ATHENS, Ga. (AP) - Fifty
major advertisers in the At
lanta area are violating fairness
in advertising laws, telling
customers they have stock
which is not available and
charging regular prices for sale
items, a state official said
Wednesday.
Dr. Tim Ryles, administrator
of the governor’s Office of Con
sumer Affairs, said he and his
staff have been shopping at “50
major advertisers in the At
lanta area and all have been
found in some violation.
“We’ve shopped, found these
violations and talked with the
managers,” he said. “We feel
they’ve had adequate notice and
now we’re building evidence for
litigation if necessary.”
Bill Mcßrayer, president of
the Georgia Retail Association,
said, “on technicalities, what
Ryles says is true.
“But, I don’t think his office is
going to go helter-skelter after
several hundred retail mer
chants in one swoop, but just go
after those who are flagrantly
violating the law,” he said.
Although Ryles said the ma
jority of retailers do not under
stand the advertising laws,
Mcßrayer said it is the retai
lers’ employes who are unsure
about the laws and inadvert
ently violate them.
Ryles said major problems
included “seeing the ad but
when you get there, that item is
not in stock.”
Some stores sell a similar
item at a higher price, and al
though a “rain check” on the
out-of-stock item is considered a
short-range solution, the use of
one would not be acceptable to
his office, he added.
Ryles said another problem
was regular prices left stamped
on sale items which customers
are forced to pay “unless you
literally fight for it at the
checkout counter.”
The consumer affairs office
and the retailers’ association
are holding a series of briefings
on the law around the state.
