the thirtieth Congress.

AN ACT to establish the Territorial Govern
ment oC Oregon.
Hu it unnetod by the Senate and Ildilso bf Ro-
presaiitativcs of the United States of America in
Congress assembled, That from and afier the pas
sage of thin act.i nil shat pnrt of tho Territory of
the United Status, which lies west of the summit
of tho Rocky inouii'nin*) north of tlm forty*i»Cc-
oitd degree of north latitude, known a8 tho Ter
ritory of Oregon, shall be orgnniaed into and
constitute a temporary government, by tho iianio
of tho Territory of Orogou: Provided, That
nothing in this act contained shall bo construed
to impair the rights of pursona'nr property now
pertaining to tho Iuthans in said territory, so
Jong as such rights shall remain unoxtiugiiishcd
by treaty between tho United States and such
Indians, or to ufiect tho authority of tho govern
ment of tho a United States to make any regula
tion respecting such Indians, their lands, proper
ty, or other rights, by treaty, law or otherwise,
which it would have been competent to the gov
ernment to make if this law had never passed 5
And provided also, That tho title to tlm land, not
exceeding six huudred nnd fbrty ucros, now oc-
ciiuiedns missionary stations among the Indian
tribes in said Territory, together with the im
provements thereon, be confirmed nnd establish,
ed in tho several religions societios to which said
missionary stations respectively belong: And
provided farther, That nothing in this act con
tained sin'll lie construed to inhibit the govern
ment of the United States from dividing said
Territory into two or more Territories, in such
muuncr and nt such times as Congress shall deem
expedient and proper, or from attaching any
portion of said Territory to any other Stale or
Territory of tho United States.
Skc.'J. And be it further enacted, That the
executive power and authority in and .over said
Territory of Oregon, shall he vested in a gover
nor, who shall hold his olfico for four years, and
until his successor shall ho appointed and quali
fied, unless sooner removed by tlm President of
Ale United States. The governor shall reside
within said Territory, shall bo commnmlor-in-
chiofof tho militia thereof, shall perform the du
ties uiul receive the emoluments of superinten
dent of Indian affairs; ho may grunt pardons
and respites for offences against the laws of said
Territory, and reprieve for offences against
tho laws of tho United Suites, until the decis
ion of the Prosidciit shall ho madu known
thereon; lie shall commission nil officers who
ahull be appointed to office under the laws of
suid Territory, where by law such commission
ahull lie required, und shall take care tliut the laws
he faithfully executed.
Sue. a. And he it further enacted, That there
shall he a secretary of said Territory, who shall
reside therein, and hold his olfico for five years,
unless soouer rumoved by thn L*re«idunt of tlm
United States; ho shall record and preserve all
tho laws and proceedings of the legislnlivo as
sembly hereinafter constituted,'and all the acts
and proceedings of the governor in his execu
tive department: lie shall transmit one copy of
the laws and journals of the legislative assembly,
within thirty days 111101’ the end of each ausaiou,
und 0110 copy bf tho executive proceedings and
official correspondence, semi-annually, 011 tho
‘first days of January and July, in each your, to
the President of the United States, nnd two co
pies of the laws to tho President of tho Senate,
nnd to the Speaker of the House of Represen
tatives for the use of Congress. And in case of
the death, removal, resignation or absence of
the governor, the secretary shall be, aud he is
hereby authorized and required to execute nnd
perform all tho powuraand duties of tho govornor
during such yncaucy or absence, or until another
governor shall bo duly uppoiuted and qualified
to fill such vucancy.
