Georgia Gazette. [No. 75 1 -) AN ORDINANCE ■or granting Licenses to Persons keeping Billiard Tables, ■ or retailing Spirituous Liquors* within the Limits of ■ the City of Savannah, and Hamlets thereof. I, DE it ordained , by the Honorable the Mayor and f dJ Aldermen of the City of Savannah, in Council assembled, and it it hereby ordained , by the puthority of the fame, That, from and immediately after Ehe pafling of this ordinance, if any person or persons within Rbe limits of the city of Savannah, er hamlets thereof, not feeing duly licensed agreeable to the tenor of this ordinance, [fliall at any time presume to keep a billiard table, ftudfle [board, or lkittie alley, tavern, inn, ordinary, punch house, porter house, ale or beer house, and shall retail any wine, brandy, rum, gin, porter, beer, cider, punch, spirituous or flrong drink under any name whatsoever, in any quantity less than three gallons, then he, Ihe, or they, so offending, and being thereof convicted before the City Council, fliall forfeit thefum of fifty dollars for every such offence; one half thereof to go to the person or persons so informing, and the other half to the use of the city. 11. And be it ordained , by the authority aforefail, That all applications in future Jo r licenses to keep billiard, tables, ihurfle boards, or lkittie alleys, or to retail spirituous lwtiors, within the limits of the city afortfaid, Hull be made to the City Council on their second meeting in March, June, September, an :l December, yearly and every year, v/ho may grant litenfes for billiard tables, lhutfle boards, or lkittie aile s, and retailing spirituous liquors, to persons applying therefor, mid producing good recommenda tierfs of their character and behavior, the persons so recom rnen ing being ibcurity in the sum of two hundred dollars, to be approved of by the City Council; which licenses Hull continue and be in force for the term of one year, and no longer* * 111. And be it further ordained, by the authority afo iv laid, That all persons intending to apply for licenses as afore laid Ih .11 give in their names, with the places of their abode, at least three days before .the meeting of Coun cil, to the Clerk thereof, and also a certificate, figtfej by two or more creditable persons, letting forth the applicant to be a fit person to obtain a liccnfe; and the Clerk fliall enter the names, with the places cf abode, of all appli cants, in a book to be kept for that purpose, and lay the fame before Council. IV. And be it ordained, by the authority aforefaid, That the City Clerk fliall deliver licenses, iigned by the M wof, or in his absence by the presiding Alderman, to such persons as have been approved of, and who ill all apply at his olfi.ee ahd produce a receipt from the City Treasurer for the following funis, (as the case may be) that is to fay: Licenses granted the second meeting of March, June, Sep tember, and December: Foi a billiard table, the fiun of two hundred dollars; a Ihuflle board or lkittie alley, one hundred dollars; and for retailing Ipirituous liquors in a smaller quantity than three gallons, and not lei’s than one qu irt, the sum of twenty-five dollars; and in a lexs quan tity than bite quart, fifty-two dollars; to commence from the day in which such licenses were granted, giving at tlie fame time security as aforefaid; and it ilia.ll be the duty of the Treasurer to make a fair and just entry, in a book to, be kept for that purpose, of the names and places of abode of ah nidi perfjii9 who fliall have taken out licenses, as aifo ot what films of money and securities he fliall have re ceived for the fame lo taken out, and lay the lame before the City Council whenever he flail be required so to do. V. And be it ordained, by the authority aforefaid, That the form of such license fliall be as follows: City Council of Savannah. This is to certify, That bath given bond, agreeable to law, for two hundred dollars, with security, for his due compliance with ail the laws that now are and which fliall be enabled and be of force in tins flute refpeding taverns, punch houses, and retailers of spirituous liquors, anJ keeping of billiard tables, so fiir as the lame relate to the city of Savannah, •and the hamlets thereof, and alio all the ordinances of the city relative to the fame: Fherefore the said is hereby authorised to retail lu’tbe house wherein-he now rcfidcs in, in •street, ward, and in no other place whatever in Savannah, from this dqy of in the vt..r of our Laird until the day cf next ensuing. Given under my hand and the seal of the city, the day above mentioned. VI. And be it further ordained , by the authority aforefaid, That no peribn having obtained* a license fliall keep more than one billiard table, IhuiSe board, or lkittie alley, or retail spirituous liquors in mere places than one, under the penalty of two hundred dollars; nor in any other place than tlie one mentioned in .such license, without hav ing firfi given notice to tlie City Clerk of his, her, dr their removal; whereupon the Ckrk ihall obtain from tlie May or, or presiding Alderman, a certificate on tlie back of such license, lpacifying their removal and place of aliode : And it any person (hall negleft or refufe so bring in their licenses sat the expiration of tlie time for which tlie feme was grant ed, or tor l'uch certificate in case of removal, he, Ihe, or