that they were asked to commit perjury

WASHINGTON (UPI) — Two
former officials of President
Nixon’s 1972 campaign were
ready to swear at today’s
Senate Watergate hearing that
they were asked to commit
perjury to protect higher-ups
and Nixon’s re-election chan
ces.
Summaries of the testimony
of Powell A. Moore, former
deputy press spokesman for the
Committee to Re-elect the
President (CRP), and Herbert
“Bart” Porter, former schedul
ing director for CRP, were
made available to UPI. Both
have been questioned privately
by the committee staff about
what they will say in public
today.
Both said former deputy
campaign director Jeb Stuart
Magruder instructed them to lie
to investigators.
Porter said Magruder admit
ted to him recently that he had
prior knowledge of the Water
gate break-in. He said Magrud
er told him he has perjured
himself 12 times.
Invokes President’s Name
Porter also said Magruder
invoke 4 the name of President
Nixon on three occasions in
asking Porter to lie about what
G. Gordon Liddy did with
1100,000 of the money given
him.
Porter quoted Magruder as
saying it would look bad—and
might hurt Nixon’s election
chances—if it were known that

the money were given Liddy for
“dirty tricks."
Liddy, the “mastermind” of
the bugging of Democratic
headquarters, has never talked
publicly about his role. Convic
ted, he awaits sentencing.
Perjury came up, too, when
Hugh Sloan Jr., former CRP
treasurer who said he distribut
ed about $1 million in early 1972
without asking about its use,
testified Wednesday he told
Magruder that he did not intend
to perjure himself about the
$199,000 he gave Liddy.
He quoted Magruder’s reply:
“You may have to.” Magruder
wanted him to testify that he
gave Liddy only $40,000, an
amount easier to justify.
Evidence Not Pursued
Sloan said he emphasized this
to chief Watergate prosecutor
Earl J. Silbert and the other
prosecutors, but they did not
pursue his evidence of a
coverup during the trial of
seven Watergate conspirators
in January.
“If I were the prosecutors, I
would request an opportunity”
to appear at the hearing and
rebut such damaging tes
timony, Sen. Daniel K. Inouye,
D-Hawaii, a committee mem
ber, told UPI.
“We would certainly be
available for them and happy
to testify if requested,” Silbert
replied.
Fearful that pretrial publicity
resulting from such inflamma
tory Senate testimony might
commit perjury if questioned about more than $1 million in
cash he shelled out for mysterious purposes early last year.

Asks Delay in Hearings
Cox earlier had asked the
panel to call off its hearings for
three months. Unanimously, the
committee refused.

“The court has no power to
grant the petition of the special
prosecutor,” Sen. Sam J.
Ervin, D-N.C., committee
chairman, said. “Under the
Constitution, the Senate com
mittee, acting as an arm of the
Senate, has the power to
conduct its investigation free

from interference of either the
judicial or executive branch.”
The dispute may be aired
Friday when Sirica is to hear
arguments from Cox’s staff and
from Samuel Dash, chief
counsel to the Senate commit
tee. The dispute then will
concern the Senate’s requests

for grants of immunity from
prosecution for Magruder and
John W. Dean HI, another
former White House aide. Cox
opposes granting immunity.
Still Up in the Air
Also still up in the air is the
refusal of former Commerce
Secretary Maurice H. Stans to
testify before the Ervin com
mittee. Stans’ lawyers will ask
a judge in New York City
Friday to rule that the dangers
of pretrial publicity and his
indictment for lying to a New
York grand jury preclude his
testifying here.
At today’s Senate session, the
staff questioning shows, Moore,
the CRP publicist, was to
testify that Magruder asked
him to lie before the Watergate
grand jury.
Moore said Magruder asked
him to testify that he learned of
the June 17,1972, break-in from
Moore, who had heard about it
from newsmen.
