The decided and correct Stand Taken by Judge Grier —the Judge 8 opinion of the Northern Fanatics. [ From th c Vh iladelphin Ledger, Oct. 18.] Yesterday ufternoon, about half past 3 o’clock, an alleged fugitive slave was brought to the Marshal’s otfice, by the Deputy Marshal, assisted by Constable Agon, of Third ward Southwark, m\9 Messrs. John Thornton and Thompson Tally. He whs arrested while at work as a hyd carrier, on the Ridge Road near poplar street, at the instance ot his master, Thomas P. Jones, of Cecil county, Maryland. Tho name of the alleged slave is Henry Garnett. He ap pears to he about 25or 27 years of age, and has been absent from his master for eight yours, lie was ac companied by a young man of his own color, who desired that he might have counsel, which request was granted. Tho warrant for the arrest of the slave was issued by Justice Grier, and the rignt of owner ship and identity of the person were heard by him. The right of property in Henry Garnett was trac ed through several wills, to tho present master, T. P. Jones. Ilia identity was about to ho established by Mr. Jones and others, when Mr. Pierce, for the prisoner, asked that the case bo postponed until a future period, to afford an opportunity to Chas. Gib bons to attend as counsel. Judge Grier said, that this was. to be sure, a summa ry proceeding, yet he desired to give the prisoner an opportunity to bo properly defended, and if he pro ceeded in a summary manner, it would bo owing to the ill advice the colored population were now re ceiving. He said he had read in the papers of meet ings being held, at which resolutions were pussed ad vising and urging the colored race to arm themselves against tho laws, and shoot down the officers of the law. If such advice should be taken, the first officer killed would be the signal for the extermination of the black race. All laws, he thought, would be set at defiance, »s they had been but a short time since, lie was as much a friend to the unfortunate race as any man, but he looked upon white men who would give advice of armed resistance to the laws, as the colored people’s worst enemies. If he were to ad journ this case until this day. he felt satisfied that thousands of blacks would assemble, perhaps, to re sist the laws. This would compel him to send to the Navy Yard for their whole military force, and as true as God liveth, and my soul liveth, snid tho Judge, I will maintain the law, though I have to order every man who puts himself in armed opposition to its ex ecution, to he shot down. I will execute the law as I find it, at all hazards. It was here suggested that the Jaws of Pennsylva nia made it illegal to place the prisoner in any of its prisons. The Marshal agreed to keep the alleged slave until this day. The Judge said, that if any mob should congregate black or white—with a view to resist the laws, it would be repelled, even to the shed ding of blood. The hearing of till! case was then post poned until this morning. Philadelphia, Oct. 18, 1850. The United States Circuit Court Judges, Grier and Lane assembled this morning to consider the case of Henry Garnett, claimed as a fugitive slave by Thomas P. Jones, of Cecil county, Maryland A formidable array of counsel appeared for the defendants ; David Paul Brown, YVilliurn S. Pierce, and Charles Gibbons, Esqrs. The counsel for the claimant is Hugh YY r . Toner, Esq. Tho prisoner is now 25 years of age, and can hardly be said to have been a slave, as by tin* will ot his former mistress, Margarotte Saunders, lie was bequeathed, in December 1838. to Benedict Jones, (of whom Thomas P. Jones is the executor,) with the express provisions that he should he free at 30.— The owners will probably claim a further servitude, to remunerate his owner for the time that he has elupeed since he became u fugitive, but this will be a question tor the Maryland .State courts. This case being the first aris ng under the new law, was brought before the court nt the desire of Judge Grier. t of the evidence of the claim was heard yes terday, but was recommenced dc nova, on account of some of the counsel for the defence having then been absent. Charles Gibbons, Esq., on tho part of the defence, objected to the admission of the wills alluded to as evidence, becuuap not certified to in the form pre scribed by the act of Congress of 1790, requiring the seal of the State, and of the Court. Judge Grier de cided that the wills were promptly ccititied accord- ing to the requirements of the law under which the claim is made. Mr. Gibbons then objected that there was no proper certificate that Thomas P. Jones wus the present executor of the estate. Judge Grier said that the law had plainly laid down the required proof of the ownership and escape which should he made in the State where the claim ants reside, so that tho court or commissioner should have nothing