Spoeeb of Hon. Edward B. Hardon.
We devote a largo portion of our space to-day
to the able speech of Hon. EnwAitn It. UahDen,
one of the seceding delegates ft-om the Charles
ton Convention, In which lie represented the
Fifth District of Georgia, Judge Uaiuikk is a
native of Savannah, where his father resided un
til he was nearly fifty years of age, nnd was at
one time Collector of tho Port. In 1854 Judge
Harden was appointed, by President Pieuob,
Associate Judge of the Supremo Court of Ne
braska, In which capacity he administered the
uath to the first Territorial Legislature, nud
lield the’ first Supreme Court in that terri
tory. During his residence in Nebraska lie
had opportunities of knowing the views
of tho original settlers of that region,
who, at that time, never dreamed of such a ’
doctrine os that the people of a Territory, in
their territorial organization, had the right or
power to interfere with the Institution of slavery.
No one knows better than Judge Harden the
mischievous" Influence of Senator Doijolas’
Squatter Sovereignty doctrine, nnd no man lit
the State is more uncompromising in his hostili
ty to tho pernicious heresy.
Judge Harden has recently beeu appointed
Judge of the Supreme Court of Utah, which ap
pointment we believe he has not yet accepted.
Wo may be permitted to hopo that lie will not
accept, as wo feel confident that he can render
better service to bis country by remaining In his
native State nnd doing battle against those who
would betray the South Into the hands rf flic
Squatter Sovereigns, than by administering law
to the Saints.
U. B. Circuit Court-United States vs. C. A. L.
Lamar.
On the opening of the Court yesterday morn
ing the District Attorney proceeded to argue
the point raised on the preceding day, when Mr.
Owens, for tho defense, objected to the follow
ing question, being propounded to the Juror
ou the eofr dire, via:
"Have you any conscientious scruples against
punishment by Imprisonment for the olVenscs
charged In thebltl of Indictment ugalnst the pris
oner at the bar.”
District Attorney Cooper argued nt length,
and cited several authorities, among them jus
tices Ccrtis, ;Ghebn and Kane, In support of
his- position that the question was proper to be
put to the Juror.
The Court ruled the question to he lnadmissa-
ble In a misdemeanor case, and could only he
put to the Juror upon challenge for cause. No
common law authorities hnd beon adduced to
sustain tbc position of couusel for the prosecu
tion, nnd no United States decisions, except
such as be repudiated. In answer to tho argu
ment that the Court had permitted a similar
question to tbc Jurors In Cnpt. Farnum’s cane,
his Honor stated that originally, threo hundred
years ago, the coir dire had refbrence to religious
conscientious scruples against capital punish-
ment—it was afterwards. In this country, ex
tended to general conscientious scruples against
the death penalty. Tho Court had admitted tbc
the question In Farnum’s case, thepunlshmout
in that case being capital, for the reason that it
was analogous to the original coir dive.
Judge Jackson, for tho defence, then asked
the Court to ofiaw the Clerk to Instruct the
Juror about to be sworn on his voir dire as fol
lows:
“Before yourespoud to the question I
about to propound, you will understand that 11,
from conscientious conviction, or from feeling,
or from prejudice agalust tho United States gov
ernment, or from hostility to the laws enacted

whatsoever, yon are so opposed to the lutlictlon

ment, ns to fqel yonsolf uuahlo to listen fairly to
the testimony, of to bring a verdict of guilty
should the evidence show; that the defendant has

setts decisions. If he was so ruled he would be
led Into many; errors.

consented to ndmit Mr. Cheevcr's testimony, to
prove that the Wandorcr had performed the voy

The Court ruled thutAMr. Chcevcr must he ex
