No court in this Stato shall hare jurisdiction to try or determine any auit against any resident of the State upon any contract or agreement made or implied, or upon any contract made in renewal of any aebt existing prior to the first day of June, 1865. Nor shall any oourt or minis terial officer of this Stato have authority to enforce auy judgment, execution, or degree, rendered or issued upon •»? contract or agreement made or implied, or upon any contract in renowal of a debt existing prior to the first day of June, 1860, except tu the following cases: 1. In suits against trustees where the trust property is in the hands of the trustee, or hits been inTested by him in other speci fio effects now in his hands, and in suits by the vendor of the real estate against the vendee, when not more than one-third of the purchase money has been paid, and the vendee is in possession of the lnnd or speci fic effects for which he has sold it, and he refuses to deliver the land or said effects to the vendor. In such cases the courts and officers may entertain jurisdiction and en force judgments against said trust property or land or effects. 2. In suits for the benefit of minors by trustees appointed before the Ist of June, 1865. 3. In suits against corporations in their corporate capacity, but not so as to enforce the debt against the stockholders or officers thereof in their individual oapacity. 4. In suits by charitable or literary insti tutions lor money Idahed, property other than slaves sold„pr services rendered by them. 6. 111 suits or debts due for mechanical or manual labor, when the suit is by the me chanic or laborer. 6. In cases where the debt is set up by way of defeuce, and the debt set up exceeds any debt due by defendant to plaintiff, of which the courts are denied jurisdiction. 7- In all other cases in which the General Assembly shall, by law, give said courts and officers jurisdiction, provided that no officer shall have, nor shall the General Assembly give jurisdiction or authority to try or give judgment on, or enforce any debt, the con sideration of which was a slave or slaves, or for the hire thereo*. Paragraph 2. All contracts made and not executed during the late rebellion with tile intention and for the purpose of aidiug and encouraging said rebellion, or where it was the purpose or intention of one of the parties to such contract to aid or encourage each rebellion, and that fact was known to the other party, whether said contract was made by any person or corporation, with the State or Confederate States, or by a corporation, with a natural person, or be tween two or mote natural persons, are hereby declared to have been and to be illegal, and all bonds, deeds, promissory notes, bills, or other evidences of debt made or executed by the parties to such contract, or either of them in connection with such illegal contract, or as the con sideration for, or in furtherance thereof, are hereby declared null and void, aud shall be so held in all Courts in this State when an attempt shall be made to enforce any inch contract, or give validity to any such obligation or evidence of debt. And in all cases where the defendant, or any one interested in the event of the suit, will make a plea, supported by bis affidavit, that he has reason to believe that the objec tion or evidence of indebtedness upon which the suit is predicated, or some part thereof, has been given or issued for the illegal purpose aforesaid, the burden of proof shall be upon the plaintiff to satisfy the court or jury that the bond, deed, note, bill, or other evidences of indebtedness, upon which said suit is brought, is or are not, nor is any part thereof fonnded upon, or in any way con nected with any such illegal contract, and has not been used in aid of the rebellion, and the date of such bond, deed, note, bill, or other evidence of indebtedness, shali not be evidence that it has or has not, since its date, been opened, transferred, or used, in aid of the rebellion. Paragraph 3. It shall be in the power of a majority of the General Assembly to assess and collect upon all debts, judgments, or causes of action when due, founded on any contract made or implied before the Ist of June, 1865, in the hands of auy one in his own r ght, or trustee, agent or attorney of another, on or after the Ist of January,lßoß, a tax of not exceeding 25 per cent., to be paid by the creditor on pain of forfeiture of the debt, but chargeable by him as to one half thereof against the debtor, and collect able with the debt: Provided that this tax shall not be collected if the debt or cause of action be abandoned or settled without legal process, or if in judgment be settled without levy and sale: And 'provided, further, this tax shall not be levied so long as the courts of this State shall not have jurisdiction of such debts or causes of action. I commeuced taking treatment of Pro fessor Roberts, March 4th, 1868, and now, after taking nine treatments, by Animal Magnetism. I feel like a “new creature!" I can now stand up, and walk any desired distance, without crutches or canct, which was utterly impossible for more than four years before seeing Dr. Roberts. I was flee of all pain and able to walk