NAACP Files
Suit Against
Textile Firms
WASHINGTON (UPI) — The
NAACP Legal Defense Fund to
day announced it is filing a suit
challenging the legality of con
tracts totaling $9 million by the
federal government awarded
three textile firms which had
been cited for employment dis
crimination.
A fund spokesman said it was
hoped the suit would result In
voiding the contracts let Feb. 8,
to Dan River Mills, Inc., J. P.
Stevens Inc., and Burlington
Industries.
The suit charged the Defense
Department and other govern
ment agencies violated Presi
dent Johnson’s 1965 executive
order forbidding government
contracts to firms that do not
meet federal standards in their
employment practices.
Robert Belton, attorney for
the fund, told reporters he be
lieved the suit to be filed later
today in federal district court
here is the first of its kind
against the government itself.
Belton said the suit charges
that the Defense Department
acted illegally in awarding the
three big textile contracts with
out first obtaining any written
program of equal employment
opportunity for Negroes for
firms that had already been
cited for failing to meet gov
ernment standards in this area
on defense contract work.
The suit comes in the wake of
a controversy in which civil
rights organizations charged
Sen. Strom Thurmond, R-S.C.,
with pressuring the Defense De
partment to award the contracts
without obtaining the required
written programs.
Thurmond issued a statement
Monday charging the executive
order goes beyond the law in
that it, in his words, demands
reverse discrimination in favor
of Negroes over Whites.
Since the controversy arose
two of the firms, Dan River and
Burlington, have submitted
written programs.
Belton said the suit does not
flatly demand the contracts be
void but said this could be the
result of the court action.
