Carswell Rejects
Georgia Speech
By MICHAEL J. CONLON
WASHINGTON (UPI) - Su
preme Court nominee G.
Harrold Carswell has rejected
as “obnoxious and abhorrent” a
white supremacy speech he
reportedly made 22 years ago
while running for the state
legislature in a small Georgia
town.
The 1948 speech was un
earthed by a Jacksonville, Fla.,
television station Wednesday
and its copyrighted account,
along with a rebuttal from
Carswell, were aired nationally
on the CBS-TV evening news.
Station WJXT said Carswell
made the speech to an
American Legion meeting in his
hometown, Irwinton, Ga., while
he was editing one of two local
weekly newspapers, the now
defunct Irwinton Bulletin. The
speech, printed in the paper,
was reported as having read:
"I yield to no man as a fellow
candidate or as a fellow citizen
in the firm, vigorous belief in
the principles of white supre
macy, and I shall ways be so
governed.”
The account also said:
“I am a Southerner by
ancestry, birth, training, inclin
ation, belief and practice. I
believe that segregation of the

races is proper and tne only

state.”
Carswell, a U.S. Appeals
Court judge, from his home in
Tallahassee, Fla., said in a
statement “I do not subscribe
to those views now. I am not a
racist.” he also said:
“Specifically and categorical
ly, I denounce and reject the
words themselves and the
thoughts that they represent.
They’re obnoxious and abhor
rent to my personal philosophy.
There is nothing in my private
life, nor is there anything in my
public record of some 17 years
which could possibly indicate
that I harbor racist sentiment
or the insulting suggestion of
racial superiority. I do not and
my record so shows. Incidental
ly, I lost that election because I
was considered too liberal.”
The Nixon administration was
also quick to defend Carswell,
whom it nominated for the high
court earlier this week. Attor
ney General John N. Mitchell
said “all available evidence
indicates that Judge Carswell is
firmly committed to the
constitutional and moral philo
sophy of racial equality.
“His judicial record on civil
rights issues is highly commen
dable. I think it is unfortunate
that a judge of Judge Car
swell’s high qualifications could
be subjected to criticism based
on political remarks made 22
years ago.”
FBI Holds Three
In Yablonski Deaths
By STEPHEN MORROW
CLEVELAND (UPI)-Three
men with no apparent ties to
the United Mine Workers Union
have been arrested by the FBI
in connection with the execu
tion-style murders of UMW
official Joseph A. “Jock”
Yablonski, his wife and his
daughter.
Aubran Wayne Martin, 23,
and Claude Edward Vealey, 26,
who have minor criminal
records, and Paul Eguene Gilly,
37, were arrested here Wednes
day —just 16 days after the
bodies of the Yablonskis were
found in there home at
Clarksville, Pa.
The men were to be
arraigned here today in federal
court.
In Washington, FBI Director
J. Edgar Hoover said the
investigation would continue
and UMW President W. A.
“Tony” Boyle expressed “de
light” the three suspects
apparently had no union con
nections.
Applies For Job
But in Morgantown, W. Va.,
Ray Martin, associate editor of
the Morgantown Dominion-
News, reported in today’s
edition Gilly applied for a mine
workers’s job in Monongalia
County, W.Va., just two weeks
before the killings and was
turned down. The newspaper
did not elaborate on the report.
Martin, Vealey and Gill were
jailed on federal charges of
interfering with the rights of a
union member by force or
violence, obstruction of justice
and conspiracy to interfere with
a union member’s rights. They
spent the night in a maximum
security section of Cuyahoga
County Jail.
Hoover said the arrests
resulted from “wide-ranging
and extensive investigation
throughout the United States.”
Police indicated further arrests
may be coming.
Pennsylvania State Police
and the district attorney of
Washington County, Pa., meet
today to discuss the filing of
murder charges.
Bodies Found Jan. 5
The bodies of Yablonski, 59;
his wife Margaret, 57; and their
daughter Charlotte, 25, were
found by a son, Kenneth, when
he went to their home Jan. 5
after being unable to reach the
family by telephone for several
days. Authorities said the
slayings occurred New Year’s
Eve.

CIVIL DISOBEDIENCE AR
GUED
WASHINGTON (UPI) —The
government’s top lawyer has
told the Supreme Court that to
permit a draftee to choose not
to fight in a specific war, such
as Vietnam, could seriously
undermine the nation’s prin
ciple of majority rule.
Solicitor General Erwin N.
Griswold argued Tuesday that
if conscientious objectors
properly refuse to fight in
Vietnam on moral grounds,
other citizens could ignore
desegregation laws because of
“conscientious scruples against
racial equality.”
Griswold argued in the appeal
of John H. Sisson Jr., of
Lincoln Mass., who was con
victed in March, 1969, of
refusing induction because he
opposed the Vietnam War.

Q) Do you have to itemize
your medical expenses to be
able to deduct one-half of Blue
Cross or other medical insur
ance premiums?
A) You don’t have to item
ize your medical expenses to
claim this deduction but you
have to choose the itemized
method of claiming your de
ductions. In other words, you
can’t use either the standard
or minimum standard deduc
tion if you want to deduct
medical insurance premiums.
One-half your medical in
surance premiums (but not
more than $150) should be
shown on line 1 of Schedule A
and added to your other listed
deductions and the Schedule
attached to the Form 1040 you
file. Instructions for using
this Schedule A are printed on
the back of this form. Copies
of the Schedule are provided
for your convenience in the
1040 tax package.
Q) My wife and I are filing
separate returns. Can I itemize
while she takes standard de
ductions?
A) No. Married couples fil
ing separate returns must
handle their deductions the
same way. If one itemizes de
ductions, the other must also
itemize.
Married couples filing sep
arately must also take the
same type of standard deduc
tion. If one takes the 10 per
cent standard deduction, both
must take it.