anywhere, and to-day I feel so well and strong I can scarcely realize that I •atn the same being who was so feeble and suffer ing so much three days since. I can never express my heartfelt gratitude to the man whose wonder ful skill has thns relieved me of so much inexpres sible suffering. When Dr. Roberts ernne to Atlanta I toodf treat ment by Animal Magnetism, and have been greatly benefitted by him—iu point of truth, more than by the entire twenty seven “regular” doctors who have attended me. Under the treatment, the tumor softened and re duced in size, the hearing in my left ear has been restored, and iny left arm, which was almost use less, lias been restored to its original strength. An Ordinance to amend the Thirty Second Sec tion of the General Ordinance, lie it ordained by the City Council of Augusta, and it it hereby ordained by authority of the same, That tho Thirty Second Section of the General Ordinance is hereby amended to read as follows •• No person shall fly a kite or play town or foot ball in any settlod part of tho City, nor within fifty yards of any road leading to the City, within its corporate limits, excopt within she Parade Ground. It shall be the duty of the Chief of Police, and all officers under his control, to destroy all kites, balls, and paddles in tho City used contrary to this seotion. No person shal shoot with bow and arrows, or arrows from a bow or bows, cr throw or shoot missiles of any de scription from slings, spring guns, or instru ments of any kind in any street, lane, or alley within the corporate limits of tho City of Augusta. Every person violating this section •hall b« fined in a sum not exceeding ten dollars for each and every offence. An Ordinance, confirming the eontract of a lease for thirty years, made between tho Augusta A Summerville, and the South Carolitfa Railroad Companies. Be it Ordained by the City Council of Augusta, and it it hereby Ordained by the authority of the tame, That the Augusta A Summerville Railroad Company be, and they are hereby authorized to contract with the South Carolina Railroad Com pany for the use, by the Summerville A Augusta Railroad Company, in accordance with tho terms of their charter, and of the Ordinance of tne City Council of Augusta, now of force, amenda tory of said charter, of tho track belonging to tho South Carolina Railroad Company, extend ing from Reynolds street to the depot of the Georgia Railroad Company, upon such terms and stipulations as the said Summerville A Augusta, and South Carolina Railroad Compa nies may agree upon, with power and authority to the said Companies, from timo to time, to alter or modify the terms of their contract. Beit Ordained by the City Council of Augusta, and it is hereby Ordained by the authority of the tame, That from and after tho passage of this Ordinance, any person offering to establish a Green Grocery in this City, shall apply in writ ing to the City Council for a License, stating tho place were he or she intend carrying on said Green Grocery, and accompanying the applica tion with a certificate ot two or more citizens of the neighborhood in which said Green Grocery is to bo carried on, recommending the applicant ns a fit person to be entrusted with such license, Provided, however, that no ono shall sign more than ono certificate, and that no such certificate shall bo signed by any person possessed of, or applying for, a license. Before opening such Green Grocery the appli cant shall take out a License, for which ho or she shall pay into tho City Treasury the sum of three hundred dollars, which License shall be good for one year only, but may bo renewed from year to year, at the same price, in the discretion of tho City Council. All licenses shall be, aud continue in force, until the first day of October next after tho same are granted. The Mayor may grant Licences at .pro rata price for the unexpired por tion of the year, counting in all oases that part of the quarter in which said License is granted as a whole quarter, and no such License shall be granted for a less time than the unexpirod por tion of the year. On obtaining such License tho Gieen Grocer shall be authorized to sell iu the placo for which he is licensed, fresh moat and vegetables and such other articles aud things as are usually sold in the markets of this city It shall bo the duty of all Groen Grocers to exhibit tho ears of such animals as they offor for sale, to the Clerk of the Market, and to givo a description of the marks, brands, and color of the animal so killed, and of whom obtained, and when there is no ear mark, tho hide shall be brought with the cars on it, and on failure there of they shall pay a fine not exceeding fifty dol lars ; and all snch returns shall be entered by the Clerk of the Market on record, free of ex pense, in a book to be kept by him for that pur pose, which shall, at all times, be subject to the examination of any person desiring the same, said Clerk being paid twelve and a half corns for each examination, and fifty cents for each certi ficate. And be it further Ordained, That any person offending against this Ordinance, shall be fined in a sum not exceeding five dollars per day for every day such offence is committed.
