Ui stmt, That ftom and alter the passage of this net, till
real sod personal estato within this State, whether owned
by individual! or corporations, resident or non-resident,
that! be liable to taxation subject lo tho exemptions hero-

Sic. 3, And be it further enacted, Thnt tho lerm "real
estate” n used in this act, shall bo construed to includo
land itself, all buildings or other articles erected upon or
t9xed to Ibe same, all mines, minerals, fossils nml quar
ries, la sad under tho same, except uilnue belonging to
tbe state; and tho term “personal citato” as used in this
id, ihall bo construed to includo uU chattels, moneys,
Jebts duo from solvent debtors, whether on nolo, bill,
drift, Judgment, or mortgage, or open accounts, goods,
warn and merchandize, capital Invested In shipping or
tonnage or capital othetwlso Invested; negro slaves, nleit-
fire carriages, public stocks, nud stocks In monied cor
porations; alio, such portion of tho capital of Incorpo

AN ACT supplementary to on net, entitled un act to levy
and colled a tax for tho ikjIUIcoI years 1853 and 1853.
approved January 0th, 1859.
Wiirreas by tho fifteenth section of tho above enUtlcd
act to lovy and colled a tax for Iho txditlcal years ie52
and 1853, It Is cnuclcd that Iho sum of three hundred and
sovoiitv-fivo thousand dollars shall ho raised for tho sup
port of tho Government of tills Btalo for each of said
years; and whereas by tho fourteenth section or sold act,
it has been further cnnrtcd that to ralso Iho said sum, for
said political years, not more thnn one-twelfth of ono
per cent, shall bo assessed on llio actual vaJuo of nil llio
property liublo lo taxntlon under the provisions or Uio
abnvo entitled net; and whereas tils Excellency tho Gov
ernor of this Stata, In a special message mado lo tho
House or Representatives, has expressed his doubts
whether tho said sum of throe hundred and sovenly-fivo
thousand dollars, necessary for the support of tho gov
ernment of this Btnto for ouch of tho said political years
1859 and 1853, can bo raised by Uio assessment of only
ono-lweltlh or ono per cent, on tho estimated value
of tho property subject to taxation under said act,
and hath recommended to tho General Assembly, as
a precautionary measure. In csso tho said rate per
cent specified In said net shall not bo sufficient lo
ralso Uio said sum for said political years 1859 and
1853, to pass an act supplementary to said net, author
izing hltn and tho Comptroller General, on tho return by
tlioj several tax Receivers or this Btnto of tho Digest of
property subject lo taxation under tho provisions of said
uct, and llio value of the same, and upon tho examination
and footing tin ofsnld Digest, ft shall satisfactorily appear
to them that tlio sold sum of three hundred and seventy*

seventy-five thousand dollars, necessary for tho support
of tho Government of this State for each of tho political

and each of them to proceed ami collect nnd receive of
and from each tax payer the amount of his tax nt nnd nf-

purposes aforesaid.
Bxc. 9. And be it further enacted by the authority a-
fort mid, That when tho tax collector of any county shall
hereafter Issuo an execution for taxes lu nrron^ tho
samo slinll be directed to nil and singular tho Sheriffs and
constables of this State, nnd shall bo levied by cither of
ficer, when llio tax duo does not cxccod thirty dollars t
but where tho tax exceeds thnt sum, the execution slinll
bo levied by the sheriff alone, uml said officers shall Iio
liable jo Im proceeded against by rule In their respective
courts as Is prescribed by law in relation to other execu
tions.
Skc. 3. And be it further enacted by the authority a-
foretold. Thnt all luwsor parts of laws, militating against
this net Im uml tho same uro hereby repealed.
