CHOLERA NEAR CHARLESTON.
The following is from tho Charleston pa'

A single case of Clivh.-n—the attack of:
which was madly courted by the unfortunate
subject, has occurred iu lliu midst of the
unsurpassed health', with which our .City is
otherwise blessed—and at tho very timo when
the Civil Authorities had set apart a day of
thanksgiving. We trust, thorofore that the
disease will tiot spreud.' fur it is well known
that in all places where the cholera has main
tained a foaling, thuro had bum an unusual
degreeofsickncss fromothor diseases. Our

tension of tho .pestilence. .It ia now throo
days isinco the individual whoso cuso is re*

death was, and no oilier case has occurred.
In places whore tho disease has prevailed, tho
succession ofcasos was rapid. Wo cannot
but indulge in tho hope, that our City muv be
spared the awful calamity, which has at
length come to our very doors. .
Wo pledge ourselves to our readers in the
country that every ease which occurrs will bo
reported by. the proper nuihoritjos—-and as

placed on the official rcports~made in the
different papers.

such a stale, iliaVit wus not worth while,to
repair her thoroughly, and tlmt, if sin was
repaired thoroughly, the expense would ex
ceed her value, hut tho underwriter ought to

tiroly on depositions, of much mooty-; 'and
required to be narrowly watched and exactly
stated. . . 7 .
Daily, J.—This was a question for tho de
termination of tho Jury ; and I think they
must have understood, from the manner in
which tho quostidn was put to them, what
thoy bad to docidc, and that in speaking of
the repairs to bo done to tho -vessel, wore
meant, not repnirs for goncral purpose**, but
only such ns W‘>ro necessary to onablo her to
complete her voyage. If at u reasonable
outlay, such us a prudent man would incur,
she wus capable of such repair, there was
no total loss ; if it would have rc<juired'a
sum uihich no prudent person would have
expended on her; then she was not repaira>
hie, uud the plaintiffs wuro entitled to recov
er. Though tho. puint ns to tho necessary
extent of tho repairs was not precisely ex-
J ressod m tho direction, I think a jury of
icnidon merchants must havo understood
them’ to ho such rcpairs’as would put tho ship
into condition lor tho vpynge. On that point
there was conflicting evidence: it was for
tho jury to docido upon it, nrnl I think their
verdict ought not to bd disturbed.
Parke, J,—I agree tliat these aro cases
thatought to bo narrowly^watched ; und by
none ore they inure likely to ho so.watched
than by a special jury ofllio city of London.
I think the question as lo the repairs was pro-
porly loft to the jury, that they must havo un-
derstood it fully, and that it docs not require
to be again submitted to them.' Rule refus

Note dy the Reporter :—With great
submission we cannot help thinking that the
court, in giving judgment, rather passed by
the point inado on behalf of the underwriters.
The complaint waa, not that the learned
Chiof Justice had not coufincd the attention
of the Jury lo such repairs a8 would bo ne-
CQss&ry for enabling tho vessel to complete
the particular voyage, but tlmt he had not
limited tho term repairs to such only as were
rendered necessary by and in consequence of
u peril insured against. General evidence
