THE CONSTITUTIONAL AMEND MENT. The following is the proposed Article of the Constitution, which must be adopted by the Legislature before the State can be represented in Congress: Retched-, by the Senate and House <f Hjlni'ißfaliroi of the United States of America, in Congress assembled, two thirds of both Houses concurring, 'That the follow ing articles be proposed to the Legislatures of the several States as an amendment to the Constitution of the United States, which, when ratified by three fourths of said Legis latures, shall be valid as a part of the Constitution, namely: Article —, Section 1. All persons born or naturalized in the United States, and subject to the jurisdiction thereof, are citi zens of the United States and of the State wherein they reside. No State shall make or enforce any laws which shall abridge the privileges or immunities of citizens of the I. nited States, nor shall any State deprive any person of life, liberty, or property, without due process of law. nor deny to any person within its jurisdiction the equal protection of the laws. See. 2. Representatives shall be appor tioned among the several States according to their respective numbers, counting the whole number of persons in each State, excluding Indians not taxed. But whenever the right to vote at any election for elector* "f President and Vice President, or for L nited States Representatives in Congress, executive or judicial officers of a State, or members of the Legislature thereof, is denied to any of the male inhabitants of -uch States, being twenty one years of age uid citizens of the United States, or in any abridged, except for participation in rebellion or other crime, the basis of repre sentation therein shall be reduced in the proportion which the number of such male utizens shall bear to the whole number of male citizens twentv one years of age in such State. ec. 3. Muinhty, Hugh It. White, Thomas W. Roberta, James Steele, John Cullen, Hint Samuel Stray horn, citizens), sentenced by General Orders No. 72, to confinement at hard labor at the Dry Tortuga*, its remains unexpired, ou the receipt of this Order at Fort Jefferson, is hereby remitted, and the prisoners will be dis charged. In thus early releasin ' these prisoners, tho Major General Commanding trusts tho eleuienev extended toward them will not he misunderstood. These misguided and thoughtless young men were convicted, after a fair trial, of acts of vio lence and outrage against a citizen, with tiie ob ject of driving him out of the State. The frequent complaints of similar conduct, and the failure of the civil authorities to repress the evil, rendered it necessary to exorcise the power conferred on him by law, and bring these prisoners before a military tribunal. Their con viction and punishment having, however, vindi cated the principle involved, tho Commanding General, in view of tho suffering imposed on tho relatives and friends of the prisoners, of the promises made of future good conduct, and in the belief that a proper example, earlier made, might have deterred the prisoners from commit ting the offence, has directed the dischurgo of tho prisoners. The Commanding General takes this occasion to state that similar clemency need not bo ex pected in future, and ho warns the people of his District, that ho is determined to sup press all lawlessness and violence, and all at tempts of individuals to take the law into their own hands, or decido who shall not live in the country. To protect every person in his rights of person and property, is made by tho law the paramount duty of the Commanding General, nnd it is well the people of tho District, and the authorities having in charge the preser vation of the peace, and the execution of the laws, should know that ho is determined to cxcrciso all tho power under his command in the discharge of this duty, and that hereafter no consideration such as are here allowed, will iu lluenco him to relieve the guilt}’ from the just punishment awarded them.
