Suit Seeks Election
Os Demo Delegates
ATLANTA (UPD— A suit con
tending that the Democratic
party of Georgia does not give
its rank and file an “effective
voice” in choosing delegates to
the party’s national convention
has been filed in federal court.
The suit, by Andrew A. Smith
and Henry M. Henderson, seeks
the election of delegates to the
convention by popular public
vote, the procedure used by
many other states.
Delegates are now appointed
by State Democratic Chairman
James Gray with the advice of
Gov. Lester Maddox.
The action contends that "the
person calculated to become the
leader of any such delegation
to the national convention un
der present circumstances is
openly and notoriously champ
ioning the cause of a self-pro
claimed opponent of the Demo
cratic party.”
Maddox indicated Thursday
he had no quarrel with the
suit’s contention, but added “I
don’t know who would finance”
such an election.
“Maybe the attorney who
brought the suit has the money.

The suit further states that

The petition also protested the

ATLANTA (UPD—CoI. R. E.
Burson, head of the Georgia De
partment of Public Safety, said
today he “probably” will tem
porarily cancel all leave for
state officers as a result of the
slaying of Dr. Martin Luther
King Jr.
Burson said that so far, how
ever, no special plans had been
set into action to meet any
emergency set off by King's
death.
"We will alert our officers all
over the state,” Burson said.
“Then if they are needed for
any purpose they will be
ready.”
The top police officer in the
state said that he assumed the
state patrol would be called on
to assist Atlanta policemen in
directing traffic.
Burson said he had received
no reports of any disturbances
in the state as a result of ths
death except for the outbreaks
