duties of the City Surveyor, t(C.
“Section6. Beit ordained, thatno lot,holder or oc
cupier of any lot, shall lay tile foundation of any build
ing or fence on the line of any lot or part of a lot, used
or occupied by .him or her, unless such line be first
ascertained by the city urvoyor, and after the line
aforesaid, is ascertained, such owner or occupier shall
not place any building, fence or other thing apper
taining thereto^ so as to affect the right of the city,
unless the said surveyor be pres, nt, (except as here
inafter specified); a d it shall be the duty of the city
surveyor to report to council all encroachments by
individuals or otherwise, that now exist, or thnt may
hereafter be made on the public squares, streets,
lanes, docks or commons of the city; audit shall be
the duty of tho city surveyor, on tho application of
any lot holder, to attend and stake off such lot, within
twenty-four hours after such application is made.
“See. 7. Beit further ordained, that the city sur
veyor shall be entitled to demand and receive the fol
lowing fees: For surveying a lot, finding and plac
ing stakes, eighteen indies long, nt the angles of such
lot, two dollars. For attending and directing the
placing of a house or fence, three dollars. For subdi
viding a lot already laid olf, one dollar. [For survey
ing and staking oil'any additional lots, out of the pre
sent commons and finding stakes and laborers, eight
dollars per day]; and for any other duty or labor, in
proportion.” 1

A N ORDINANCE, for tho protection ot the
public Gas Lamps, and lor other purpuses.
Section 1. Be it ordained, by the Mayor and Alder
men of the City of Savannah and tho hamlets thereof,
in Council assembled, and jt is hereby ordained by
the authority of the same, that if any person shall
break, injure, defuce or destroy, any of the street
lainii posts or lanterns, or shall without due author!-
ty, light or extinguish tho gas, in any of said lanterm,
he, site or they, may bo fined, if a white person, by
the Mayor or acting Mayor, in a sura not less than
twenty dollars, nor more than fitly dollars, ouo halt
to the informer; und in default p^ payment may ho
committed to jail for such fine, us in the discretion pi
the Mayor or acting Mayor, muy seem proper. And
if said otfence shull bo committed by a free person of
color or slave, lie or she shall bo whipped at the dis
cretion of the Mayor or acting Mayor, unless the
guardian of such free person ot color or the owner
of such slave, shall consent to pay the fine assessed
by the Mayor or acting Mayor, and in all cases
it shall be in the discretion of tho Mayor or acting
Mayor, to order tho offender, whether white, lree per
son of color or slave, into custody, until the fine shall
be- paid or punishment inflicted.
See. 2. And be it further ordained, that Section 1,
of an Ordinance passed in Council, July 22,1839,
which section regulutes the urruugomen tof the public
lampB, be aud the same is hereby repealed, and that
section 4, providing for the election oi a lamp con
tractor, be and the same is hereby declared to have
reference to gas lights established or to be estab
lished in the streets, public buildings, or market.
Sec. 3. And be it further ordained, tliut all ordi
nances and parts of ordinances militating against this
ordinance,be and they are hereby repeuled.