they, lb offending, Ihall forfeit their license, and net have Another granted them for the term of one year thereafter. VII. And whereas many persons not having license make a practice of retailing spirituous and otlrer liquors, and evade the law by charging tlie buyer with three gallons or upwards, be it ordained, by the authority aforefaid, A fiat fiuch person or persons convicted of delivering a less quantity than three gallons at any one time Ihall incur the penalty of fifty ntfince. to be rccov red tend applied as herein after mentioned. VIII. And be it further erdainsd, by the authority FRIDAY, MARCH 1 6, 1798. aforefaid, That every pet lon taking out>a liccnfe for retailing of spirituous liquors in lots quantity than a quart find have plainly painted in letters not less than two inches in length, on ionic conspicuous place over the door, on the outside cf tite {hop or house fronting tin street wherein such spirituous liquors are fold* the name of such person, together with the words, “ Licensed Retailer of Spirituous Liquors.” IX. And be it further ordained , by the authority aforefaid, That every person or persons who have hereto fore taken out a license, or Ihall hereafter take out a license, for retailing spirituous liquors, neglefting or refilling to have plainly painted as aforefaid the names of such person or persons, together with the words, “ Licensed Retailer of Spirituous Liquors,” within the (pace of sixty days after the publication of this ordinance, ihall forfeit fifty dollars, to be recovered and applied as herein after mentioned. X. And be it ordained, by the authority aforefaid, That no retailer pi spirituous liquors (tavernkeepers except ed) Ihall fell or diipofe of any Spirituous liquors under a quart after candle light; and that ail retailers of Ipirituous liquors (tavernkeepers excepted) Ihall Unit up their fliops. every night at beat of|li um; ‘under forfeiture of fifty dol lars for every such offence, to be recovered as hereinafter mentioned* XL And whereas licenses have been heretofore grant ed at all times, and to ail persons, when they have been applied for, be it ordained , by the authority aforefaid, That no License for retailing ipirituous liquors under a quart Ihall be hereafter granted to any peri’ * who has not been a refidenter of this city for one year prior to his, her, or their application for the fame, or to any officer under the Corporation, or to any pilot for the port of Savannah, butcher, baker of bread, overleer, carpenter, joiner, brick layer, plasterer, fliipwright, filter or goldlniuh, lhoeniak er, fmilh, tanner, cabinetmaker, cooper, tailor, or to any person exercillng any trade w hatfoever, unkls it Ihall ap pear that by age, or any losses, misfortunes, licknefs, or by the number of such person s family, he is thereby ren dered incapable of maintaining his laid family by his labor in fiich his trade, of which circum.tance the Council Ihall judge. XII. And be it ordained, by the authority aforefaid, That all fines and forfeitures Incurred under tins ordinance to the amount of fifty dollars ihall be recovered bv levy of distress and fide of the offenders-, goods and chattels, by warrant under the hand and leal oi the Mav or or prefiding’ Alderman; and ail funis above the penalty of the bond jlndi be feed for. And be it ordained, by tlie authority aforefaid, That an ordinance, entitled; An Ordinance for granting Licenses to Persons therein deferibed, puffed in City Coun cil the fifteenth April, one thousand leven hundred and ninety-two, be, and the feme is hereby repealed. February 23. Bythe Ihip Lively, Moultrie, which ar rived here on Wecltitfday from London, we have the un pleasant information of two ft.ips from Liverpool for these islands, the Manchester and Union, being captured by French cruisers; the former lent into Guadaloupe, and the latter to Bourdeaux. The brig Diana, Daniel, from this port for London, was taken tlie 12th of November* by the Felix privateer of Nantes, and retaken on the 23d of the fame month by the •Sylph Britifli Hoop of war. The Frenchmen taken in the Diana informed Capt. White of the Sylph/ that on the night of the 16th of November the Felix was upset in a sudden gust, and, though not a quarter of a mile from the prize, 137 persons on board, includiug 22 Britifli and Ame rican fcamen taken in several prizes, were drowned. Wylly. 1 , r By this vessel advices are received of the homeward bound Jamaica fleet having cleared the Gulf, and of Sir Hyde Parker being off Cuba witfT a powerful fquadren. February 27. By a wrecker which arrived yesterday from the westward inCrfligence is received of three Spanish veflels, laden with gunpowder, from La ‘Vera Cruz for Havana, being captured by Admiral Sir Hyde Parker’s squadron off Cuba, and that they may be momently expell ed here. Yesterday the Lark privateer brig, Tucker, of this port, returned from a crude, with the American (hip Fabius, Cook, from Savanna la Mar, having on board a large quantity of logwood, for which there was tio clearance. ILc Fabius, (oon after coming into harbor, was taken pos session of by an officer from the Topaz frigate. A fehooner arrived this afternoon in three weeks from Martinique. The army and navy in the Weft Indies had enjoyed better health for several months past than at any former period fmee the commencement of hostilities.
