THE Court, in pursuance of an order of the 15th of
March, 1798, from Sir Parker, Knight, Vice
Admiral of the Red, and Commander in chief of fiis Ma
jesty’s ftiips and vessels employed, and to be employ ed, at
and about Jamaica, ficc. Sec. addrefled to George Bowen,
Esquire, Captain of his Maiefty’s Ihip Carnatic, and Third
In command, being firft duly fwott, proceeded to try- An
thony altar Antonio Marco, John Elliot, Joseph
Man fell, and Peter Dehmy, alias Pierre d’Orlanie, upon
an information contained in a latter from Captain Mends,
of his Majelly’s sloop Diligence, of the 27th of October,
1797, to the Commander in chief, and otie from Captain
Crawley, of his Majesty f t (hip Valiant, dated the Bth off
Mvch instant, and aifo the deposition of John Mason, late
Carpentjr's Mate of his Majesty’s Ihip Hermione, taten in
the presence of the said Captain Crawley, and Lieutenants
Philpot and Hancock, of the Valiant, dated the Jtd of the
said month of March, representing that the laid Anthony
Mark, alifs Antonio Marco, John Elliot, Joseph Man
fell, and Peter Del any, alias Pierre d’Orlanie, were a part
of the crew of the French privateer la Magicienne, captured
by the laid (hip, and alto a part of the crew of his Majesty’s
said ship Hermione, and were aftuaily on board his Majesty’s
said Hup Hermione at the time the mutiny, murders, and
piracy, were committed onboard her; and for being taken
in arms againll his Majesty.
And having heard the evidence produced to identify the
persons of the prilbners, and very maturely and deliberately
weighed and confidertd the several circumftartCes in the let
ters and paper above mentioned, and theprifoners having no
evidence to produce, or any thing to offer in their own de
fence, the Court is of opinion that the charges of mutiny,
murder, and running away with his Majesty’s said ship Her
toione, and delivering her up to the enemy, and being
found aftualjy in Jinm against his Majesty and his fubje&s
bn board la-Magicienne, a French privateer, are folly
proved. *
The Court do therefore adjudge the said Anthony Mark,
alias Antonio Marco, John Elliot, Joseph Manfell, and
Peter Dclany, alias Pierre d’Orlanie, to be hung by theft
necks until they are dead, tit. the yard arms of inch of his
Majesty’s ships, and -at foch times, as Hull be directed by
the Commander in chief*
And, as a further example to deter others from commit*
ting, or being acceflbry to such (hocking and atrocious
crimes, that, when dead, theirbodies be hung in chains
upon gibbets, on fifth conlpicuous points or headlands as
the Commander in chief {hall direct. And they are hereby
sentenced to be lo hung until they are dead, and their bodies
gibbeted accordingly, 4
