" We regret to edviee the feilure of two houeen here, extensively engaged in the American trade, and which line again com pletely damped the cotton market. The ealee of the three data of thie week, have been 3400 bales, but the greater proportion cd tor auction two daye hence, and in addi tion, 1000 Uplands are to be offered by oth er*. We may quote them nominally to day : Upland*, from 8t to Hi ; Orleans, 9 o H t. The import into the kingdom to the &th innt. ie 551,500 bales, against 396,000 bales in the same time last year. The ex port 9000 this year, against 37,186 last year. When money is more plentiful and confidence more restored, we may have a more regular market, but at present other articles, as well as cotton, are affected by the distrust which prevails. The state of business in Manchester also is very unfa vorable, similar events being apprehended there, end we hardly ever had to notice so much commercial distress in the American trade, as we have seen of late. Wlioat has advanced 6d per bushel, owing to the vari able weather—but we look for no improve ment in flour—we quote it at 34 a 25a. per bbl. Rice more enquired for at 17 a 21s. The cautious expressions, in the conven tion, as to the time the lands should be ac quired for Georgia, scorn to have been used in consequence of the thon existing treaties of the U. 8. Government with the Creek In dians, by which the lands of the Indians hid boon guaranteed to them, 7 and un doubtedly were familiarly known to the Georgia Commissioners. That the terms were thought advantageous by Georgia, and too partial by citizens of other states, are evident from tho grotulntions of our citizens and the murmurs of tliuse of other states at the time. It hns been asserted by Gov. Troup that the U. S. Government made immense pro fit- by this convention,and ul our expence. ThisiB not true ; for if a profit tins accru al to the U. S.: it has not been at our ox- pence, hut of that of the claimants under t'ie Ynzoo act. For by a decision of tho 17. S. Supreme Cnurt. it was adjudged that the sale under tint act was valid** and consequently that. Georgia had no legal claim to tho laods when she ceded them to tlieU.S. If, however, she had an equita ble claim, she hns received a valuable con sideration. For hv the report of I lio Secre tary of war. it will be seen, that exclusive of four millions paid to claimants under tho Yazoo act, near four millions hnve been ex pended for Georgia, anil at loan one mil lion more will be required to complete the compact, so that we shall have reecivcd five millions of dollars for lands to which it &as boon decided, we had no legal claim It is also asserted, that the General Go vernment extinguished Indian titles to lands in Tennessee, when the same qunntity might have been obtained for Georgia. I bjjsh for those who make this charge— For who has or will forget the services of the brave militia of Tennessee during the last war? And what hsve theso men re ceived for their blond, but a small extern •inn of their stole territory ? But the extravagant invectives of Gov. T.oup against the General Government are not more extraordinary than are iniiny •f the arguments he has advanced now, at least in this country, 4 absurd every whrero. In a letter to Mr. Calhoun dated 24th April, 1824, ho says, “ Are not the Indians there treated as allodial proprietors, as an Indo- S undent people having penum ot absointum orainum and seized pur ney et per toi(t.” * When the proclamation of ’64 (Geofge the 3d commission to Gov, Wright probab ly alluded to) gave Georgia the country between llio Atlantic and tho Mississippi, it was thought wo took something by it. It w«3 not believed that it gave us what we and all maukiud hud beibre,.the right to ask tloi Indiana to sell lands in fair market.” Wo not only thought differently, hut acted differently. The very reverse of this doctrine, con tended for in thie letter, is true: for their allodial title to the lands they occupy can not be seriously controverted; since nei ther choir traditions nor ours, tell when they lirqt came into possession ; or tnnt they ever owed allegiance to any people tor their lands. Indeed, we should be the last to question their sovereign tittle, since we found them in free and independent posses sion, have purchased from them, and hold their titles to the lands we occupy. Nor can I imagine a better title, since it is bas ed mi nature and justice, because derived from immemorial possession. It is, however, too late‘o contend for this doctrine; since among the first acts, of General Oglethorpe, ins the purchase of lands from the Indians; and since that period we have had numer (mis other treaties with them for tho same purpose; all of which have been bo many tacit acknowledgements on our part, that the allodial title was in the Indians. Our original title was crcatedjby the let tors patent of George the II. and that was merely a right to purchase ; and of pre-emp tion only as it regards ojher colonies.
