5. And be It further ordained by tho authority afore
said, That tho lots In said Cemetery when otTered for sale
under tho direction of the said Board, shall each bo set
at a valuation of ten dollars, and shall be knocked
_ . to tho highest bidder above that valuation; that tiio
tlrao of sale of said lots shall bo advertised for at least
twenty dayslu each of the gazettes of iheCtty of Savannah,
and the solo shall be at or near the premises. The sales
nay bo closed or continued from day to day, or be ad-
oumed over to any future day, at the discretion of ama-
orily of said Board.
B. And bo It further ordained by tho authority afore
said, That purchasers of said Lots shall respectively on
payment or tho purchase money to the City Treasurer,
anu on their paying also ono dollar to the Clerk for title,
be entitled to recclvo from Council, titles for tho same;
but upon tho express condition that the lot or lots con
veyed shull not bo aliened or conveyed nway by the
purchasers or their bclra respectively to any other person
or persons whomsoever, provided tho purchase money
and title foe bo paid within ten days from the day of sale;
and If tho purchase money In any case bo not paid wllhlu
said ten days, the Lots In relation to which the failure
shall occur shall re vert to tho Corporation ortho City of
Savannah. Tho title to be delivered to purchasers shall
havo Inserted therein a clause or ogroemeul declaring
that Uio Mayor and Aldermen of tho City of Bavannah,
audthe Hamlets thereor, shall always havo the right
and power to regulate Uio manner of Interments on
the Lots.
7. And bo It further ordalnod by tho authority afore
said, That all and singular tho monies arising from sales
of Lots tn said Cemetery at any time hereafter, shall be
kopt separate from all other monies In the Treasury, and
shall be used and expended only for tho purposes of en
closing, protecting, furnishing and adorning tho said
Cemetery, under such regulaUons as Council may from
Ume to Ume prescribe.
8. And whereas the crowded slate or the Old Ceme
teries renders it absolutely necessary that Interments
therein should cease at as early a day os possible; and
whereas It Is tho duty or Council to cncourago Uio volun
tary removal or remains now within tho Old Cemeteries:
Be it thoreroro further ordnlned by tho authority afore
said, That no Interment of tho body of any deceased
persons shall bo mado in cither of tho present Cemeteries
after Ids Honor tho ftinyor shaU under the direction or
Council, give public notlco In nil the city gazettes that
Laurel Grove Cemetery 1* prepared to recclvo oil remains
of deceased persons. And thereafter, wbenover the pur
chaser of any Lot in said Laurel Grovo Cemetery shall rev
movo tho remains of any deceased member or connec
tion of his or her family from either of the present Cem
eteries In to the new Cemetery, the City Treasurer for tho
tlmo being shall remit, return and pay over Uio said val
uation money which such purchaser may havo paid into
the Treasury. Provided such removal of remains from
the present Cemoterles Into.lho Laurel Grove Cemetery,
be made within twulve months from tho Umo at which
the Mayor shall publish theuoUcu provided for in this
section.
0. And whereas it is the duty or Council, also, to pro
vide a suitable place for the Interment of deceased freo
persons of color and slaves: Be it therefore ordained by
the authority aforesaid, that there shall bo laid out In tho
South Western portion or the Lands before set apart for
tho’Cemotery fifteen acres or ground, which shall be used
aloue for tho Interment of tho remains of deceased per
sons of color, under such regulaUons as Council may from
time to time proscribe.
10. And bo It ftirthcr ordnlned by tho authority afore
said, Thnt from and after the dny of publication of the
B iamtlon of taid Laurel Grovo Cemetery, shall bo
o by the Mayor as abovo provided for, it shall not
bo lawful to Inter any dead body In any other place,
within the Corporate limits of the City of Savannah, Ilian
in Uio said Laurel Grove Cemetery, and in Uio present
Hebrew Cemetery,and any person who shall so inter or
cause to bo Interred or be in any manner concerned in
Interring any dead body within the Corporate limits, save
in Laurel Grove Cemetery, and said Hebrew Cemetery,
Blrall l.o subject to a line of fivo hundred dollars to be
recovered on Information before tho Mayor of said City.
