Lee Patterson plan to appeal
the two consecutive life sent
ences their client has been
ordered to serve for the
slayings of two law enforce
ment officers.
Defense attorney C.B. King of
Albany is expected to file an
appeal within two weeks to both
the murder conviction and the
sentences Patterson received in
the shooting deaths of state
trooper James Young and
Cordele policeman W. R.
Haralson.
Superior Court Judge W.L.
McMurray imposed the sent
ence Tuesday after relieving a
hung jury of the task of fixing
the penalty.
Patterson’s lawyers said im
mediately that they would
appeal.
McMurray had to impose the
life penalty because Georgia
law permits the death sentence
only if a jury recommends it
unanimously.
Patterson, 25, showed no
emotion as McMurray handed
down the sentence.
The black Marine, a native of
Gastonia, N.C. stationed at the
Albany Marine supply depot,
had claimed he shot the two
white officers in the Cordele
police station last May 4 in self
defense because he feared for
his life.
The jury had found him
guilty of murder in just two
hours and three minutes last
Wednesday but spent approxi
mately 27% hours without
success in trying to determine
a sentence.
At various times, the jurors
reported they were split 7-5, 8-4
and 9-3, reportedly for the
death sentence. Under state
law, it had to fix the sentence
at either death or life imprison
ment.
McMurray relieved the jury
at 11:15 p.m. Monday, the
fourth day of deliberations on
the sentence, when it reported
for the second time in five
hours that it was deadlocked 9-

Eloise
damage
slight
ATHENS, Ga. (UPI) -
Georgia crops sustained only
moderate damage overall when
Hurricane Eloise brushed past
the state last week. Heaviest
damage was to western border
crops and those in northern
counties.
The Georgia Crop Reporting
Service said Tuesday the corn
crop apparently was heaviest
hit. Strong winds raked over
com fields along western
Georgia and heavy rains
flooded bottomland fields in
northern sections.
County extension agents es
timated that corn yield loss
varied from slight to 75 per
cent. Corn conditions, which
declined during the week, were
rated fair to mostly good.
The cotton crop sustained
some rain and wind damage
but condition ratings were still
mostly fair to good.
The state’s peanut crop
probably had the least damage
although digging operations
were delayed. Prospects re
mained favorable with the crop
described as in good condition.
Peacans declined last week
as winds blew green nuts off
the trees and snapped bran
ches. Overall conditions were
reported mostly fair to good.
Harvest was just beginning in
south Georgia.
