ANT ORDINANCE.
An Ordinance—To set upartand dedicate a portion of tht
Springfield Plantation, lately purchased by the Corpora-
. "Hion of the City ef Savannah,from the If tire er Devi
seei of Joecpk Stiles dtceattdyfor a Public Cemetery—
to provide for a tale of the Lota in taxi Cemetery for
purposes of sepulture, and for the protection, preserva
tion, adornment and regulation of aaid Cemetery—and
further to regulate future interments.
1. Ho It ordained by the Honorable the Mayor and Al
dermen of the City or Savannah and Usmlota thereof In
Council assembled, and It is hereby ordained by tbo
authority or tho samo, That so much of tho said Spring-
field Plantation ns Is herein set tbnh and described be,
ami tho.samo Is hereby sot apart and dedicated as a
Public Cemetery forever, to bo known by tho name or
laurel Grove Cemetery—that is to sav—Tho parcel or
land beginning at the northern fcnco recently built, run
ning across the land purchased from tho helra of Joseph
St ilea—between tbo lands or Dr. Bulloch on tho East,
nnd tho dam of tun old rice Hold on tho West, and run-
nlng Southwardly between said lands of Dr. Bulloch and
land of the helra of Morel on tho East and sakl dam on
the \\ eat, to the comer of the bank on land of the helra
of Morel on tho Eastern side—then (Yum said comer west-
vrardly, to within sixty foot of the (fence now running (torn
a point near said comer In n soulh-woetwanlty direction—
and thcnco by said (fence nnd a line I n tho direction t hcreoi;
on tho eastern side, ami by the sold dam and a lino In
thodlrecUouthcreor on the western side to tho southern
line of tho said lauds purchased (hint tho helra or Joseph
Stiles. And that Iho space nr sixty feet noxt to said renco
and a lino In the direction (hereof, from said comer to the
southern lino of said purchase, shall bo a public highway
or street (braver, and bo called by the name orKollock-
street.
2. And bo It (briber ordained by tho authority afore
said, That a pillar or granite shnll bo placed at each of
tho comers or said land so set apart and dedicated, and a
map of thojaml so set apart and designated shall bo made
by tho City Surveyor, and recorded on the Oounty record,
In order that the true location of tho said Cemetery may
be known and perpetuated.
3. And bo H Ihrtber ordained by tho authority afore
said, That tho plan of the iulerior of said Cemetery rondo
by James O. Morse, and now In the office or the Clerk of
Council, bo and the same Is hereby declared to be tbo true
plan thereof, nnd that all the ways, passages, avenues and
comers thereon delineated shall forever l>e kept fYco and
unobstructed for the use of those who may, at any time
hereafter, become owners of Lots within said Cemetery,
and for tho public, subject, however, nt all times to such
rules nnd regulations, os may, from time to lime,bo made recovered on information before tho
by Council for tbo government of the samo.
4. Ami bo it further onlalned by Iho authority afore
said, That thu Health and Cemetery Committee, together
with a Committee of five citizens of Savannah, to bo np-
pointed by the Mayor, shall constitute a Board, a mgjori*

also to number the several lots laid out within that
part of said Cemetery, which Is now enclosed by a