11. And be it further ordained by the authority afore
said, That tbero shall be erected nt or near the said
Laurel Grovo Cemetery, a convenient dwelling house,
kitchen nud stable, and also, an outhouse for the accom
modation of laborers—and at the gate or main entrance
to said Cemetery, there shall be erected a Lodge, and
.wllhlu the said Cemetery, there shall bo erected a Chapel
and a Public Vault, all under tho direction of tho Health
and Ccmotenr Committee. The dwelling, stable, kitchen
and laborers' house, shall he placed In the keeping of an
officer to bo elected by Council us hereinafter provided.
Tho Chapel shall bo for the uso of all such as desire to
have foneral service therein. The Vault shall be for tho
temporary keeping of the remains of such persons ns nre
to bo carried away from the City. The Lodge shull bo
fora Porter to attend the gate.
12. And bo It further ordained by tho authority afore
said, That Council shall on a day to bo fixed by resolu.
tion of the Bonrd, elect an officer to be colled the Keeper
of Laurel Grove Cometery, to serve until Die first regular
meeting of Council In January next—and for tho term of
three years thereafter, and at the first regular meeting
In January, 1850, Council shall elect such Keeper to
serve three years. It shall bo the duty of such Keeper
to watch, protect and keep in good order and con
dition, the said Cemetery, and the public property
attached to the same; to keep at nil times two nblo
bodied laborers to work within the Cemetery grounds—
to dig all graves promptly upon tho written request or
any person or persons—to attend tho gate at the mnin
entrance for tho purpose of opening tho samo in the
morning and closing II at evening, nnd to perform by him
self nnd laborers such other serTlco relating to the Cem
etery nnd Interments therein as the Health and Cemetery
Committee may prescribe. Tho said Keeper shall havo
tho use of the dwelling, kitchen and outhouses aforesaid,
and of half an acre or land for a garden, and shall re
ceive os compensation for all his service, and for the ser
vice, hire and maintenance of said two laborers the sum
of one huudred nnd twenty-five dollars per month during
his continuance In office. And tho said keeper, for any
failure to prepare a grave for the remains ofany white per
sonal the written request or any Inhabitant of the city,shall
bo subject to a fine not exceeding fifty dollars,to holm posed
K tho Mayor of the city. It shall also bo the duty ofsuch
leper to keep a plan of said Cemetery with the Iota
numbered thereon, nnd to record all interments by the
numbers of the lots, and it shall also bo his duty
to keep In a well bound book, a regular record,
with correct doles, of oil Interments inode wllhlu sold
Laurel Grovo Cemetery—shewing tho day of death, ago
and disease or accident occasioning tho death of the de
ceased; nnd il shall be further his duty to send Into Couu
cll a monthly perfect transcript or such record.
13. And be it ftirthcr ordained by the nuthorit;
said, That the present office of Sexton shall be al
after tho firslday of January next
14. And bo It further ordained by the authority afore
said. That the Keeper of said Laurel Grove Cemetery,
shall collect torevery grave of a white person which he
may dig nnd for every vault which he may open, the sura
of one dollar and fifty cqnts, to be pakl into tho Trea
sury; and ho shall collect alike sum when ho may dig, a
grave for a colored person,or fifty cent* for supervising
the digging of a grove fora colored person to bo paid in
like manner Into tho Treasury and ndded to the fund
arising from the sale of Lots; but nothing heroin con
tained shall compel the Keener to close a vault unless
the actual cost thereof bo paid to him.
15. And be it further ordained by tho authority afore
said, That all Interments In said Laurel Grore Cemetery,
shall be mode In such manner as the Health and Ccmo-
tery Committee, or any member thereof; may, from time
to lime, prescribe.

said, That if any white person shall remove, deface, or In
any manner Injure nny monument, railing, enclosure,
ornament, troo or plant within said Laurel Grove Ceme
tery, such person so offending, shall bo subject nnd llablo
to a fine of not less than Five Dollars and not exceeding
One Hundred Dollars, to bo Imposed by Uio Mayor of
tho city, nnd If any person or color shall bo guilty of the
like offence, such person of color shall bo subject and
liablo to such fine, not exceeding Fifty Dollars, and to
such corporal punishment os the Muyor of the city may
Impose, or cause to be inflicted. If any wbilo person
shall shoot any gun, pistol, rifle or other fire arm within
the said Laurel Grovo Cemetery, such person shall l>o
subject nnd liable to a fine of fivo dollars to bo lmpoied
by the Mnyor, and if any person of color shall commit
the like offence, such person of color shull bo llablo to a
like fine, and moreover, to such corporal punishment as
tho Mayor may cause to bo inflicted. If any person shall
K co on any part of the ground set apart us aforesaid for
urel Grovo Cemetery or on Uio City Land adjoining,
any dead carcass nr any putrid or offensive mnttor what
ever, such person shall ho llnblo to a flno or five dollars,
to be imposed hy the Mayor; and moreover, such per
son, if a colored person, shall ho subject to such corpora!
