Sec. 5. And bo it further enacted, Th*)sper-

Sec. 7. And be it further enacted, That any
person who shall unlawfully destroy, mutilate,
deface, injure, or remove any tomb, monumeriL
grave-stone, or other structure, placed iu the said
cemetry, or, uny fence, railirig,Or other work, fob
tiro protection or ornament of uuy tomb, mono-
ment, grave-stono, or other structure aforesaid,
or of any ceiirotry lot within tlie limits oft fori;
ground belonging to tiro said corporation, or of
the grouuds set apart for the cemetry | or shall
unlawfully destroy, break, or remove, cut/tob
injure, uuy tree, shrub, or plant, Within the limits
ofsaid cemetry; or shall shoot or discharge any
gun, or other firu-arm, within tiro said limits, or
ut any object within foe same,.shall bo deemed
guilty of u misdemeanor, und shall, upon convic
tion thereof beforo any justice of the peucri, bb
other court of compCfurit iuris'diotion within
Washington comity afarosaia, be punished by a
fine of not less than five dollars, or more than
fifty, according to the nature and aggravation bft
the offence; und such offender shull, also, be
liuble, in an actioir of■ trespass, to be brought
against him iu uny court of competent jurisdic
tion in the name of the snid corporation, to pay
all such dariingefc us shall have been occasioned
by liis bniuwfui act or acts; which'money, when
recovered, shall bo npplied by the said corpora

therefrom, such person, on conviction ihebettfilt
any court of competout jurisdiction within the
county where tha suid cemetry is situated,’shall

lubor, for a tenn not loss than one year, or more'
than five, and pay a fine of not less than’ one’

in tiro said cemetry shall lie indivisible, and upbrt
the death of any proprietor of any lot in the said
ceuielry, lie or she being a member of said corpo

privileges .of membership at aforesaid'; and if
