Supreme Court
Makes Ruling
On Jury Picking
WASHINGTON (UPI) -The
Supreme Court ruled today that
Georgia and Alabama have
been practicing discrimination
against Negroes in selecting
juries.
But the court, in two opinions
by Justice Potter Stewart,
refused to strike down the
general state jury laws which
in general require jurors to be
citizens, of specified age, “of
good character.” “well in
formed,” and the like.
Stewart said earlier Supreme
Court rulings have left the
states free to restrict the
selection of jurors to persons
with such qualifications.
In the Georgia case, the court
did strike down a requirement
that limits school board mem
bership to property owners.
“It seems impossible to
discern any interest the qualifi
cation can serve,” Stewart said.
The school board situation
came into the case because in
Georgia members are chosen
by grand juries.
States having jury selection
laws similar to those of Georgia
and Alabama are Arizona,
Arkansas, Connecticut, Florida,
Illinois, lowa, Kansas, Louisia
na, Maine, Maryland, Michigan,
Missouri, Nebraska, New York,
North Carolina, Oklahoma,
South Carolina, Texas, West
Virginia and Wisconsin.
The Alabama case was
brought to the court by three
Green County Negro residents—
Willie Carter Sr., John Head
and Rev. Percy McShan—who
claimed they are qualified to
serve as jurors but were never
chosen. They attacked the state
law in Federal District Court in
Birmingham.
The governor appoints the
jury commission, which then
selects the jurors.
The Georgia case was initiat
ed by Calvin Turner of
Crawfordville, in Taliaferro
County, where the 3,369 res
idents are 62 per cent Negro.