punishment at the Mayor may canto to bo Inflicted. Tho

h ares, Produce, and Merchandise within the Limits
of the City of Savannah, except by Licensed Vendue
Masters. by Sheriffs, Coroners, or Constables, in exe
cution of thsirdnty, and by Executors, Administrators,
or Guardians. And also to regulate and limit the
right of Vendue Masters to sell under License.
Sec. 1. Bo It ordalnod by the Honorablo tho Mnyor nnd
Aldermen of tho Cily or Savnimah and tho Hamlets
thereof, In Council assembled, and lt Is hereby ordalnod
by the authority of tho same, That from nnu after tho
passugo or this Ordinance, It shall not bo law fid for nny
person whomsoever, not being a licensed Vcnduo Mas
ter, or aBherlli; Coroner, or Constable, iu execution of
lawful process, or an Executor, Admlulstrator, or Guar-
'Ian, In the due execution ofhls trust, to hold nny public
.endue or nuctlon whatsoever, or to oxposo for sale by
himself at public oulcry any Goods, Chattels, Wares,
Produce, or Merchandize, within tho limits of the City or
Savnnnan. And If after tho passage or this Ordinance,
any person, other than tho personslierelu before numed,
shall hold any public auction whatsoever, within the
limits ortho City ofSavannah, or expose to sale by him
self at public outcry within tho limits of said city,auy
Goods, Chattels, Wares, Merchandize, or Produce whnt-
soorer, such person so acting or offending shall bo sub
ject and liable to a flno for each and every such net or
offence of not exceeding Fifty Dollars, to be Imposed and
recovered on information before tho Mayor of said Cily.
Sec. And be il further ordained by tho authority
aforesaid, that when an application for tho offleo of Ven
due Master shall hereafter bo made, the applicant shall
set forth the store, or placo nt which ho intends to con-
duct and carry on hi# general vonduo or auction busi
ness; nnd no auctioneers shull hereafter bo permitted to
hold, carry on, or conduct any general auction or vcnduo
business at nny other store or house or placo than the
store or place so set forth, unless by special permission o '
Council: And hereafter all licenses shall show tho said
place or store set forth by tho nppllcant; and such licenses
shall not be In nny way assignable, provided always that
tho license shall authorise sales for persons olhor than
the vendue musters, at any point within tho city, and at
any tlmo during tho continuance or such license—such
safes for other persons to be mado In good follh, and not
with tho Intent to defraud tho Corporation of tho city of
Savannah.
Sec. 3. And be it further ordnlned by the authority
aforesaid, That no Veuduo Master shall bo hereafter per
mitted to use Ids license In such manner as to allow nny
person other than such Vcnduo Master to have any part
or share of tho Commission or prollta which may bo
inado on tho sales of such Veuduo Master; provided,
that if there bo two or threo partners, and license be
granted to ono partner, the license shall set forth tho
rnuno or nnmes ortho other partner or partners who may
be allowed to recotve a share of such profits. And If nny
licensed Vendue Master shall so hereafter use his license,
that any person other than the person or persons named
in the license, shall rocoivo a port or share of tho com
mission or profits on his sales, such licensed Vunduo Mas
ter shall be liable to a fine of ono hundred dollars, to bo
recovered on information before Uio Mnyor of tho city.
And If any Vcnduo Master, licensed, shall carry on nny
general auction or sale at public outcry, at any place other
than tho placo named In his license, williout special per-

nah and Ogttcktt Plank Hoad Company.
Section 1st. Be Itordalued by the Mayor nnd Alder
men of the City of Savannah and hnmluls thereof, In
Council assembled, and It is hereby ordained by the au
thority of tho same, That there shall bo Issued Bonds of
tho city of Savannah to tho amount of fivo thousand dol
lars, to pay for the city subscription to the Savannah and
Ogcecheo Plank Road Company. The sold'Bonds shall
bo payable lu ten years, with Interest at tho rate of seven
per cent, per nnnuro, tho Interest payable seml-nnnuolly,
according to coupons to bo annexed to the Bonds.
