The lollowing is the proposed Article of t |,e Constitution, which must be adopted by the Legislature before the State can be represented in <- engross : Ptsolcol by /be Senate and House , f HtureseHtiUiees of the United States of America* Congees* assembled, two thirds ! Houses concurring, That the follow articles be proposed to the Legislatures of the severe! States as an amendment to the Constitution of the United States, which, w hen ratified by three fourths of said Legis ; j ßtures , shall be valid its a part of the Constitnlion, namely: jhrtide —, Section 1. All persons born or naturalized iu the United States, and | < a bjcct to the jurisdiction thereof, are citi zens of the United States and of the State wherein they reside. No State shall make or enforce any laws which shall abridge the privileges or immunities of citizens of the United States, nor shall any State deprive »ny person of life, liberty, or property, without due process of law, nor deny to any person within its jurisdiction the equal protection of the laws. Sec. 2- Representatives shall be appor tioned among the several States according to their respective numbers, counting the , whole number of persons in each State, excluding Indians not taxed. But whenever the right to rote at any election for electors of President and Vice President, or for United States Representatives in Congress, executive or judicial officers of a State, or members of the Legislature thereof, is denied to any of the male inhabitants of such States, being twenty one years of age and citizens of the United States, or in any way abridged, except for participation in rebellion or other crime, the basis of repre sentation therein shall be reduced in the proportion which the number of such male citizens shall bear to the whole number of male citizens twenty one years of age in such State. Sec. 3. No person sha 1 be a Senator or Representative in Congress, or elector of President or Vice President, or hold any office, civil or military, under the United States, or under any State, who, having previous v taken au oath us a member oi or as an officer of the United States, or as a member of any State Leg islature, or as an executive or judicial officer of any State, to support the Constitution of the United States, shall have engaged in insnrrection or rebellion against the same, or giveu aid or comfort to the enemies thereol; but Congress may, by a vote of two thirds ol each House, remove such disability. Sec. 4. The validity of the public debt of the United Slates, authorized by law, including debt incurred for the payment of pensions and bounties for services in sup pressing insurrection or rebellion, shall not be questioned: but neither the United States nor any State shall assume or pay any debt or obligation incurred in aid of insurrection or rebellion against the United States, or claim for the loss or emancipation of any slave; but ail such debts, obligation and claim shall pe held illegal and void. Sec. 5. The Congress shall have power to enforce by appropriate legislation, the provisions of this article. Passed June 13, 1800. We believe that the adoption of this Amendment by five of the States now under going reconstruction is needed to make it a part of the Constitution. Official. M(today, Hugh L. White, iboma-j W. Roberts, James Steele, John Cullen, anil Samuel Stray bom, citizens), sentenced by General Orders No. 72, to confinement at hard labor at the Dry Tortngas, as remains unexpired, ou the receipt of this Order at Port Jefferson, is hereby remitted, and the prisoners will be dis charged. In thus early releasing these prisoners, the Major Genera! Commanding trusts the c lemency extended toward them will not he misunderstood. Ibese misguided and thoughtless young men were convicted, after a fair trial, of*nets of vio lence and outrage against a citizen, with the ob jectof driving him out of the .State. The frequent complaints of similar conduct, and the failure of the civil authorities to repress the evil, rendered it necessary to exercise tho power conferred on him by law, nnd bring those prisoners before a military tribunal. Their con duction and punishment having, however, vindi cated the principle involved, the Commanding •cucral, in view of the suffering imposed on tbo tdatirea and friends of tho prisoners, of tho prumiiiee made of future good conduct, and in 1 •« belief that a proper example, earlier made, might have deterred the prisoners from eoininit u»g the offence, has directed the dischargo of ’h® prisoners.