Sue. 4. And bo it further enacted, That the
legislative power mid authority of said Territory
shall bo vested in a legislative assembly. The
legislative iiBsemhly shall consist of a council and
house of representatives. Tliocouucil shall con
sist of nine members, having the qualifications
of voters as herciuafiur prescribed, whose term
of service shall continue three years. Iiiiiiii-
diatcly^after they shall bo assembled, in conse
quence of the first election, they shall he divided
us equally an may bo into throe classes. Tho seats
of the members of council of the first class shall
he vacated at the expiration of tlm first year; of
tlm second class ut tlm expiration of the second
year;nnd the third class at tho expiration of tlm
third year, so that one-third may he clio»oii every
year; nnd if vacancies happen hy resignation or
otherwise, tlm same shall ho filed ut the next cu-
suiugclcction. Tlm house of represoututivesahall,
nt its first session, consist of eighteen members,
possessing the same qualifications an prescribed
for mombers of the council, and whose term of
service shall continue one year. The number
of representatives may he increased hy tho legis
lative assembly from tune to time, in proportion
to tlm increjiso of qualified voters; Prodded,
That the whole number shall never exceed thirty.
All apportionment shall he made ns Hourly bqunl
as practicable, among tlm several counties or
districts, for tho election of the council and rep
resentatives, giving to each section of the Terri
tory representation in tlm ratio of its qualified
voters, as nearly as may he. And tlm mumbers
of the council and *of the house of representa
tives shall reside in nnd be inhabitants of tlm dis
trict, or county, or counties, for which tliny may
lie elected respectively. Previous to tho first
election, the governor shall enuse a census or
ouumcratiou of tlm inhabitants and qualified
voters of the several counties and districts of (lie
Territory to ho taken by such persons, and in
such mode, ns the govornor shnll designate und
appoint; nnd the persons so appointed shnll re
ceive n reasonable compensation therefor; and
the first election shall be held at such time and
plnccs, and he conducted in such manner, both
as' to the persons who shnll superintend such
election, and tlm return* thereof, as tlm governor
shall appoint nnd direct; and he shall, at tlm same
time, declare the number of members nf the conn-
til, and house of representatives to which each
of tho counties or districts shall he entitled under
this act; and tho governor shall, by his proc
lamation, give nt least sixty days’ previous no-
lice of such apportionment, und of tho time,
places, and manner of holding lurch election.—
The person having the highest number of legal
votes in each of said council districts, for mem
bers of the council, shall ho declared hy tlm gov
ernor to ho duly elected to the council; nnd tlm
persons having t’m highest number of legal votes
far the house of rcpi'eseulatives. shall he declared
by tho governor to be duly elected inemhors of
said house: Provided, That in case two or more
persons voted for shall have an equal number of
votes, and in case a vacancy shall otherwise oc
cur, in either bruucli of the legislative assembly,
tlm governor shall order a new election, and tho
persons thus elected to the legislative ussembly
shall incut ut such place, and on such duy, within
ninety days after such elections, us tho governor
shall appoint; hut thefeuftcr, tlm time, place and
manner of holding uud conducting all elections
hy the peoplo. uml the apportioning the repre
sentation in the several counties or districts, to
the council and house of representatives, accord
ing to tlm number of qualified voters, shall be
prescribed by law, as well us the day of the com
mencement of the regular sessions of tho legis
lative assembly: Provided, That 110 session in
any one year shall exceed the term of sixty days,
except tho first session, which shall not bo pro-
longed beyond one hundred days.
Skc. 5. Aud bo it further enuctcd. That every
white male inhabitant, ubove the ago of twenty-
one years, who shall have been a resident of said
Territory at tho time of tlm nnssage of this act,
and sliufl possess the qualifications hereinafter
prescribed, shall be entitled to vote at the first
election, and shall be elligible to any office within
tho said Territory; hut tho qualifications of voters
und of holding olfico, at all subsequent elections,
shufi he such ns shall ho prescribed by tho legis
lative assembly : Provided, That the right of sulT-
rage and of holding office rhnll bo exercised only
hy cUi/.«My.i of the United State* above the ago of
twenty one years mid those above that age,
Who shall haVo declared on oath, their intern
lion tn becotim ipicli, nnd shall liiivu taken an
oath to support the constitution of tho United
States, and the provisions of this net. And pro
vided further, That no ofitcer, soldier, aennum, or
marine, or other purson in thu army or rniv'y of
tho United Stntos. or attached tn troops in tho
service of tlm United States, shall ho allowed to
vote in said Territory, by rensmi of being 011 ser
vice therein, unless said Territory is uud has
been, for tho period of six months, his perma
nent domicil: Provided faithet, That 1vS iiermm
belonging to tho army or navy of tho United
States, shall ever he elected to, or hold flny Civil
office or appointment in said Territory.
