Jin Ordinance—7Y> set apart and dedicate a portion of tho
Springfield Plantstian, lately purchased bp the Corpora
tion of tho dtp of Savannah, from tho Heirs or Devi-
attt of Joacph Stilts deceased, for a PuHia Cemetery—
toprovids for a note of tho Itoto Is oaii Cemetery for
purposes of sepulturei, and for the protection, preserva
tion, adornment and regulation of said Csmetery—and
further to regulatefutureinterments.
1. Ho it ordnTned by tho Honorable the Mayor and Al
dermen or the City of Savannah and Hamlets thereof In
Council assembled, and it Is hereby ordained by tho
authority of tho name, That so much of tho said Spring*
field Plantation os la herein set forth nnvl described be,
and thu same is hereby set apart and dodlcntcd as n
Public Cemetery forever, to bo known by tho namo of
Laurel Grove Cemetery—that Is to sny—Tlio parcel of
land beginning at tho northern fence recently built, run
ning across thu land purchased from tho heirs of Joseph
Stiles—between tho lands or Dr. Bulloch on tho East,
and tho dam or Urn old rico field on tho West, and run
ning Southwardly between said lands of Dr. Ilulloch and
land of tho heirs of Morel on tho East and said dam on
tho West, to tho corner of the bank on land of tho heirs
of Morel on the Eastern sldo—then from said comer west-
wnnlly, to within sixty foot of tho fonce now running from
n point near said comer In a soulh-wcstwnrdly direction—
and theuco by said fonco and n lino lu tho direction thereof,
on tho eastern side, and by tho said dam and a lino In
thodlrecllon thereof on tho western side to tho southern
lino of tho said lauds purchased from tho heirs of Joseph
Stiles. And that tho space of sixty feet next to said fenco
and a line In Urn direction thereof, from said corner to tho
southern line of said purchase, shall bo a public highway
or street forever, and bo called by tho namo or Kollock-
street.
2. And bo It forther ordained by tho authority afore
said, That n pillar of graffito shall bo plncod at each of
tho corners of sold land so set apart and dedicated, and a
map of tholnnd so sot apart ami designated shall bo tnado
by the City Surveyor, and recorded outho County record,
In order that tho true location of tho said Cemetery may
bo kuown and perpetuated.
3. And bo It Author ordained by tho authority afore
said, That the plan ortho Interior of said Cemetery mado
by James O. Mono, and now in the office of tho Clerk or
Council, bo and tho same Is hereby doclared to bo the truo
plan thereof, and that nil tbo ways, passages, avenues and
corners thereon delineated shall forever be kept freo and
unobstructed for the use of those who may, at any timo
hereafter, become owners of Lots within said Cemetery,
ami for the public, subject, however, nt all times to such
rules uml regulations, us may, from tlmo to time, be mado
by Cuuncil for the government of tho same.
4. And bo It further ordained by tho authority afore
said, That tho Health and Cemetery Committee, together
with a Commlttoo of ttvo citizens of Savannah, to be ap
pointed by tho Mayor, shall constltuto a Board, a majori
ty whereof shall proceed to namo tho avenues, niul
also to number the several lots laid out within that
part of eald Cemetery, which is now enclosed by a
fence, and after tho said lots shall have been duly num
bered for tho easy ascertainment of tho same, to otTer
said lots, or as mnuy thereof as In tholr Judgment may bo
proper, to tlio public, In the monuer and upon tbe terms
hereinafter mentioned.
5. And bo It further ordained by tho authority afore
said, That tho lots in said Cemetery when offered for solo
under the direction or tho said Board, shall each bo sol
up at a valuation or ten dollars, and shall bo knocked
off to tlio highest blddor nbovo that valuation; that the
time of sale of said lots shall bo advertised for at least
twenty days in each oftho gazettes of the City of 8a vanuah,
and the sale shall be at or near the premises. Tbe sales
may bo closed or continued from day to day, or be ad
journed over to any future day, at the discretion of a ma
jority of said Board.
.15. And bo it forther ordained by tho authority afore
said, That purchasers of said Lots shall respectively on
paymout or tho purchase money to tho City Treasurer,
and on their paying also ono dollar to the Clerk for title,
he entitled to receive from Council, titles for tho same;
but upon tbe express condition that tho lot or lota con
veyed shall not be aliened or conveyed awny by tho
purchasers or tbelr heirs respectively to any other person
or persons whomsoever, provided tho purchase money
and title foe be paid within tan days from tbe day or sale;
mid If tho purchase money In any case be not paid within
said ten days, the Lots In relation to which tho failure
shall occur shall revert to tho Corporation ortho City of
Savannah. Tho title to bo delivered to purchasers shall
have Inserted therein n clause or agreement declaring
that tho Mayor and Aldermen or the City of Savannah,
and tho Hamlets thereof, shall always have the right
and power to regulate the manner of Interments on
thn Lota.
7. And be It further ordained by tho authority afore
said, That oil and singular tho monies arising from sales
of I<ota in said Cemetery at any timo hereafter, aboil bo
kept separate from all other monies In tbe Treasury, and
. shall be used and expended only for the pur|>oses of en
closing, protecting, furnishing and adorning tho said
Cemetery, under such regulations as Council may from
tlmo to time prescribe.
3. And whereas the crowded state of Uie Old Como-
teries renders it absolutely necessary that Interments
therein should cease at as early a day as possible; and
whereas It Is the duty of Council to entourage the volun
tary removal or remain* now wlUiin the Old Cemeteries:

