To pul this at rest give me leave to insert here Um words used by,mo.’ "i For if a profit has Accrued to tlie united States Government, lit lias not been at .our expense ; hut of that [of the claimants,, under the Yazoo Act. For by a decision of the Unjted States Supreme Court.it was adjudged that the nth under that act was valid and conse quently that Georgia had no legal claim to the lands when she ceded them to the Uni- tcd'Siates." This admits ofnp other souse than that 1 affirmed, that, by a decision of the Supremo Court, it was adjudged tint wacisigtw s»y etl* V*«m -*•»„ liu«1 Jlucahwil herself of her claims to the lands previous to her ceding them to the United States. The truth of that assertion may be known by any one who will take the pains to look into the case of Fletcher, vs. Peck, there referred to 1 will not further complain of the torments to which you have put my words—I do not deul in toys. As I but briefly explained for want of room in my first'number, what I believed to bo the nature of the rights of Georgia to the luiids prior tq their disposition, to pre vent any misconception permit me to trbi- piss a little further. In that number I s ated‘-our original title was created by tiie Letters Patent of George the 2d, and that was merely a right to purchase,& ufpre cutption as regarded other colonies." That lit was a right of pre-emption and not an a! le.tiiij title, is supported by tile language of tiie old congress in which tile states are in vited to code their right of pre emption for tin; Ueneljl jtf the Onion.' Bat the question of a pre emptive right or an allodial title is settled oy the compact between Georgia and the.United States, in which the latter undertakes to be at their own expence of extinguishing the Indian titles to certain lands lor the use of the former, as soon ss it could be peaceably obtained oil reasona ble terms. Here a purchase is implied, which one party would mm.o for the other; and it would be absurd, iiideejl, to say, that tho u. S. wore ,Jo .have , purchased lauds for Jioorgia, which were then the lends of Geor- giu. To illustrate a right of pre-emption lot us suppose that live uiorehan s for the purpose o! obtaining merchandizo at a moderate price enter into an agreement by which A. only ahull be allowed to make oilers for the cargo of the Fanny—B. for that, of the E- melta, aud so ou. Now this is a pre-emp tive right agreed upon by those morel*.-—r and binding upon each to Che other. But It would be nonsense to suppose this would give a full title to the cargoes before their owners had made sale to tho parlies. Pre cisely the same principle obtained with Eu ropean nations who settled colonies in A- merica. To prevent interminable wars a- monglhcmaelves they entered into treaties by which they bound themselves to each o: her not to obtain lands from the Indians, within certain claimed limits; but until the Indians becumc parties to a treaty, their jest rights could not be affected. It is almost unnecessary to add that the U. S. government under tiie clnims derived from Georgia aud other stiftes to lands, has never contended for more t han tho pre-emp tive right and capable of excluditig other civilize d nations from becoming purchasers only, but notsufficieut to dispossess the lit Minus of their lauds. The same course aud jMrine was observed aud maintained by (.-c and the same are adhered to by , ■'' ,l *nta«i. And, indeed, I know of no ct 1 ™ Ihbt hat supported the contrary, ex- ca gPji'b.