Sec. 0. And bo it furthur enacted, That tho
legislative power of tho Territory shall extend to
all rightful subjects of legislation, not iiionusis*
tout with the constitution and law* of the United
o.tntes; but no law sliull ho passed interfering
with tlm primary disposal of tlm soil: no tax shall
ho imposed upon tlm property of the United
States; nor shall the lands or othor property of
nou-ruHidunts he taxed higher than tlm 'lauds or
othor property of residents. All the laws passed
by tlm legislative assembly sliull lie submitted to
the Congress of the United States, and, if disap
proved, shall bo mill and of no effect; Provided,
Elmt nothing in this act shall he cnustniod to
give power to incorporate a bank or any institu
tion with banking powors. or to borrow money in
the name of tho Territory, or to pledge the faith
of tlm people of file sumo, for any loan whatever,
either directly or indirectly. No churtor grant
ing any privilege of making, issuing, or putting
into circulation any notes, or hills in the likeness
of hank notes, or any bonds, scrip, drafts, bills of
exchange or obligations, or granting any other
hanking powers or privileges, shall ho passod hy
tlm legislative assembly ; nor sliull tlm establish
ment of any branch or ngenoy of any such cor
poration, derived from other authority, he allow
ed in said territory nor shall said legislative as
sembly unihnriv.e tlm issue of any obligation,
scrip, or evidence of debt by said Territory, in
any mode or utuuiior whatever, except certifi
cates for services to said Territory 5 and all such
laws, or any laws inconsistent with tho provisions
of this act. shall be utterly mill mid void; and all
taxes shall he equal and uniform; and 110 dis
tinction shall h» miulu in the assessments between
diirereiit kinds of property, but the assessments
shall lie according to the value thereof. To avoid
improper influences which may result from inter
mixing in one and tlm same act such tilings as
have no proper relation to each other, every law
shall embrace hut one object, and that shall be
uxpre*6ud in tho title.
Sec. 7. 'And he it further enacted, That all
township, district, and county officers, not here
in otherwise provided for, shall bo appointed or
elected, in such manner ns shall be provided
by tile legislative assembly of the Territory of
Oregon.
Sec. 8. Aud licit further enacted, That no
mouther of the legislative assembly shall hold, or
be appointed to, any office which slin’l havo linen
created, or the salary or emoluments of which
shall havo been increased, while lie was a member,
during tlm term for which Im was elected, and for
one year after tlm expiration of such term; but
this restriction shall not ho applicable to members
of tlm first legislative assembly and no person
holding a commission or appointment under tlm
United States shall he a member of tlm legisla
tive assembly, or shall hold any otlicu under tho
government of said Territory.