said, That no Interment of the body of any deceased
persons shall bo made In either of tbe present Cemeteries
nfler his Honor tho Mayor shall under tho direction of
Council, give public notice In all the city gazettes that
Laurel Grove Cemetery Is prepared to receive all remains

nah to pay subscription heretofore made to the Savan
nah and Ogteekee Plank Load Company.
8rctios 1st. Bo it ordained by Uie Mayor and Aider-
men of tbe City or Savanuuh and hamlets thereof, In
Council assembled, and it is hereby ordained by the au
thority of the same, That there shnll bo Issued Bonds or
the city of Savannah to the amount of IIvo thousand dol
lars, to pay for tho city subscription to tho Savannah and
Ogccchec Plank Road Company. Tho said Bonds shall
be payable In ten years, with Interest at the rate of seven
per cent, per annum, tho interest payablo scml-nnuually,
according to coupons to be annexed to the nonds.

vide a suitable place for the iutorment of deceased free

the authority aforesaid, that there shall be laid out in the
South Western portion of the Lauda before sot apar

be lawful to Inter any dead body in any other place,
witldn the Corporate limits of the City of Savannah, than
In the said Laurel Grove Cemetery, and in tho pre»eUl
Hebrew Cemetery,and any person who shall so Inter or
cause to be Interred or be in any manner concerned In
interring any dead body within the Corporate limits, save
In Laurel Grove Cemetery, and said Hebrew Cemetery,
shall lie subject to a fine of five hundred dollars to be
recovered on Information before tho Mayor of said City.
11. And bo It forther ordained by the authority afore
said, That there shall be erected at or near the said
Laurel Grove Cemetery, a convenient dwelling house,
kitchen and stable, and also, an outhouse for the accom
modation of laborers—and at the gale or main entrance
to said Cemetery, there shall be erected a Lodge, and
within the said Cemetery, there shall be erected a Chapel
and a Public Vault, all under the direction of tho Health
and Cemetery Committee. The dwelling, stable, kitchen
and laborers’house, shall be placed In tbe keeping or an
officer to be elected by Council os hereinafter provided.
Tho Chapel shall bo for tbe use of all such as desire to
have foneral service therein. The Vault shall be for the
temporary keeping of tbe remains of such persons as are
to bo carried away from the City. The Lodge shall bo
friva Porter to attend the gate.
12. And be It further ordained by the authority afore
said, That Council shall on a day to be fixed by resolu
tion of the Board, elect an officer to be called the Keeper
or Laurel Grove Cemetery, to serve until the first regular
meeting of Council In January next—and for tbe term of
three years thereafter, and at the first regular meeting
lu January, 1850, Council shall elect such Keeper to
servo three years. It shall bo the duly of such Keeper
to watch, protect and koep in good order and con
dition, tho said Cemetery, and tbo public property
attached to the same; to keep at all times two ablo
bodied laborers to work within the Cemetery grounds—
to dig nil graves promptly upon tho written request of
any jnsrson or persons—to attend tho goto at Uie main
entrance for tbo purpose of opening the samo in the
morning and closing It at evening, and to perform by him
self and laborers such other scrvlco relating to the Cem
etery and Interments therein ns the Health and Cemetery
Committee may prescribe. The said Keeper shall have
the use of the dwelling, kitchen and outhouses aforesaid,
and of half an acre or land for a garden, and shall re
ceive as compensation for all his service, and for the ser
vice, hire and maintenance of said two laborers, tho sum
of one hundred and twenty-five doUars ;»cr month during
his continuance In office. And the said keeper, for any
failure to prepare a grave for the remains of any white per
sonal tho written requestor any Inhabitant of foe city .shall
be subject to n fine not exceeding fifty doltflrs,lo bo Imposed
by the Alayor of tbe city, it shall also be the duty ofsucli
Keeper to keep n plan of said Cemetery with the lots
numbered thereon, and to record all Interments by the
.numbers of Uie lots, and it shall also be his duty
to keep In a well bound book, a regular record,
with correct dates, of nil interments made within sulu
Laurel Grove Cemetery—shewing tho day of death, age
and disease or accident occasioning tho death of the de
ceased ; and it shall be forther hi* duty to send Into Couu
cll a monthly perfect transcript of such record.
13. And bell further ordained by tho authority afore
said, That tho preseut office of Sexton shall bo abolished
after the first day of January next.
14. And bo It further ordained by the authority afore
said, That tho Keeper of said Laurel Grove Cemetery,
ahull collect forovery grave of# white person which he
may dig and for every vault which hemoy open, the sum
of one dollar and fifty cents, to be paid Into tho Trea
sury; and ho shall collect a like sum when he may dig,
grave for a colored |ierson, or fifty cents for supervising
the digging of a grave for a colored person to bo paid In
like manner into tho Treasury aud added to tho fond
arising from the sale or Lots; but nothing herein con
tained shall compel tho Keeper to dose a vault uuloss
the actual cost thereof be paid to him.

