Georgia Bar Plans
To Appeal Ruling
MARIETTA, Ga. (UPI) — At
torneys for the Georgia Bar As
sociation said they would appeal
a Cobb County Superior Court
judge’s ruling that declared the
bar "unconstitutional, null and
void."
Alexander Cocalis, one of the
attorneys for the bar, said the
decision would definitely be ap
pealed to the Georgia Supreme
Court, which recently declared
that the organization was con
stitutional.
Superior Court Judge Luther
C. Hames Jr. Wednesday de
cided the bar was created as
an administrative arm of the

law which contained wording
“amounting to convert, surprise
and clandestine legislation in
seeking to tie the hands of the
Supreme Court."
Hames ruled in the case of
Marietta attorney Stephen Olah,
whose case is now being con
sidered by the bar’s discipline
committee. He is accused of
stealing records of drunken
driving suspects from the Civil-
Criminal Court clerk’s office
here.
Hames did not rule on the
charges themselves, but enjoin
ed the discipline committee
from proceeding with its ac
tions. A Cobb grand jury had
decided the matter should be
handed over to the state bar
rather than be pressed in the
courts.
Grounds for the decision in
cluded the charge that the bar’s
exercising legislative power
over lawyers through a private
group created by the Georgia
judiciary was a violation of the
separation of powers policy,
that bar members must pay
what is actually a “tax” that
must be paid into the state gen
eral fund, and that the judicial
branch cannot exercise legisla
tive powers, nor can it dele
gate such powers.

Joe Maddox
Will Stay
ATLANTA (UPI)—Gov. Lest
er Maddox has announced he
would keep Atlanta real estate
executive Joe Maddox on the
State Pardon and Parole Board.
The governor thus quashed
persistent reports that he would
kick Maddox off the board.
Maddox is no relation to the
governor.
Joe Maddox was appointed to
the controversial board to re
place J. W .Claxton, who re
signed rather than face im
peachment proceedings.
But the governor did not send
Maddox’s name to the Senate
for confirmation in the recent
session, leading to speculation
he was looking for someone to
replace him on the three-mem
ber board.
The Claxton term Maddox was
filling expired at the end of
1968, and it was necessary for
the governor to appoint Maddox
again even though he had
served less than a year.
Maddox now has a full seven
year term on the board.

Seniors Question
Members Os
Congress
TOCCOA, Ca. (UPI) —High
school seniors from six North
east Georgia counties put ques
tions to members of Congress
in a forum here Wednesday.
Sen. Herman E. Talmadge,
asked about President Nixon’s
decision to deploy the antibal
listic missile system, (ABM) said
he agreed fully with the decis
ion.
Congressman Phil Landrum
said, however, that he’s reser
ving his opinion.
The forum at Stephens County
High School brought seniors
from Stephens, Franklin, Hart,
Raburn, Banks and Habersham
counties together for the ques
tion and answer session. Talma
dge was asked the results of his
hunger tour of school lunch
rooms in Georgia.
“In this two-day tour I have
found that some of the children
that go to school hungry leave
with their bellies full because
of the lunch program," he re
plied.
As for the ABM policy, Tal
madge ’aid, “I support the de
cision fully. We don’t know that
it will work. If it doesn’t we
have spent $2 billion for an un
usual purpose.”
