Tlte City Surveyor, Ci ty Marshal, and all 0tilers interested, are hereby notified to observe and enforce the provisions of the Ordinance passed in Council, 19th August 1839, re lative to the,Surveyor's Duties, Pavements, &.o„ and more particularly tno followitig Sections thereof, viz : See. 2. Bo it further ordained, That no lot holder, or occupier of any lot, shall lay the foundation of tiny building or feneti on the lino of any lot or part of a lot,used or occupied liv him or her, untbss such line lo first, ascertained by the City Surveyor ; mid after tho line as aforesaid is, ascertained, sueli owner or occu pier shall not plnee any building, fence, or other thing appertaining thereto, so ns to effect the right of the eity, and unless the said Surveyor is present, (ex- eept as hereinafter specified:) And it shall lie the du ly of the City Surveyor to report to Council all en- roneliments, liy individuals or otherwise, that now exist, o^ that may hereafter he made, on the public squares, streets, lanes, docks, or commons of the city : And it sluill also lio tho duty of the City Sitr- vojtir, on the application of any lot-holder, to attend nil'll stake (ilfsuch lot. within twenty four hours after such application is made. See. 3. He it further ordained. That the City Sur veyor shall he entitled to demand and receive the fill ing fees : For Surveying n lot, finding and placing stakes, eighteen inches long, at the angle of said lot, Two dollars. For attending anil directing the placing n house or fence, Three dollars. For sub-dividing a lot already laid off, One dollar. Sec. 4. Be it father ordained, That it shall be the duty of the City Surveyor to keep it complete map of each tytiling in this City, on a scale o! 20 feet to 1 inch, to be hound in a suitable bonk, anil therein re cord the site nml dimensions of all buildings in such tylhiugs, and on the margin and at the foot of such map, make a note of such delineation of such buil dings or improvement, and the (latent his attendance; and the said City Surveyor shall, when thereto re quirod, deliver over to Ins successor in office, all re cords and documents which relate or appertain to the duties thereof. Sec. 5. Be it further ordained, That no person shall bring, lay, put, or cause to be brought, laid or put any timber, brick, Btoue. or other material for build ing, or lire wood, goods, wares and merchandize, or other bulky thing whatsoever, and permit niut sutler, the same to continue aud remain in any square, street, lane or alley within the said City for a longer time than six hours; nor shall any person permit or sutler any curt, dray, waggon or carriage of any sort to stand nml remain in any square, street, lane or uiley longer than such time us aforesaid; nor ahull any per son, without previously obtaining tho written consent of tho Mayor and two thirds of the monikers of the City Council, place, erect or construct, or cause to he placed, erected or constructed, in any square, street or lime, or other place, of or in thc’City of Savannah, any booth, tent or other obstruction; nor shall any person digor cause to be dug any hole or pit in any square, street, lane or ally, whereby the free passage of persons on foot or on horseback, or in or with any enrriuge, may he in tiny wise obstructed or render ed unsafe. And any person offending against the provisions of this section shall on conviction he sub ject to a tine not exceeding $100, for each nml every offence, or corporal punishment, if the person lie a sluvo or free person of color ; and ill ease the person or persons making, causing, permitting or suffering such encr achmeiits, obstructions and nuisances as aforesaid, shall refuse or neglect to remove the same forthwith, after notice giveirto him, her or them for that purpose, then the same (in such cases as will ad mit thereof,) ahull lie removed by the. Marshal and Constables of said City or any of them, at the proper expense of the person or persons offending ; and if any person or persons shall molest or trouble the said Jlarslmlor Constable in the execution of such bis or their duty, such person or persons shall on convic tion thereof forfeit and pay a tine of not exceeding $100 if u white person, or corporal punishment if the off ender be a slave or free person of color. Provid ed ulways, nevertheless, that any person or persons actually building or repairing, or about to build or repair any building, may collect and levy all such materials as may be necessary for such building or repairs in the square, street, lane or alley next adjoining to tlie place or spot whereon such build ings or repairs are intended to be made , and pro vided, that such materials ho so enclosed in a sufficient spuce (mid no more) as will effectually prevent the spreading Into the streets, lanes or squares; anil the said space so enclosed slmlliu no way extend beyond 19 feet on any street, lane, or square; and during all such time as such materials shall so lay in any square, street, lane or'alley, the owner or proprietor of such materials shall cause a lamp or lantern with a good und sufficient light therein to be securely hung up. placed or fixcif on post or* otherwise, at each of the two corners,of such enclosure,and in such manner as clearly and plainly to show the place and extent occupied by such materials ; and said lamp or lan tern shall be lighted at or before dark in the evening, and shall continue to burn until daylight. And the City Marshal and the City Constables arc hereby enjoined to notice and report to the Mayor all en- crochmcnts, obstructions or nuisances mentioned herein. Sec. G. Beit further ordained, That no person shall be permitted to increase or level the height of the side walks in front of hia or her lots above or below the common level of streets as ascertained in the accom panying map; and no person without the permission of the .Street and Lane Committee, shall throw any dirt, filth or rubhinh, or any matter or material what soever in any street, lane or square,* by which the proper level established may be destroyed: and all offenders and encroachments against the provisions ot this section shall he dealt with as prescribed in the fifth section of this ordinance Sec. l(i. Be it further ordained, That whenever any person owning or leasing or possessing any lot, shall pave, or in any manner alter the surface of a public street in front of his lot. he shall be bound to conform to the levels ami inclinations marked on the accompanying map—for which purpose he shall call on tlie City Surveyor, whose duty it shall be to grade and stake down the space to lu* paved* or oth erwise altered, both on the line of the lots and the limits herein before determined in the street—driv ing a stake at every ten feet of line; and the said Surveyor shall attend within five days alter he shall be requested to do so, aud he shall receive from the person calling on him, for such survice, the sum of Five Dollars per lot, except corner or trust lots, and for these he shall receive Ten Dollars per lot: and if such person so owning, leasing or possessing any lot, shall, within ninety days thereafter, finish the surface so marked in a good and substantial manner, by paving the side-walks with llag-stoues or bricks, mid placing a good curb on the outer limits, of stone or of bricks well laid in mortar, then, upon the same being certified hy the City Surveyor, or Street and Lane Committee, the amount paid to the Surveyor by such person, shall be refunded to him out of the City Treasury : And any pavements hereafter to be made, which shall not conform to the provisions of this section, shall be considered «n encroachment* and may he removed in the manner specified in the fifth section of this ordinance : and the person vio lating the same, or the owner, lessee or possessor ol the lot, may be fined by tho Mayor, acting Mayor, or Alderman presiding at tho Police Court, or by the Council, in a sum not exceeding $100; and a like penalty may be inflicted upon any person who shall alter the position of any ot the slakes so placed by the City Surveyor.