Sec. 9. Andbn it,further enacted, That tho ju
dicial power of said Territory shall be vested in a
supreme court, district courts, probate courts, mid
iu justices of tho peace. The supreme court
shnll consist of a chief justice, mid two associate
justices, any two of whom shall constitute a quo
rum, nml who shall hold n term nt the seat of gov
ernment of said Territory annually; aud they
shall hold their olfico* during tlm period of four
years, mid until their successors shall ho appoint
ed und qualified. Tho said Territory shall ho di
vided into three judicial districts, and a district
court shall be held in euchof said districts hy one
of the justices of the supreme court, at such
timos and places ns may 00 proscribed by law 5
und tlm said judges shall after their uppoiuuunt*,
respectively reside iu tlm districts which shall he
assigned them. Tho jurisdiction of the several
courts heroin provided for, both appellate aud
originnl, and that of the probate courts mid of
justices of tlm pence, shall he as limited hy luw :
Provided, That justices of the pence shall not
have jurisdiction of any case iu which the title
to laud shall in any wise come iu question, or
where tlm debt aud damages claimed shall exceed
one hundred dollars, and tlm said supremo mid
district courts, respectively, shall possess chan
cery, ns well us common law jurisdiction. Each
district court or thu judge thereof, shall appoint its
clerk, who shall also bu the register ill chancery,
and shall keep his ollice at the place where llio
court may ho held. Writs of error, lulls of ex
ceptions, aud appeals, shall he allowed ill all
cases from the final decisions of said district
courts to the supreme court, under such regula
tions as maybe prescribed hy law; hut in 110
case removed to the supreme court shall trial hy
jury he allowed in said court. Tho supreme
Court, or tho justicos thereof, shall appoint its
own clerk, and every clerk shall hold Ins olfico at
the pleasure of the court for which he shall have
been appointed. Writs of error and appeals
from tlm fnnl decisions of said supreme court
sliull he allowed, and may he tukcii to the Su
preme Court of the United States, iu tlm same
manner and under tlm same regulations as from
tlm circuit courts of the United Slates, where tlm
value of the properly, or the amount in contro
versy, to ho ascertained hy tho oath or affirmation
of cither party, or other competent witness, shall
exceed two thousand (toilers; mid iu all cases
where the constitution of tlm United States, is
brought iu question, and each of tlm said district
courts shall have and exercise the same jurisdic
tion iu ull cases urUlug under the constitution of
the United Statas, and tho laws of said Territory,
as is vested in the circuit and district courts of die
United Status; writs of error and appeal in such
gases shall ho made to the supreme court of such
Territory, tho same as in other eases. Writs of
error and appeals from tlm final decisions of said
supremo courtshull be allowed, mid may ho taken
to tlm Supremo Court of tlm United States, in
tlm same manner ns from the circuit courts of tlm
United States, whoro tlm value of tlm property,
or tho amount in controversy, sliull exceed two
thousaud dollars; ami each of said district courts
shall havo uud exercise the same jurisdiction in
all eases arising nmlor the constitution uud laws of
the United States, as is vested in the circuit mid
district courts of the United States, ami also of ull
cases arising under tho laws of tho said Terri
tory, mid otherwise. The said clerk sliull receive,
ill all such cases, the same fees which the clerks
of tho district courts of tlm late Wisconsin Ter
ritory received for similar services.
Sec. It). And bo it furthereuactnd, That there
shall he appointed an attorney for said Territory,
who shall continue iu ollice lor four years, and
until his successor sliull he appointed and quali
fied, Unless sooner rumoved by die President, and
who shall receive tho sumo fees mid salary as
were provided by law for the attorney of the
United Stales for the lute Territory of Wiscon
sin. There shall also he a marshall for the Terri
tory appointed, who shall hold his ollice lor four
years, and until his successor shall ho appointed
mid fluidified, unless sooner removed by the
President ;‘nud who sliull execute all processes
issuing from the said courts, wliuu exercUiug
their jurisdiction as circuit and district courts of
the United States: he shall perform tlm duties, he
subject to the same regulation mid penalties,
•und be entitled to the same lees, as were provi-
dided by law fur the marshal of the district court
of the United States for the present [lute] Ter
ritory of Wisconsin, and shall, in addition, be
paid, two hundred dollars, annually as a compen
sation for oxtra services.