said lots, or as many thereof as in their Judgment may be
proper, to tho public, In the manner and upon the terms
hereinafter mentioned.
5. And be It further ordained by the authority
_ dd, That the lota In said Cemetery when offered...
under the direction of tho said Board, shall each be >0
on at a v aluation of ten dollars, nnd shall be knockci
off to tho highest bidder abovo that valuation; that tho
time of sale of said lota shall be advertised for at least
twenty days In each ofthe gazettes of iho City ofSnvnnnah,
and the sale shall be ul or ucar the premises. Tho sales
may bo closed or continued from day to day, or be ad-
ourned over to any future day, at the discretion of a 111a-
orlty of said Board.
. 6. And be It further ordained by the authority afore
said, That purchasers of said L'ts shnll respectively on
payment of tho purchase money to tho City Treasurer,
and on their paying also one dollar to the Clerk for title,
bo entitled to receive from Council, titles for the same;
but upon tho express condition thnt the lot or lots con.
veyed shall not be aliened or conveyed away by the
purchasers or their helra respectively to auy other person
or persons whomsoever, provided Uio purchnso money
sud title fee be paid withiu teu days from the day of sale;
sud if the purchase money in any case be not paid within
said ten days, tho Lots In relation to which the failure
shall occur shnll revert to tho Corporation of the City of
Savannah. The tUlo to be delivered to purchasers shall
have iuserted therein a clause or agreement declaring
that tho Mayor and Aldermen of tho City of Savannah,
and the Hamlets thereof; shall always have the right
and power to regulate tho manner of interments on
tho Lots.
7. And be It further onlalned by the authority afore
said, That all and singular the monies arising from sales
cf Lots In said Ceraolery at any time hereafter, shall be
kept separate from all other monies In tpe Treasury, nud
shall be used and expended only for tho purposes of en
closing, protecting, fUrulshlng and adorning the said
Cemetery, under such regulations as Council may from
timo to time prescribe.
8. And whereas the crowded stato of the Old Ceme
teries renders it absolutely necessary that Interments
therelu should ceaso at os early a day as possible; aud
whereas It Is the duty of Council to encourage the volun
tary removal of remains now within the Old Cemeteries:
Bo It thererore further ordained by the authority afore
said, That no iutemicnl of the body of any deceased
persons shall be made in cither of the present Cemeteries
alter his Honor tho Mayor shall under the direction of
Council, give public notice in-all the city gazettes that
Laurel Grove Cemetery la prepared to receive all remains
of deceased persons. And thereafter, whenever tho pur
chaser of any Lot in said Laurel Groro Cemetery shall re
move the remains of any deceased member or connec
tion of his or her family from either of the present Cem
eteries lu to the uew Cemetery, the City Treasurer for the
time being shall remit, return and pay over the said val
uation money which such purchaser may hare paid luto
tho Treasury. Provided such removal of remains from
the present Cemeteries Into tho Laurel Grove Cemetery,
be mode within twelve mouths from tho time at which
the Blayor’shall publish the uotlco provided for In this
section.
9. And whereas It Is the doty of Council, also, to pro
vide a suitablo place for the interment of deceased free
persons of color nnd slaves: Be It therefore onlalned by
the authority aforesaid, that there shall bo laid out In Iho
South Western portion ofthe Lands before set npnrt for
tho’Cemetery fifteen acres of ground, which shnll no used
alone for the interment of the remains of deceased per
sons of color, under such regulations ns Council may from
time to timo prescribe.
111. And be It further onlalned by tho authority afore
said, Thnt from and after the day of publication of the
S oration of said Laurel Grove Cemetery, shall be
0 by the Mayor as above provided for, it shall not
be lawful to inter any dead body in any other place,
within the Corporate limits of the City of Savannnh, than
in tho said Laurel Grove Cemetery, mid in Iho present
Hebrew Cemetery, aud any person who shall so inter or
cause to be Interred or be In any manner concerned In
interring any dead body within the Corporate limits, save
In Lautel Grove Cemetery, aud said Hebrew Cemetery,
shall be subject to a fine of five hundred dollars to bo
recovered on Information before the Mayor of said City.
11. And be It further ordained by the’ authority afore
said, That there shall be erected nt or near tho said
Laurel Grove Cemetery, a convenient dwelling house,
kitchen and stable, and nlso, an outhouse for the accom
modation of laborers—and at the gate or main entrance
to said Cemetery, llivro shnll be erected a Lodge, und
within the said Cemetery, there shnll be erected a Cliupcl
amt a Public Vault, nil under the direction of the Health
WkI Cemetery Committee. The dwelling, stable, kitchen
and laborers’house, shnll be placed In the keeping of an
officer to bo elected by Council as hereinafter provided.
Tho Chapel shall be for tho use of all such as desire to
have funeral service therein. Tho Vault shall be for the
temporary keeping of the remalus of such persons os are
to bo carriod nv sy from tbo City. Tho Lodgo shall bo
for,a Porter to atteud tho gate.
12. And bo It further onlalned by the authority afore
said, That Council shall on a day to be fixed by resolu
tion of tho Board, elect au officer to bo called the Keeper
of Laurel Grove Cemetery, to servo until tho first regular
meeting of Council in January next—aud for the term of
three years thereafter, and at the first regular meeting
in January, 1856, Council shall elect such Keeper to
serve three years. It shall be the duty of such Keeper
to watch, protect and keep. in good order and con
dition, the said Cemetery, aud the public property
attached to the same; to keep at all times two able
bodied laborers to work within Uio Cemetery grounds—
to dig all grave* promptly upon the written request or
any person or persons—to attend the gate at tho main
eutranco for tho purpose or opening the same in the
morning and closing it at evening, and to perform by hitn-
aelf and laborers such other service relating to the Cem
etery and Interments therein os the Health and Cemetery
Committee may prescribe. The sold Keeper shall have
the use of the dwelling, kitchen and outhouses aforesaid,
and of half an acre or Innd for a garden, and shall re
ceive as compensation for all his service, and for the ser
vice, hire anu maintenance of said two laborer*, the sum
of one hundred and twenty-five dollars per month during
his continuance in office. And the said keeper, for any
failure to prepare a gravo for Uio remains ofany white t»er-
son^U tho written request or any Inhabitant ofthe city .shall
bo subject to a flno not exceeding fifty dollnrs,to be imposed
by tite Mayor of the city. It shall also be the duty ofsuch
Keeper to keep a plan of said Cemetery with the lots
numbered thereon, and to record all hitcrmcnta by the
numbers or the foie, and It shall also be his duty
to keep In n well bound book, a regular record,
with correct dates, of all* Interments made within said
Laurel Grove Cemetery—showing the day of death, age
and disease or accident occasioning the death or the de-
ceased; und it shall bo further tils duty to send Into Coun
cil a monthly perfect transcript of such record.
13. And belt further ordained by ihe authority afore
said, That tho present offleo or Sexton shall Jjo abolished
after Uie first day of January next.
14. And bo It further onlalned by tho authority afore
said. That the Keeper or said Laurel Groro Cemetery,
shall collect forevery grave of a white person which he
may dig nnd for every vault which ho may open, the sum
of ono dollar and fifty cento, to lie paid Into the Trea
sury; and he shall collect alike sum when ho may dig, a
grave for a colored person, or fifty cents for supervising
the digging of a grave fora colored tierson to be paid In
like manner Into tbo Treasury and added to tbo fond
arising from the sale of Lots; but nothing herein con-
tained shall compel the Keeper to close a vault unless
the actual cost thereof bo pula to him.
15. And be It further ordained by the authority afore
said. That all Interments In said Laurel Grove Cemetery,
shall bo mado lu such manner ns the Health and Ceme
tery Committee, or any member thereof; mny, from timo
to lime, prescribe.
10. Aud belt further orlalned by the authority afore
said, That If any white persou shall remove, defuce, or In
any manner Injure any monument, railing, enclosure,
ornament, tree or plant within said Laurel Grotfo Ceme
tery, such person so offending, shall be subject and liable
to a fine of not less than Five Dollars and not exceeding
Ono Hundred Dollars, to be Imposed by tho Mayor of
tho city, and If any person of color shull bo guilty of tho
like offence, such person of color shall lie subject nud
liable to sucb fine, not exceeding Fifty Dollars, und to
-such corporal punishment us the Mayor of the city may
Impose, or cause to bo Inflicted. If any while person

