after 50 years

along Flatbush Avenue in 1922
when Brooklyn sent a promis
ing young Jewish lawyer
named “Manny” Cellar down
to the 68th Congress.
Now 84, Chairman Emman
uel Cellar of the House Judi
ciary Committee is packing
up 50 years of Washington
memories and heading back
to a Brooklyn law office as the
92nd Congress fades into his
tory.
Only one man, the late Rep.
Carl Vinson of Georgia,
served longer in the House of
Representatives. Vinson had
50 years and 47 days to his
credit. Cellar wUI be just shy
of 50 years when his term offi
cially ends next Jan. 3. He
was sworn into office on
March 20, 1923.
He probably feels a tinge of
humiliation and perhaps a
touch of disappointment in the
voters over his primary elec
tion defeat by a 30-year-old
activist woman lawyer named
Elizabeth Holtzman. Miss
Holtzman is a dedicated sup
porter of Sen. George McGov
ern. She won by 542 votes. Had
McGovern faced strong oppo
sition in the New York prima
ry last May Cellar might have
won his primary. But McGov
ern was virtually unopposed.
Only 12 per cent of the Demo
cratic voters bothered to go to
the polls and a high percent
age of those were pro-
McGovern youngsters who
apparently felt CeUar was
“just too old.”
The age factor has been
working against many in Con
gress this year. Cellar is only
one of four veteran House
chairmen defeated in the pri
maries. Reps. George Miller,
D-Calif., of the Space Com
mittee; Floyd Aspinwall, D-
Colo., of the Interior Com
mittee and John McMillan,
D-S.C., of the District of Co
lumbia Committee, also
bowed to younger rivals.
In his 50 years — 22 of them
as chairman of the Judiciary
Committee — Cellar has left
an indelible mark on the na
tion’s lawbooks. He authored
or he co-sponsored some 400
laws.
Manager of most civil
rights bills passed in Congress
in this century, he also guided
to passage the constitutional
amendment that gave the
vote to 18-year-olds. He
blocked an amendment to au
thorize prayer in public
schools; he failed to block the
equal rights for women
amendment. He maneuvered
the censure of the late Rep.
Adam Clayton Powell, D-
N.Y., and he stymied Repub
lican attempts to impeach
Justice William O. Douglas.
His opposition to Women’s
Liberation arguments added
a touch of irony to his defeat
on record, that she has fully
administered said estate: This
is, therefore, to cite all persons

they can, why said executrix
should not be discharged from
her administration, and receive
Letters of Dismission on the
first Monday in December, 1972.

Cellar has been a “no bones
about it” liberal. He and the
late Sen. Estes Kefauver
wrote the only important anti
trust bill passed by Congresss
in the last 20 years.
He was also the author of
legislation that ended the
“country of origin” quotas for
immigration.
Regarded as one of the best
debaters in the House —a
chamber where that quality is
not abundant — Cellar some
times was likened to the late
Sen. Everett Dirksen of Illi
nois. Both liked to pull Shake
speare quotations into their
arguments. But where Dirk
sen could stroke Shake
speare’s lines with his soft
midwestern tongue, Cellar
scratched at them in gruff
Brooklyn tones.
In recent years, Cellar and
Rep. William McCulloch of
Ohio, ranking Republican
member of the Judiciary
Committee, worked in close
tandem on landmark civil
rights bills. McCulloch, too, is
leaving Capitol Hill this fall.
He is retiring after 26 years in
Congress. Rep. Richard Poss
of Virginia, second-ranking
Republican on the committee,
also is retiring.
If the Democrats retain
their majority in the House,
Cellar will probably be suc
ceeded as chairman by Rep.
Peter Rodino Jr. of New Jer
sey.
If Republicans carry the
House in the Nov. 7 election,
Rep. Edward Hutchinson of
Michigan would be in line for
the chairmanship, followed by
Rep. Robert McClory of Illi
nois.