See. 11, Aud be it further enacted. That, the
governor, secretary, chief justice, nnd nssociuto
justices, attorney and marshal, shall’ be nomina
ted, and, by and with tho advice and consent of
the Senate, appointed hy the President of the
United States. The governor and secretary to
ho appointed us aforesaid, shall, before they act
as such, respectively, take mi oath or affirmation,
before thu district judge, or some jntdico of tho
peace in the lirtutsof said Teirilory, dnly author
ised to administer 'oaths and affirmations by tlm
luwa now iu forco therein, .or beforo the
chief justice or souio associate justice of tlm au-
proum court of tlm United States, to support thn
constitution of fim United States, and faithfully to
discharge tlm duties of their respective olficos:
which said oaths, wlieu so lakett, shall be curtilicd
by the person hy whom tlm same shnll have been
taken, und such certificates shall ho received mid
recorded hy the suid secretary among the execu
tive proceedings; uud tlm chief iustice and asso
ciate justices,.Add ull other civil olficcrs Iu said
Territory, bofnro they uct as such, shall take a
liko oath.or ufiirmalion, before tho said governor
or secretary or some judge or justice of tho
peace of tlm Territory, who may he duly coin-
missioned mid qualified; which said oatli or affir
mation shall ho certified and transmitted, hy the
person taking the same, to the secretary, to he hy
him recorded ns nfnrcsuid; and, afterwards, llio
liko oath or affirmation shall be taken; certified,
and rocorded, iu such inmiuer and form as may
bo proscribed by law. The governor shall re
ceive an annual salary Of fifteen hundred dollars
ns governor, mid filleuu hundred dotlurs its su
perintendent of Indian ulTairs. Tho chief jusliee
and associate justices shall each receive an an
nual salary of two llmusund dollars. Tlm secre
tary shall receive nil Uurtrtul salary of fifteen hun
dred dollars. Tlm said salaries shall bo paid
qdartcr-yenrly, from tlm dates of the respective
appointments, ut tho trensurv of the United
States; hut no such payment shall ho uiado un
til said oUlcers shall have entered upon the duties
of their respective appointments. Tlm mem-
hers of the legislative assembly shall he entitled
to received throe dollars each per day during

nually, the Minn of fifteen hundred dollars, to ho
expended hy the governor to defray the contin
gent expenses of tlm Territory including tho sal
ary of a clerk of tlm executive department; and
there shall also he appropriated, annually, n sulfi-
c.ioiit sum, to be expended by the Secretary nf
tlm Territory, nnd upon an estimate to be made
by the Secretary of tho Treasury of the United
States, to defray the expenses of Ilia legislative
assembly, tlm printing of the laws, aud other in-
cideiitaroxpnnses; mid llio governor and secre
tary of the Territoryjsliall in the dislmfscment of
all money* intrusted to them, ho governed
solely by the instructions of tho 8ccretury of the
Treasury of the United States, and shall senti-an-
nually account to tlm said Secretary for the man
ner iu which tlm aforesaid [sum] moneys shall
have been expended; und no expenditure.4o ho
paid out of money appropriated hy Congress,
shall bo made by said legislative assembly for ob
jects not specially authorized hy tlm acts of Con
gress making tho appropriations, nor beyond tlm
sums thus appropriated for such objects.
Sec. Ui. And be it further enacted. That the
rivers and streams of water iu said Territory of
Oregon, iu which salmon arc found, or to which
they resort, shall not he obstructed hy dams or
otherwise unless such dams or obstructions nro
so constructed as to allow salmon to pass freely
up and down such rivers and streams.
Sec. EL And he it further enacted, That the
sum of tell thousand dollars bo, aud is hereby,
appropriated, to be expended under the direction
of thu President of tlm United States, In payment
for the services and expenses of such persons as
have been engaged by tho provisional govern
ment of Oregon ill conveying communications
to nnd from tho United Btntes, nnd the purchase
of presents for such of the Indian tribe* as the
peace nml quietude of the country requires.
