Judge Denies Directive
To Jury To Acquit Shaw
NEW ORLEANS (UPD—
Criminal Dist. Judge Edward A.
Haggerty Jr. declined today to
direct the 12-man jury hearing
the Clay L. Shaw assassination
conspiracy case to acquit the
silver-haired defendant. The
defense was to begin its case
immediately with testimony
from Marina Oswald Porter,
U. S. Marines Capture
Enemy Artillery, Guns

SAIGON (UPD—The U.S.
commander in Vietnam, Gen.
Creighton W. Abrams, said
today there was “massive
evidence” that the Communists
would launch a new offensive.
Gen. Abrams said, however,
he did not think there would be
a major attack on Saigon,
although he said the city might
be shelled.
"There is massive evidence
that there will be an offensive,
or at least they want to launch
one,” the general said during a
visit to 9th Infantry Division
headquarters at Dong Tam, 37
miles southwest of Saigon.
He would not say when he
expected the offensive to begin.
In the battlefield, U.S. Ma
rines leapfrogging from peak to
peak above the A Shau Valley
in northern South Vietnam
captured one of the biggest
equipment hauls of the war and
killed 107 North Vietnamese
defenders, military spokesmen
said today.
Offshore, the USS New
Jersey, the world’s only active
battleship, prepared to return to
the United States. Informed
military sources said the vessel
would end its tour of duty off
Vietnam in mid-March, as part
of its regular rotation schedule.
The Marines smashed through
stiff Communist resitance and
100-degree heat to seize two
122 mm artillery pieces, a five
ton artillery tractor, a truck
and an antiaircraft machine gun
on hilltops commanding the
valley that leads from Laos
toward Da Nang.
The 9th Infantry Division Gls
summoned reinforcements and
reported killing 35 guerrillas at
a cost of two killed and eight
wounded. The battlefield was 63
miles southwest of the capital.

In Ankara, Turkey, early this
year, U.S. Ambassador Robert
W. Komer watched from a
window of a campus building of
the Middle East Technical
University as leftwing students
overturned his automobile and
set it afire.
Then, according to the story,
he sat down and ate his lunch
with the university rector.
There is no record of
disciplinary action against the
students.
with Lee Harvey Oswald and
David W. Ferrle, to murder
President Kennedy.

South Vietnam, it was getting to
be an old story.
To their shouts of “Down with
the United States ” the students
have added “Killer Komer!” to
their list of epithets.
Those who attempt to explain
anti-Americanism on a local
basis find three possible causes.
One is a general belief that
the United States sided with
Greece against Turkey in the
dispute over Cyprus.
Another is the presence of
American troops in Turkey
under NATO and a feeling,
exploited for propaganda purpo
ses, that NATO infringes upon
national sovereignty.
A third is the reduction in
American aid to Turkey,
expected to be phased out
entirely in 1972.

be in the hands of the jury
sometime next week.
Shaw’s defense set out on the
27th day of the trial to prove his
principal accuser is a “notorie
ty-seeking liar.” One of its chief
witnesses was his father. The
key state witness to the alleged
conspiracy is Perry Raymond
Russo, 27, a book salesman.
The defense, in its opening
statement to the all-male jury,
said that “We will prove that
the man who says this is a liar
—a notoriety-seeking liar.”
Huge Surprise
However, it now contends
Russo pulled a huge surprise on
the state and told the truth on
cross examination by saying
that in his opinion the talk he
heard was no conspiracy.
That was the basis of a
motion for a directed verdict of
acquittal made by defense
attorney F. Irvin Dymond
Thursday after Dist. Atty. Jim
Garrison rested his case. Judge
Edward A. Haggerty Jr. said he
would read all of Russo’s
testimony overnight and rule on
the motion today, the 27th day
of the trial.
Russo’s father, Frank, sub
poenaed on Valentine’s Day, is
reported to be ready to testify
as a willingly hostile witness.
Also subpoenaed by the defense
was former Texas Gov. John B.
Connally whom the state had
subpoenaed and then failed to
call.
As for a conspiracy, which is
defined in the law as an
agreement or combination of
persons for “the specific
purpose” of committing a
crime, Dymond told the judge:

"Russo’s testimony destroyed
the contention that there was
ever an agreement or combina
tion.”
Among the defense witnesses
was Mrs. Mary E. Bledsoe, one
of Oswald’s former landladies,
who says she saw him on a bus
a few minutes after the
Kennedy murder, Col. Pierre A.
Finck, a military wound patho
logy expert, and William
Gurvlch, a key Garrison investi
gator who resigned In June,
1967, and said he had found “no
truth” in the conspiracy allega
tions.
Also ready to testify was
Alvin Beauboeuf, a friend of
Ferrie’s who accompanied him
to Houston the day after the
assassination, who has tape
recordings of what he says was
a bribe offered to him to
buttress conspiracy allegations.

released a statement approving
Nixon administration proposals

Judge Rejects Sirhan
Effort To Enter Plea

LOS ANGELES (UPD—Sir
han B. Sirhan is willing to go to
prison for life but he does not
want to take his chances with a
tury of going to the gas
chamber.
The admitted killer of Sen.
Robert F. Kennedy offered to
plead guilty to a charge of first
degree murder provided he had
the assurance there would be no
death penalty.
Superior Court Judge Herbert
V. Walker rejected the “com
promise” and ordered the trial
to proceed.
The “plea bargaining” was
officially confirmed Thursday
when the judge made public the
transcript of a secret session in
his chambers at which defense
counsel Grant Cooper asked for
a mistrial because of news
stories of the offer to plead
guilty.
Motion Depled
Walker denied the motion.
The Judge also revealed that he
personally was the source of

ALDRETH, England (UPD—
Hie Aldreth Housing Committee
was delighted to approve plans
for a two and a half acre
recreation site until they
discovered the naked truth.
The Cambridge Outdoor Club,
which has applied for a permit
to turn the tract into a
recreation site, wanted to turn
the land Into a nudist colony.
The club had omlted that
fact from its application. “We
didn’t say we were nudists," a
club official said. “What differ
ence does it make?”

minutes after midnight on June
5.
Such an entry would help
establish premeditation by Sir
han In the killing of Kennedy
who had advocated arming the
State of Israel In its defense

states.

Thursday afternoon Walker
made public the transcript of
the closed session.
Earlier in the day, Cooper
cross-examined a police officer
for an hour and suggested he
was lying about giving Sirhan a
sobriety test.
Officer Travis White was one
of the policemen who took
Sirhan to the station shortly
after the shooting of Kennedy in
a pantry of the Ambassador
Hotel.
The officer maintained that
Sirhan showed no signs of
intoxication, such as alcoholic
breath, weaving or lack of
balance, and it was his opinion
Sirhan was not under the
Influence of liquor.
