fit for hard labor—and wished to
make some money, in order to live euy In hla old
daya, and that, if Sarsaparilla under the name of Town
send sold so well, and ao much money wu made by
it, he could see no rewon why he might not make
something out of it too, (his name belnp J *

conversations asked said Townsend if he wu related
to Dr. 8. P. Townsend, to which he replied, that he
knew Dr. 8. P. Townsend would he down on him after
he should commence. But that he did not care tor
him. u he had formed a co-partnership with men who
could furnish tho requisite amount of capital—and
well prepared to defend himself against any atl
that might be made on him.
Deponent further soys, that pursuant to the request
of soul Jacob Townsend, he wrote a recipe for the
manufacture of e Syrup of Sarsaparilla, ami gave it to
him. Said Townsend observed that he wanted to
make a i|iecimen to exhibit to hli partners for their
approval, u ho wished to gratify them in every thing,
u they famished all the capital—said Townsend also
told deponent that the bottles they were to uso wero

send’s, and deponent, at the request of said Jacob
Towiuend, went to tho ofllco of Dr. S. P. Townsend,
and procured one of his labels.

vertisements uml circulars, they publish a number of
gross falsehoods respecting Dr. Townsend, which wo
will not notice.

Our opponents have published In the papers, that
Dr. 8. P. Townsend was dead. This they send lo their
agouti about tho country, who report that we have

pled men.