.Sec, 14. And ho it further enacted, That the
inhabitants of said Territory sliull ho entitled to
enjoy all and singular tlm rights, privileges, ami
advantages granted mid secured to the people of
tho Territory of thn United States northwest of
thn river Ohio, by the articles of compact con
tained in the ordinance for tlm government of
said Territory, on tlm thirteenth day of July
seventeen hundred and eighty-seven; nml shall'
ho subject to all the conditions, and restrictions,
and prohibitions iu said articles nf compact im
posed upon tho people of said Territory; and
tlm existing laws now iu forco iu the Territory of
Oregon, under tlm authority of thn provisional
government established hy tlm people thereof,
shall continue to ho valid and operative therein,
so far as the same ho not incompatilile with tho
constitution of the United States, and tlm prin
ciples mid provisions of this act; subject, never
theless, to he altered, modified, or repealed, by
the legislative assembly of the said Territory of
Oregon; but all laws horotolbro passod in suid
Territory, making grants of land, or otherwise
alVcciingor incumbering the title to lauds,shall Im,
and are lierobydeclarci! to be, mill aud void; ami
the laws of tho United States arc hercbj* extend
ed over, mid deelared to ho iu forco in said Ter
ritory, so far as tlm same or any provision there
of. may ho applicable.
Sec. Hi. Atld he it further enacted. That the
legislative assembly of the Territory of Oregon,
shall hold its first session at such lime and place
in said. Territory a* tho governor thereof shall
appoint mid direct; and at said first session, or as
soon thereafter as they shall deem expedient, tlm
legislative asftmhly shall proceed to locate and
establish the seat of government for said Terri
tory at such place as they may dcum elligible;
which place, however, shall thereafter ho subject
to ho changed hy said legislative assembly. And
the sum of five thousand dollars, out of any
money in tlm treasury imt otherwise appropria
ted is herein* appropriated and granted to said
Territory of Oregon, to he there applied, hy the
governor, to the erection of suitable buildings at
tlm seat of government.
Sec. 16. And he it further enacted That a del
egate to tlm House of Representatives of the
United States, to serve for tho term of two years,
who shall ho a citizen of tho United States, may
ho elected by tlm voters quuliliud to elect uloiil-
hers of tlm legislative assembly, who shall ho en
titled to the same rights uud privileges ns have
been heretofore exorcised and enjoyed by the
delegates from the several other Territories of
tlm United Stulusto the said House of Represen
tatives: but the delegate first elected shall hold
his seat only during mo term of tlm Congress to
which lie shall be ejected. The first election
shall he held ntsimh time and places, and he con
ducted in such munner, as the governor shall np
point aud direct; of which, mid tlm time, place,
and lUatluer of holding the elections, Im shall
give at least sixty days’ notice by proclamation:
and at all subseniient elections, the times, places,
uud niaiitmr of holding such elections shall tic
prescribed by law. The person having the great
est number of votes shall be declared by the gov
ernor to he duly elected, and a certificate thereof
shall he given accordingly. The delegate from
said Territory shall not bo entiled to receive more
than twenty-five bundled dollars, at uny one ses
sion of Congress, ns a compensation for his mile
age, iu going to mid returning from the seat of
government of the United States, any act of Con
gress to tlm contrary notwithstanding.
Sec. 17. Aud be it ftntjier enacted, That all
suits, process, and proceedings, civil nud crimi
nal, nt law and iu chancery, aud all indictments
and informations, which shnll be pending and un
determined in tho courts established by authority
of the provisional government of Oregon, within
the limits of said Territory, when this act shall
take etlecf, shall he transferred to be heard, tried,
E rosecuted, und determined in the district courts
creby estoblished, which may include the coun
ties or districts where uny such proceeding mny
be pending. All bonds, recognizances, aud ob
ligations or every kind whatever, valid under the
existing laws within the limits of mid Territory,
shall be valid under tins act; und ull crimes uud
misdemeanors again?! the laws in force within
said limits may bo prosecuted, tried, and punish

See. 18 And ho it further onneted, That all

judicial and ministerial officers, who sliull bo in
otlico within tho limits of said Territory when
this act shall take elfect, shall ho, and they are
hereby, authorized and rouuirod to continue to
oxorcisc mid derform the ditties of their respec
tiveofiiccRHs olficors of tho Territory nf Oregon,
until they or others shall bo duly olcnted or ap
pointed, and qualified to fill tliuir places in thu
maimer herein directed, or uutil their offices
shall ho abolished.
