Search raises issue of police misconduct

“Please take the guns off the kids,”
Ms. Green pleaded. “What can they
do?” The police ignored the requests.
Then the threats came. .
“Did you know you can lose your
house for having drugs? You know
your son is doing drugs... You know
why we're here! You know where he’s
at...We can call Family Services to
night and take these kids away from
you right now!”
Finally, after searching for nearly
two hours and with frustration mount
ing for both the police and the occu
pants, things came to a head. After
ordering everyone to stay in the living
room, police entered Sabrina’s bed
room one last time. It was then, they
“ound the dope — or so they say. None
of the residents in the house were shown
any illegal narcotics. The police merely
said they found some and then the
badgering began all over again.
“Who's gonna claim the dope!?” the
police shouted. Finally, since the dope
(a marijuana cigarette) was allegedly
found in Sabrina’s room, they took her
to jail, but not before promising to
return and get Mr. Green.
The foregoing description is obvi
ously not a police account. It was the
account told from the point of view of
Ms. Rogers, Ms. Green and Mr. Green
who witnessed the raid from woods in
the rear of the trailer. According to the
residents, after terrorizing the women,
destroying property, ransacking the
house, tearing siding from the frame of
the trailer, ripping up the upholstery

cating histitle, the police did not present
a search warrant.
Richmond County police officials,
however, say the raid was executed
according to the law. Investigator
Mathue Phares, the person in charge of
the raid, told Augusta Focus Ms. Green
was presented a copy of the search
warrant upon entering the premises
and left a copy behind as the law re
quires. Ms. Green said that never hap
pened.
“They never showéd me no search
warrant,” Ms. Green said. “They said it
was in the car. I never saw it and never
got no copy of it.” No one else in the
house reported seeing a search war
rant.

an attempt to ascertain the existence of
a search warrant, the police could not
or would not produce one. Further, no
copy of the search warrant was perma
nently stored in any police or court
office, prompting questions as to the
proper or efficient routing of sensitive
public documents. After hours and
days of getting the runaround in police
and court chambers, Augusta Focus
was able to at least ascertain the exist
ence of the warrant. Apparently, it was
signed on March 7 by a Judge Slaton.
The search warrant is all important
cases of this type because the residents
are charging the police with gross mis
conduct, violation of constitutional
rights and planting narcotics. The war
rant must state exactly why the police
conducted the raid and it outlines the
parameters within which police must
operate. A copy of the warrant must be
provided to the citizen or citizens tar
get by the raid. If the Greens are to be
believed, this has not happened and the
police are guilty of violating their con
stitutional rights.
If the police did not follow the letter
of the law, it would be apparent by
investigating the warrant.
Further, the 10-day time limit within
which the warrant must be returned to
theissuing magistrate, hasexpired. Since
the warrant was issued on March 7, it
should have been properly returned and
documented by court officials by March
17. This has not happened.
Legal experts suggest that because
of the failure to handle the documents
properly within the 10-day window,
any evidence collected by police would
likely be inadmissable in court.
