Representative SpaiMing, one of the leading Western mtabors, made a speech on Thursday, it* which he boldly took the position that the Constitutional Aniemlineut requites only the endorsement of three fourths of the Northern States, in under to make it a law. He said :“1 do no* believe that the approval or disapproval o! the ’ amendment by the Outstanding commu nities, or atjy of them, will a’lect the ratification of the Constitu Tumi Amend ment m the least degree." I’his View is a natnral consequence of the territo rial theory which the Radical caucus adopted at the beginning of the session, i If it is correct the dominant party not ' only have the rightful power to recon- S struct the Southern Statesas they please, ■ but they can lawfully reluse to accept the voles of those States in the next Presidential election, thereby securing a Radical in the place of Mr. Johnson. But here is the difficulty in the new position: up to a recent date Congress has treated the Southern States as members of the Union. lit the precedent established by the admission of Tennessee, and in all the acts of Congress affecting the excluded States, the latter were regarded as States and not as territories. The question then arises, when did they lose the element of state-hip and assume the territorial condition ? It is claimed by some of the Radicals that unless the new view is correct all the legislation of Congress since the beginning of tha rebellion must null and void. But that will not answer. The status of the Southern : States has undergone a material change since the close of the rebellion. Those States severed the relations of their Government with the General Goyeyji; -mefit,'ami while that breach continued. | Congress was not obliged to take them i into account in any matter of legisla i tion. Since then, however, the govern [ meets of the Southern States have been reestablished, the President has form ally declared them to be again in accord with the Union, and all their relations with the Government have been resumed, excepting, only, their representation in Congress. There might have been some propriety in adopting the territorial theory before the said States were form ally declared to he in their old places within the Union, but it is now too late. The Radicals, under this state of things, are getting deeper in the mire at every move they make. They have already so muddled the question that it is diffi cult to make any sense out of it. and the probability is that it will become even more complicated after the holiday festivities.—A'. Y.
