the hope the public will feel convinced they are tumble
tq assign any particular or cogent reasons. 1 have there*
forte to request you will do me the favor of giving it a

IN your paper of the loth instant 1 find Thomas Gib
bons endeavors to thrthy a veil over his conduct in the
best manner he can, but does he deny one charge exhibited
against him in your paper of the 6th instant signed A Pa
trol Man? No, he docs not, noi\cannot; lie confirms all
I have stated.’ The question is, What right had he to
authorise any assembly of negroes? 1 deny lie had any.
But, suppose I had imprisoned Bouclie improperly, is the
verbal order of mr. Gibbons sufficient to take him out of
Custody? This is a point of law which the court will de
termine. I am ready to meet any prosecution Gibbons
chooses to conduct for Bouclie; I have only done my duty
agreeably to the commander in chief's orders, lately pub
lished, commanding all officers, from the general down,
to execute the patrol law stridbly, and doubt not, from,a
fair statement of fads, he, and every honest good man
and citizen, will approve of my conduit; I have sworn to
support the laws of the state, and will endeavor to do it.
Thomas Gibbons asks why no mention has been made
of col. Tattnall, who sanctioned this dance, and why has
his note-been suppressed? In answer to which I have only
to observe, that, on the morning of the 4th, col. Tattnall
came forward, and, on inquiry, found that Free Jim and
Bouclie had abused the confidence placed in them, and had
admitted all negroes indiscriminately with and without
tickets from their owners. The colonel approved of my
condud, and has offered to give a certificate of it, Did
Gibbons do so? No, but the direct contrary; he even
threatened me with a prosecution before he saw Bouclie.
I am ready to meet him at any thing he pleases, except
clubs; a two years illness disables me from engaging in
personal contests; besides, I never was a bully. In con
sequence of publishing fads he Can’t deny he met me, and
attempted to break my head with a club or bludgeon, on
Saturday last, but was disappointed, and came off second
best. ‘ For this outrage he shall answer at a tribunal of
his country, before which I shall call him and Bouclie as
soon as a grand jury may be convened.
1 informed alderman M‘Credie, on the morning of the
3d instant, that a riotous house had been kept in his neigh
boi%Riod for some time past, as I had been informed, and
that it had been sandioned by the mayor and council. He
denied that the council had granted any permission, or had
been applied to, and he believed he might venture for the
mayor. I told him, let who wculd grant permission, I
would know* the truth that night, as it was very improper,
and complained of By many of the citizens; that 1 wished
him, alderman M'Credie, to be with me, as in that case
the civil would support the guard, and the guard the civil
authority. Accordingly, at 11 o’clock that night, I called
on the alderman, who was out; I then went to major
Mitchell; he was in lied; I afterwards met some respect
able citizens, who have been longer in the habits of doing
patrol duty, and were better acquainted with the patrol
law; X shewed them Gibbons’s ticket; they denied he had
any such authority, in his private or official capacity, and
advised the whole assembly of blacks to be carried to the
gaol. 1 accordingly ordered the whole to the guardhouse,
reexamined their tickets, aud found them as stated on the
6th instant. I was compelled to commit Bouche; ho was
impudent and insulting; but I discharged the negroes.
‘Hie subsequent conduct of Gibbons and myself is fully
stated on the 6th instant. Citizens, to your approbation
or censure of my conduct I cheerfully submit, “and am,

N. B. This is not the first time Gibbons has granted
permission; Bouclie offered to shew me many tickets he
said he had of a similar nature. The house has been com
plained of as a nuisance for some time past, let Jeremiah
Cuvier sav what he will. Official information has been
lodged with one of the aldermen, who reprimanded Bouclie.

