Summon Court.—Tho application which
Waa made to the Judge qn Thursday laat, to
adjourn over the Court toaonte lima in the
Summer, when the attendance of pother
Ju-lgc, who oould oot bo supposed to be
biassed In tho several cssos arising out of the
alleged abduction of Stephenaoii, might 'be
obtained, waa yesterday overruled, The
reasons aaalgnod by the Court for rofuaiqg
tho motion, aa wo understood thorn, wore sub
stantially tho following i—
V That thB Judge hnd very recently re.
called a letter from Judge Holt, (tho only
Itidge whose prcaeooo at that time could be 1
oxpeotod,) stating the probable continuance
Iff hit own Court in Richmond, until into in
Ohno. and the improbability of bis bciug ablrj |«etoril power with unequalled
to visit Savannah beforo the fall.
A- That the dofendanta had moved a poet,
igument of their trial until the next term in
afeoriw; uppu the ground of thB exolfemont
A the commuuity wbioh would be calculated
(h.defeal an impartial trial. Thin motion
\voald bo preaouted to tho Judgq, who might
attend at tho postponed tlmo, and might
yretalt with lira, aa tho penal codo allows
cdntinunnoofbrqoe term, where the Court
thinks the principles of Justlco require it.
3. A great numbor of important civil caaea

tho present Judge was Counaol at. tho Oar,

Them oaaea cannot ha propnpod for trial in ao
ahorl a time, nor Could any Judge be expect
ed to remain bore, at that aeaaon of tho year,
sufficiently long to diapoao of them. The
visit of Judge Holt at the contemplated peri,
od, would render it less practicable to pro
cure hit services at tile next regular torm
of this Court.
4. To keep the Tcrnt of the Court opon
so long, would impend the entering up of
judgments and issuing execution!, and thus
Uelay ponoiia in obtaining their rights.
6. Many of tho persona upon tho original
panel of tho Petit Jury, are in the habit of
leaving Savannah in the'Summer, for the
North—It would be unjust to detain them
bore, and it would be extremely incoovoni.
ent tu drag those from thoir plantations, who
live in the country, at that hot season of the
year. And it is even doubted whether a
iuftichmf“numbcr of Jurore can then bo ob
tained free front objection, to try all these
Hilt*.
The Court Ihrlhcr stated, that it did not
foel authoiiaed to depart from the uaual
course of justice, at the exponso of stf-these
inconveniences, for thc purpose of facilitating
the trial of fheso eases, and when it wee el
moat certain, that the attempt, if made,
ho futile—and that such a departure from
the usual course, was iu itself, calculated to
prejudice the defendants.
The Court considered the motion as an ex
trabrdiutry one, which was to distinguish
(bone eases from all others, and foundod alone
upon ineonvonionee to the prosecutor, whilst
it was bound to attend likewise to the con-
venienee of Jaron end ail others concerned
in the Court.
It mated timber, that the pubtio wishes
nbd desires on this subject could not be per-
milted to. operate for e moment, ae a motive
of decision with tho Court, and that ite judg
ment on the propriety of granting or refuting
this motion,-was to ha exercised apart from
oily consideration of poblie feeling.
