Child support

If each partner in a mar
riage obtains a divorce, and
the terms of the two divorces
differ, which one is binding on
the departed husband?
Q. I got a divorce from my
wife in Nevada in 1972, and
my wife got one in California
the same year. She filed first,
but mine came through first.
My divorce decree says noth
ing about my paying alimony
or child support, but hers
says I must pay child support
and two-fifths of my military
retirement. I now live in Ari
zona. Doi have to make these
payments?
A. Once a divorce court or
ders the father (or mother) to
pay a specified amount for
child support, he or she must
do so unless the court modi
fies the order or the child be
comes of legal age, marries,
or is emancipated (Ca. Fam
ily Sec. 4700).
Where or when the divorce
was granted is of no conse
quence when child support is
involved. Under terms of the
Revised Uniform Reciprocal
Enforcement Act, Sec. 9 (now
the law in every state) the
former wife can file in the
California court for an order
of default if the husband does
not pay the amount ordered
by the divorce decree
The county attorney in her
county then transmits the de
fault order to the county at
torney in the state where the
husband is living, and it
would be enforced there.
Failure to pay could result in
a contempt citation.
Q. I'm told a widow’s dower
is no longer paid in Illinois.
Does this mean a widow’s
right in property earned dur
ing marriage is paid in an
other way if the husband dies
without a will?
A. Illinois abolished dower
by legislative action Jan. 1,
1972. Now the surviving
spouse takes one-third of the
entire estate if there are sur
viving children, or all ofit if
there are no children (111.
Rev Stat 3-11).
Q. My brother died in Octo
ber, 1972, and left a $700,000
estate (in Pennsylvania) to
another brother and me. The
bank serving as executor has
not sent us a penny as yet,
and they keep telling us the
government is auditing the
estate. What can we do to get
the estate settled? It has been
over two years now.
A. Pennsylvania law says
real and personal property
must be appraised and the in
ventory filed by the executor
within three months after his
appointment (Pur. Pa. Stat
Sec. 20-3301). The executor's
first account to the court
must be filed within six
months, and claims of credi
tors must be filed within one
year (Pur. Pa. Stat. Sec. 20-
3385).
The court can postpone
these actions by the executor,
but only for substantial rea
sons. You may go to the clerk
of the common pleas court,
orphan's division, in the
county where the estate is be
ing administered to find out
what is causing the delay.
Q. Is a holographic will I en
tirely in the maker's hand
writing) valid in California?
If so, and the maker leaves
everything to his surviving
spouse, can surviving grand
children sue if they are not in
cluded in the wiir I choose to
leave everything to my pres
ent wife, who is not the natu
ral grandmother of my
grandchildren.
A. Yes, California recog
nizes a holographic will, one
wholly handwritten on a
blank piece of paper dated
and signed by the maker and
filed with his most important
papers. No witnesses are re
quired. (Ca. Prob. C. 53). The
law says your properly exe
cuted will can be contested,
but the interested contestant
must prove you were mental-
ly incompetent or under un
due influence (destruction of
your free will by another)
when you omitted your
grandchildren from the will
(Ca. Prob. C. Sec. 370).

ahead: Although it rarely
happened in the past, do you
now receive repeated dun
ning notices from your credi
tors? If this has been happen
ing to you, you probably don’t
know where all the money
you are spending goes. You
may be cashing more checks
to purchase nonessentials
than you have set aside to pay
your bills.
One certain way to stop
that drift is to discontinue us
ing your charge accounts —
all of them. If your bills are
now larger than you can pay,
make certain that you are
paying something on each bill
every month.
If your dunning notices are
to the threatening state, take
the step of contacting them —
tell your creditors that you
are having financial prob
lems, but are willing to pay
your debts. The large major
ity of commercial stores and
creditors will be so pleased,
that they will likely assist
you, or at least stop the
threats. By the way, utilities
should be the first bills paid
each month after your rent.
Question No. 6: Lately,
does the withdrawal column
in your savings passbook
have more and larger entries
than the deposit column?
This is a problem which no
doubt is familiar to every
family in America. With our
spiraling inflation and rising
costs, if we do not earn what
we are spending to live, that
money has to come from an
other source, usually our sav
ings.
The problem with that solu
tion is that savings are de
signed as financial insurance,
not for living expenses. Espe
cially in these times, you
should view your savings ac
count as very real living in
surance.
So, if you are depleting
your savings, a change is in
order — and the change is to
either earn more or spend
less. Although some econo
mists recommend six months
of earnings in your savings
account, that number is prob
ably unrealistic for most
families. Three months sav
ings is certainly a goal that is
well worth the effort to strive
for.
Question No. 7, You’ve bor
rowed before on your life in
surance, but this time, are
the chances of paying it back
more remote?
Although borrowing money
from your life insurance
policy is an inexpensive way
in which to obtain cash, re
member that if you don’t pay
the money back, your benefi
ciary’s insurance proceeds if
you should die before all
money borrowed was re
turned, will be the face
amount less any sum still ow
ing, plus accrued interest.