Sec. 19. Aud ho it further enacted,. That tho
sum of fivo thousand dollars ho, and thu sumo is
huruhy, appropriated out of any moneys in thu
treasury not otherwise appropriated, to be ox-
pended, by and under tho direction of the said
governor of the Territory of Oregon, iu the pur
chase of a library, to be kept nt flio seat of gov
ernment for the uso of tho governor, legislative
assembly, judges of tho supreme court, secretary,
marshall, and uttorney of said Territory, nnd such
regulations, as shall he proscribed hy law.
Hec.SO. Aud be it further enacted, That when
tho lands in the a#l Territory shall ho surveyed
undur the direction nf tho government ol* llio
United States preparatory tn bringing the same
ill to market, section numbered sixteen and thirty-
six in each township in said Territory shall he,
mid the same is hereby, reserved for the purpose
of being up plied to schools in said Territory, mid
in thn State* and Territories hereafter to bo erect
ed out of thn same.
8ec. ill. And be it further enacted, Thai, un
til otherwise provided for hy law, the governor
of suid Territory may define tho judicial districts
of said Territory and assign tho judges who may
ho appointed for said Territory to thn several dis
tricts, and also appoint the times and place* for
bidding court* m the several counties or subdi
visions in each of said judicial districts hy pro
clamation to lie issued hy him; hut the legislative
assembly, at tlmir first Ur any subsequent session,
may orgnuiso, alter, or modify sunli judicial dis-
tricts.and assign the judges, uud alter the time aud
places of holding the courts, ns to them shall
seem proper mid convenient.
Sec. 22. And be it further enacted, That nil
olliccr* to ho appointed hy the ('resident, hy uitil
with thu advice mid causautaf the Senate, for the
Territory of Oregon, who by virtue of the pro
visions of ally law now existing, or which may
be enacted during the present Congress, are re
quired to give security for moneys that may hu
intrusted with them for disbursement, shall giro
such security nt such time mid place, mid in such
maimer, ns the Secretary of the Treasury may
proscribe.
Stte. 2,1. And he it further enacted, That all
tlm ports, bailors, shores, and waters of thu main
land of the Territory aforesaid, sliull Constitute
a collection district, to he called tho district of
Oregon; mid a port of entry shall ho established
at Astoria, near the mouth of the Columbia river,
uud a collector of customs shall he appointed by
the President, by and with the advice mid con
sent of the Senate, to resident such port of entry.
Sec 24. And he it further enacted, That the
President of the United States ho, and hu is iinrc-
jiy, authorized to establish such ports of delivery
in the district created hy this net, not exceeding
two in number, (one of which shall he located
on Puget's Sound,) as he ntuy deem expedient,
and may appoint, hy and with the ndvico mid
consent of the SunnGs surveyor* to reside thereat.
See. 25. And ho it further enacted, That the
collector of said district shall bo ullowod a com
pensation of 0110 thousand dollar* per annum,
and tho fees allowed hy law ; mid tho compensa
tion of uny surveyor appointed in pursuance of
this net shall Hot exceed live hundred dollnrs per
annum, including iu said sum tlm Cues allowed hy
law, and the mnniiiit collected hynity of said sur
veyors, lor fees in any one year, exceeding tho
sum of live hundred dollars, shnll he accounted
for and paid into tlTo treasury of thu United
States.
Stic. 2(i. And bn it further enacted, That the
revenue laws of the United State* be, and are
hereby, extended over tho Territory of Oregon.
Sec. 27. And he it further enacted. That the
sum of fifteen thousand dollar* Im, mid the same
is hereby, appropriated out of any moneys in tho
treasury mil otherwise appropriated, to he ex
pended under the direction of tlm Secretary of
llir. Treasury, for the construction of light-houses
at Gape Disappointment mid New Dungiiiess;
and for the construction mid anchoring of the re
quisite number of buoys, to indicate (be channel*
at the mouth of the Columbia river, aud the ap
proaches to the harbor of Astoria, tho said buoys
to he placed and anchored under the direction of
sunli person as thu Secretary of the Treasury
shall appoint.
