Admission suffers setback
SACRAMENTO, Calif. (AP)
— In a setback for the Univer
sity of California’s minority ad
missions program, a federal
judge has ordered the admis
sion of Rita Clancy, a white
medical school applicant.
Mrs.- Clancy, a 22-year-old
Russian immigrant, will enter
classes next Monday at the UC
Davis medical school, which
had placed her at the top of its
waiting list.

Thomas Macßride issued a
temporary restraining order
Friday night requiring the uni
versity to admit her. He said
there was “a good likelihood”
she would have been admitted
but for a program reserving 16
of the 100 places in each medical
school class for disadvantaged
minorities.
While the legality of minority
admissions remains to be re
solved in the case of Allan
Bakke, now before the U.S. Su-
preme Court, Mrs. Clancy
would suffer if she were not ad
mitted immediately, Macßride
said.
Bakke, another white student,
was rejected by the Davis med
ical school in 1973 and 1974, and
was not placed on the waiting
list. He filed suit, saying less
qualified minorities were ad
mitted under the special admis
sions program.
The California Supreme Court
ruled last year that the program
violated Bakke’s equal
protection rights under the 14th
Amendment to the U.S. Con
stitution, and ordered him ad
mitted. But the U.S. Supreme
Court blocked that ruling from
taking effect while the univer
sity appealed.
In a long-awaited friend-of
the-court brief submitted this
week, the Justice Department
argued that the California Su
preme Court was wrong in its
decision.
The nation’s high court is
scheduled to hear arguments in
the Bakke case Oct. 12. A ruling
CDC cites
cholera
outbreaks
ATLANTA (AP) - The na
tional Center for Disease Con
trol has reported recent cholera
outbreaks in several Middle
Eastern countries and Western
Europe.
The CDC said Friday the out
breaks occurred in the Gilbert
Islands, Jordan, Lebanon, the
Syrian Areb Republic and Saudi
Arabia.
Other Middle Eastern coun
tries may have had outbreaks,
but the CDC said there were no
other reports filed with the
World Health Organization in
Geneva.
The cases in Western Europe
originated from other areas and
no secondary transmission was
noted, the CDC said.
Cholera is an acute infectious
disease marked by severe gas
tro-intestinal symptons. It is
spread by food or water con
tamination.

The university contends that
without a program that uses
race as a criterion for admis
sion, its classes would be vir
tually all-white.
UC had asked Macßride to
delay a ruling in Mrs. Clancy’s
case until the Bakke case is de
cided. University lawyers con
tended the state Supreme Court
ruling had no effect because it
had been stayed by the U.S. Su
preme Court.
But Macßride said Mrs. Clan
cy would suffer more harm by
having to wait another year to
reapply to medical school than
the university would by adding
another student to its class.
The judge’s order allows Mrs.
Clancy to attend classes
through Oct. 13, when a hearing
is scheduled on a preliminary
injunction that would allow her
to remain indefinitely.
If the injunction is denied, she
could be expelled. But her
lawyer, Merritt Weisinger, said
he is confident Macßride will let
her stay in school at least until
the Bakke case is resolved.