WHEREAS official communication has been made
to the Executive of the death of James Jones,
late Representative of this state in the Congress of the Un
ited States:
And Whereas, in and by an a<ft to regulate the Ge
neral Elections in this state, and to appoint the time of
the meeting of the General Assembly, puffed on the ele
venth day of February, one thousand seven hundred and
ninety-nine, it is declared, “ ‘That in case any person duly
elected, being in this state, and notified thereof, in man
ner herein directed, shall not within twenty days, and if
out of this state, within forty days after such notification,
signify his acceptance, or shall depart this life, the Governor
or,Commander in chief shall order anew election to be
held in like manner as herein before pointed out: And fur
ther, that all writs of election to fill vacancies that may
happen for Members of the General Assembly of this state,
or House of Representatives of the United States, shall
be directed to the Justices of the Inferior Courts of the
respective counties, who are hereby required to give public
notice thereof, and cause the same to be held in manner
and form as herein pointed out, agreeably to such writ:”
I have therefore thought fit to issue this my procla
mation, notifying, directing, and ordering, the respective
Justices of the Inferior Courts of this state to consider this
my proclamation as a general writ of election for the dif
ferent counties of this state, for the purpose of filling the
vacancy of a Member in the House of Representatives of
the United St-.ifes, in the room of the aforementioned
James Jones, who was elected to that seat for two years
from the fourth day of March next: And I do hereby re
quire and charge the said Justices to promulgate this pro
clamation, and give due notice thcrcof; which said election
shall be held in the respective conn ies of the state, agree
ably to the terms and directions of the said aCt, on Mon
day the twenty-third day of Marcli next, of which all per
sons are required to .take flue notice; and the saiu Justices
are hereby required to make due return of such election to
the Executive Department as in and by the said act is
pointed out.

IT is with great pleasure we announce to the public, that
the fliip Thomas (late Admiral Duncan) is by the molt
uncommon exertions railed from the rocks which she drift
ed upon a few days since, near Corlaer’s Hook, and Dow
lies in fafety. At the fame time we are sorry to add, that
between 5 and 600 Calks of flaxfted, bolides fome flour,
Sc c. are totally loft.

cember, 1800. •
“ 011 account of an earthquake which did much dam
age here in October, and a severe hurricane on tire 2d
November, the duty on flour and provisions brought in
vessels belonging to the United States is. reduced to 10 per
cent, for fix months from the 20th inflant, which I pray
you will make known to the merchants of the United
States.”
Capt* Whelden informs that lye left Cuxhaven on the
sth December, at which time there was a great number of
Prussian troops there; it was expedted -they would proceed
in a few days agairil Hamburgh.
On Fuefdav last the legiilature of this date unanimously
defied the lion. John Armflrong, efq. a lenator to repre
sent this date m the senate of the congress of the United
States, to take his feat the 4th of March next.
Philadelphia, January 3t. 0 Y'efterdav arrived and
fired a lalute, the flip Edipfe, capt. Jones, from Calcutta.
Sailed from the Sand Heads in company with the (hip Re
becca, .Pitt, of ard tor Baltimore, and brig Lydia, (late
rvulnll) of and for New York. .On the 12th October, off
the Sami Heads, 1 poke the Nonfuch BrltilTT frigate, capt.
Canning, who informed, that the lion, -company’s fliip
i\.ent had been taken, on the 7th October, by the French
corvette LaConfiance, capt. SirccufT, of 20 guns and 220
men, alter an action of two hours, in which the captain
and 11 men were killed, and 44 wounded, and that the
privateer at length fucceeued by boarding; that the prison
ers dated the privateer had captured 7 fail from Bengal,
and an American Indiaman, bound in, name unknown;
and that he (capt. Canning) was miffing for the privateer.
On tne 15th October again Ipoke the Nonfuch. Capt.
Canning dated that the dav before he boarded a vessel from
Puli Penang, and was informed that Batavia surrendered,
on the i2xi September,, to 5 Britifli frigates, a 50 gun
fliip, and the 12th regiment of foot. On the 23d of Oc
tober. the frigate Nonfuch in company, discovered a fail
in light, gave chafe, continued it the next dav, and dis
covered the chafe to be an enemy; 2.Britifli frigates mere
m light, the chal; was continued, and the frigate gained
upon tne f.ivatetr, the Gonfiance, and wa^
Tiileu by the Nonfuch, and informed that rant q