there left to decide upon, but the mere question of identity. The law he said, was plain, and this court could not relax its provisions because the claimant had not thought proper to employ counsel to have them drawn in legal form. The wills were therefore rejected. Mr. Tenor, on the part of the claimant then sub mitted affidavits of certain witnesses, taken before the authorities of Cecil county, that a slave belonging to the late Benedict Jones had ran away in 1842. These being in the required form, were admitted, and wit nesses were then produced as to his identity. Rich ard Somans, formerly of Cecil-county, testified to the prisoner having been a reputed slave otthe late Ben edict Jones, from 1838 to 1842, when he ran off. A son of Benedict Jones, deceased was next offered as a witness, but objected to by the counsel lor the tugi- tivn as a party interested. The court seeming inclined to favor this objection Mr. Teller asked that the case be postponed until to morrow morning to enable the' claimants to have the necessary papers produced. Judge Grier said, before this application should be argued, it must be taken into consideration that be fore he had issued the warrant for the arrest ot the alleged fugitive he had warned the claimant that his vouchers were irregular, and not such as would he likely to stand the searching inquiry that would pro bably be made into such an exciting case. He li^d taken this precaution because of the excitement which the arrest of a fugitive would createiand in view ot his determination to maintain the surpremaey of the laws at whatever hazard of file, or expense. He nad, in anticipation of difficulty consequent upon the trea sonable doctrines lately promulgated by persons ot white color and elevated standing iu society, obtained a large police force from the Mayor ot the city, and even notified the cammandants of the United States forces in this vicinity to hold themselves in reudiness to repeal any attempt at treasonable violence, cards. Oct 12 Fifteen days Inter from California—$1,000,. OOO in Gold Dust. The U. 8. Mail Steamship Crescent City, Capt. Stoddard, from Chagres, via: Kingston and .tumni- ca, arrived at her wharf in Now York, at half past 3 o’clock Friday morning. The Crescent City brings 342 passengers, one mil lion dollnrs in gold dust ill the hands of tho passen gers, and twenty two thousand live hundred dollars on freight. General News. The principal item of nows from San Fralicisco is the continuance of failures, espe cially of banking houses. The Pacific News of the 17th ult, says:—-Three of the largest firms have made assignments during tho past three days, viz : Simmons. Hutchinson & Co., Henry Howison, nnd Finley, Johnson & Co. Humor relates Borne curi ous tales in connection with business transactions. However tiiis is always the case where a man or firm tail to meet their engagements., it also nays con fidence now seems in a grout measure to be again restored, nnd those bankers which have passed through the ordeal, may now be regarded as occupy ing a better position than before. On the other hand, the Alta California of tile 15th Sept, says: we cannot hut regard financial matters at the present time as in u very unsettled state, and confidence lins been impaired to a very considerable extent. Shipment of Gold Dust. Wo oau safely say that the shipment of gold from this country, during the month of August, exceed that of any other mouth siiico the discovery of the mines.. The amount is al most incredibly large, verging on three millions of dollars. This sum has been regularly manifested, and is exclusive of the purcels carried through by private hands. A rich silver mine has been discovered near Car- son’s, by Hr. Brown. The vein is n foot in widtli and is supposed to extend over a distance of JO miles. VVe have a specimen in our possession which con tains fc'O per cent, of silver.—Sonora Herald, Sept. 1st. Panama. In tho Panama Star of Uctober4th, we find an amusing account of a very rediculous attempt at revolution on that Isthmus. The object of the Revolution is said to have been to declare the Isth mus independent of the Republic of New Grenada. The revolution, if such was intended, wns nipped ill the bud, yet the affair seems to have excited quite au alarm among the peace loving iuhubitants, and on the part of tile authorities. Rumor set any number of stories afloat, among which was one assigning the lendcrthip ot thu move ment to Gen. Flores. The aotiroriLics are active in obtaining testimony to warrant them in arresting certain suspec ed individuals. The Granadians, and all well-disposed foreign residents, have hern culled on to enroll themselves in the National Guard to pro tect the rights of the Republic. Some of the lenders ol die Revolution have shipped for California, and tho revolutionary elements urc probably scattered for the present.
