SAN FRANCISCO (UPI) -
Prosecutors used bank pictures
to show Patricia Hearst was
pleased with a Symbionese
Liberation Army holdup. The
defense will use the same
photographs — enlarged — to
show she was horrified.
Attorney F. Lee Bailey said
he would introduce the photo
graphs today and might finish
the defense’s case in the five
week U.S. District Court trial
by the end of the day’s
proceedings.
The prosecution was expected
to call several psychiatric
experts to rebut defense tes
timony that Miss Hearst, 22,
was brainwashed into becoming
an SLA bank robber and
terrorist. U.S. Attorney James
Browning Jr. said this might
take a day or two.
Then Judge Oliver Carter
would give his final instruc
tions. Observers said the case
could reach the jury by the end
of the week.
Prosecutors used the Hib
ernia branch bank security film
to show Miss Hearst had a
smile on her face when she saw
SLA confederate Nancy Ling
Perry shoot and wound two
bank customers in the April,
1974, holdup.
The holdup occurred about
two months after Miss Hearst,
daughter of San Francisco
Examiner President Randolph
Hearst, was kidnaped by the
SLA from her Berkeley, Calif.,
apartment.
Albert Johnson, one of
Bailey’s assistants, said the
enlarged photographs showed
Miss Hearst’s expression was
“one of horror.”

Will she get off?
SAN FRANCISCO (UPI) — F. Lee Bailey has all but
completed the defense for Patricia Hearst and the ques
tion from all sides is: “Will he get her off?”
It is a cynical question for it tromps immediately on the
fundamental of justice that a person is deemed innocent
until judged guilty by a jury taking into consideration
reasonable doubt.
It also is a logical question. The American people have
long ceased to be strangers to the fact there is a separate
and special brand of justice for the rich and powerful.
But in Miss Hearst’s case there is one basic that is
sweepingly ignored and it is a cinch the veteran criminal
lawyer will not let the jury forget it when he makes his
final argument.
Patricia Hearst is charged with robbing a bank and
wielding a deadly weapon that could have killed someone.
Nothing more. Nothing less.
She is not charged with joining a wierdo terrorist'gang.
She is not charged with spurning her parents. She is not
charged with smoking pot or taking LSD. In Los Angeles,
she is charged with assault with a deadly weapon and
kidnaping but not in this federal courtroom.
She is charged with robbing a bank. And put in that
frame the defense has a powerful case.
The prosecution has not attempted to deny she was a
legitimate kidnap victim. Nor have they substantially
shaken her stay that she was subjected to brutality by a

murderous cult that could have unhinged the mind of a
captured paratrooper, let alone a 19-year-old girl.
If that is so, why should it not take the jury more than a
few minutes to bring in a verdict of not guilty?
Take a look at the government case.
She did take part in a bank robbery. She was holding an
Ml automatic carbine. Bank movies show her waving it
around. A customer whose testimony was never shaken
said she told him to lie down on the floor or she would blow
his head off.
All of that, however, could be explained by what the
defense psychiatrists have termed “coercive persuasion”
—she was a dead little girl if she didn’t act that way.
The point where it all comes together is in the term
“credibility.” Is Patricia Hearst telling the truth? The
whole truth?
She has been lauded by Bailey as having been one of the
best witnesses on the stand he ever had.
TTie jury may think she was a little too good.
Some news accounts have had the defendant almost
drowning in tears when she talked about being confined in
the closets and sexually molested.
This reporter has sat in the courtroom for five weeks
and has yet to see her break down and cry. Her voice has
faltered, she has gulped for breath, her eyes have
reddened and she has dabbed at them with a
handkerchief, she has sniffled.
But the impression she left after a week on the stand
was that of a young woman of remarkable composure
with a sharp mind who took some scarcely concealed glee
in tripping up a government prosecutor who is not the
brightest in the business.
In a droning, almost whining, voice she told her story —
not once, not twice but perhaps a dozen times and always
in the same way as she was led through direct and cross
examination.
But it was what she did not tell that may sink Patricia
Hearst.
She will go up to the bank robbery and her shooting up of
a sporting goods store in Los Angeles, watching on
television six of her Symbionese Liberation Army captors
dying in a burning house.
After that it is as if a curtain had fallen on this
courtroom drama. She will provide only the haziest
account of what she was doing for the last 17 months
before her arrest.
She took the sth Amendment 42 times before the jury on
questions about that period, claiming the right against
selfincrimination but also pressing the point that if she
snitched she would put her life and that of her parents in
danger from terrorists still at large.
The thought, however, may have crossed the jurors’
minds that there is a possibility that somewhere along the
way Miss Hearst began to experience a kick, an
exhilaration, about her life with the underground and
being the most sought-after girl in the world, so to speak.
The question is when that might have occurred. Before
or after the bank robberry ? Or did it occur at all?
Three psychiatrists called by Bailey have testified she
was never converted to the ideology of the SLA. They say
all her actions can be explained by a fear so overriding
that she became mentally sick and could not control her
behavior.
She was playing a role to please her kidnapers, they say.
Could she not be playing another role now? the govern
ment asked. The three doctors agreed that was not so, that
she showed all the symptoms of the “survivor syndrome”
displayed by American prisoners of war released from
Chinese, Korean and Vietnamese captivity.
Their testimony was persuasive and it may be the
deciding factor in the case.
But the real job of persuasion is up to Bailey when he
makes his final address to the seven women and five men
who will decide Miss Hearst’s fate.
In that sense, it does get down to: “WiD he get her off?”
