Herd of wild burros
damaging environment
LOS ALAMOS, N.M. (UPI) -
A herd of wild burros that is
damaging the environment and
threatening historic Indian
ruins at the Bandelier National
Monument is increasing by
nearly one-third each year
because the animals have no
natural enemies.
The herd, initially composed
of domesticated animals that
were turned loose or strayed
from their owners, was first
noted in the north-central New
Mexico region in the 19305, said
Bandelier Superintendent John
Hunter.
N.C. patrolman reinstated
DURHAM, N.C. (UPI) - A
second North Carolina Highway
Patrolman, fired following a
roadblock shootout in which a
Virginia State Policeman died,
has been ordered temporarily
reinstated by a Superior Court
judge.
Judge Thomas H. Lee issued
a temporary restraining order
Wednesday directing patrol
officials to put Trooper Robert
P. Williams, 28, of Durham
back to work. A hearing in
Durham Superior Court on the
matter was set for Jan. 7.
Williams, 28, also filed suit
against three top patrol offi
cials Wednesday, seeking
$400,000 in damages. He con
tends in the suit that he was
wrongfully discharged and that
his civil rights were violated.
A hearing was scheduled in
Wake County Superior Court
today for Trooper D.H. Mat
thews of Franklinton. Mat
thews, fired with Williams for
allegedly violating patrol fire
arm policy at the roadblock,
obtained a reinstatement order
last week and has been working
at a desk job since.
Williams, a seven-year patrol
veteran, named Transportation
Secretary G. Perry Greene;
Col. E.W. Jones, patrol com
mander now on a leave of
absense; and Maj. Jack Cabe,
acting patrol commander, in
his damage suit.
He asked for SIOO,OOO in
compensatory damages and
SIOO,OOO in punitive damages for
the wrongful discharge claim
and similar amounts on the
claim that his rights were
violated.
In a telephone interview
Wednesday night, Williams said
he was “very elated” at the
prospect of returning to work.
He said he expected it would be
Friday before he could start
work again because of delays in
serving the court paperwork on
patrol officials.
While Matthews was ordered
reinstated at a desk job,
Williams expressed confidence
he would be able to return to
regular duty.
"The order states I will be
returning to full duty with full
benefits and full duty, I
assume, means just carry out
your normal duties," said
Williams.
Williams and Matthews were
dismissed and four other

“It has now grown to about
140 animals, and our research
indicates it is increasing at 29
per cent annually,” Hunter
said. “These animals have no
native enemies other than man;
natural predation is very
limited.”
Hunter said the burros eat
much of the grass in the area
and the loss of vegetation has
become a major source of soil
erosion. Additionally, he said,
the animals’ habit of “trailing,”
or walking in single file,
creates hard paths that lead to
water erosion.

Wednesday that a man charged

President-elect Jimmy Carter’s

trial
Dr. Joseph F. Alderete said
at a preliminary hearing before
U. S. Magistrate Joel Feldman
that in his (Alderete’s) opinion,
Otis M. Simone, 41, of Decatur
is not competent to be tried.
Feldman ordered Simone to
undergo psychiatric tests to
determine his mental com
petency.
Simone, a self-styled political
activist, was arrested last week
after he allegedly told an
inmate at the Fulton County
jail that Carter owed him
“thousands of dollars” for
campaign work.
The Secret Service charged
Simone allegedly indicated to
the inmate he would attack
Carter if he was not paid.
Alderete, said under question
ing by defense attorney Stanley
Nylen, that his examination
was not conclusive and involved
“a lot of educated guessing."
The doctor acknowledged he
spent a “very brief” time with
Simone and said that Simone

commandeered car as it
approached the roadblock. He
said he fired three more times
moments later after seeing
gunfire in the car and thinking
he was being fired upon.
He testified that Matthews
then approached the passenger
side of the car, looked in and
then jumped back, firing his
service revolver six times into
the passenger side door. Wil
liams said Conley was found
crouched on the floorboard of
the car on the passenger side in
front of the car.
Greene, at a news conference
at which he announced the
personnel actions, said the

Simone had been detained at
the Fulton jail, where he
allegedly made the threats, for
threatening Atlanta Mayor
Maynard Jackson’s life. He was
later released and arrested at
his home.
Nylen claimed the inmate
was a "stool pidgeon” and
concocted the story after
overhearing a conversation
between Simone and a Carter
campaign worker. In the
telephone discussion Simone
talked about compensation for
campaign work, Nylen said.