by tho authority of tho same, That from and after tho
passago of this Ordinance, it shall uot bo lawful for any
person whomsoever, not being a licensed Vouduo Blas
ter, or n Sheriff; Coroner, or Constable, In execution of
lawful process, or an Executor, Administrator, or Guar
dian, in the duo execution of his trust, to hold any public
venduo or auction whatsoever, or to expose for salo by
himself at publlo outcry any Goods, Chattels, Wares,
Produce, or Merchandize, within tho limits of tho City of
Savammn. And if after tho imssageof this Ordinance,
any person, other titan tho personslieroln before named,
shall hold any publlo auction whatsoever, within tho
limits ofthe City of Savannah, or oxposo to sale by him
self at public outcry within tho limits of said city, any
Goods, Chattels, Wares, Blerchandlzc, or Produce what
soever, such persou so acting or offending shall bo sub-

granted to ono partner, tho license shall set forth tho

licensed Venduo Master shnll so hereafter uro his license,
that qny person other than the persou or perrons named
In tho license, shall rccelvo a part or share of tho com
mission or profits on his sales, such licensed Vunduo Mas
ter shall be liable to a flno of ouo hundred dollars, to be
recovered on Information before tho Blayor of tho city.
And If any Vendue Blaster, licensed, shall carry on auy
general auction or sale at public outcry, nt any place other
than the place named in his license, without special per