Sec. 1. Be It ordained by tho llonorablo the Alayor and
Aldormen of tho Clly of Savannah and tlio Hamlets
thereof, in Council assembled, and It Is hereby ordained
by the authority of the same, That from and after the
pussngo of this Ordinance, It shall not ho lawful for any
persou whomsoever, not being a licensed Vendue Mas-
tor, or a Sheriff; Coroner, or Constable, in oxccultonof
lawful process, or tut Executor, Administrator, or Guar
dian, In tho duo execution of his trust, to hold any public
votulue or auction whatsoever, or to expose for salo by
himself at public outcry any Goods, Chattels, Wares,
Produce, or Merchandize, within tho limits of tho City of
Savannah. And If after tho passago of Uils Ordinance,
any person, other than tho perilous herein before named,
shall hold any public auction whatsoever, within tho
limit! oftho City of Savannah, or exposo to salo by him
self nt public outcry within Uio llmiU of said city, an”
Goods, Chattels, Wares, Merchandize, or l’roduco wbst
soever, such person so acting or offending shall be sub
ject and liablo to a lino for each and ovory such act or
otfonce of not exceeding Fifty Dollars, to bo imposed and
recovered on Information before the Maj or of sold City.
Sec. 2. And bo it forther ordnlued by the authority
aforesaid, that when an application for tho office of Yen-
duo Master shall hereafter bo made, the applicant shall
set forth tho store, or place nt which ho Intends to con
duct and carry on bis general venduo or auction busi
ness; und no auctioneers shall hereafter bo permitted to
hold, carry on, or conduct any general auction or vonduo
business at any other store or house or plnco than tho
store or place so set forth, unless by spool a) permission of
Council: Aud hereafter all licenses shall show the sold
placo or store set forth by tho applicant; nnd such licenses
shall not bo In any way asslgunble, provided always that
tho license shall authorise sales for persons other than
the venduo masters, nt any point within tho city, and nt
any time during the continuance of such license—•ra-i-
sales for other persons to be mode In good Ihllh, and not
with the Intent to defraud tho Corporation of tho city of
Savannah.
8ac. 3. And ho It forther ordained by tho authority
aforesaid, That no Venduo Master shall be hereafter per
mitted to uso his llceuse in such manner os to allow any
person other than such Venduo Alaitcr to have any part
or shore of the Commission or profits which may bo
mode on tho sales of such Vendue Mastor: provided,
that If there bo two or threo partners, nml license bo
granted to ono partner, tho license shall set forth the
namo or names or tho other partner or partners who may
be allowed to receive a share of such profits. And If any
licensed Vonduo Master shall so hereafter uso his license,
that any person other than the person or persons namod
In tho license, shall rccoive a part or share of tho com
mission or profits on his sales, such licensed Vendue Mas
ter shall be liable to a flno of one hundred dollars, to bo
recovered on Information before tho Alayor of tlio city.
And If any Vendue Muster, licensed, shall carry on any
general auction or sale at public outcry, at any placo other
than tho place named In his license, without speclnl per
