bound to San Francisco, a greater number of passengers
than are and were allowed lo be carried ou board the said
vessel, according to the proportion specified and establish
ed by the provisions of the Acts of Congress of the United
States, namely about the uumber of three hundred and
fifty passengers, exclusive of children under the age of one
year, with intent to carry the said passengers to tho said
port or San Francisco; that tho height or distanco be
tween tho decks of tho said steam vessel “Fanny" is less
than six feet and not less Hum five feel; aud that tho
apaco allowed to each passenger on board the said ves
sel (exclusive of children under tho age of one year at
the time of cmbarcation.) la less than sixteen clear su
