Sec. 1. Be it enacted by the Senatn nml House
of Repte.eaiativc* of lira State ofGeorgia in Gener
al A.-semhly met, and it is hereby enacted b/ tho
authority of the sumo, That from trad after thu pnx
sage of this act the fund heretofore set opart, nml
now known us it common school fund-for the State
of Guorgiu, nml such other fuml* a. muy b<» h. rent
ier set apart for teaching the poor, shall become and
compose a Four School fund for lira Slute of Geor
gia.
Sec. 2. Aml betl ftmher enacted by thenulhnnty
aforvitaid, That lira Justices of tho lidurior Cotm
in the several counties in this State, or a majority
of them, shall on the first Monday of Fclnuary, in
the year 1841, and on the first Monday in Jununry
in Cuch r.ad every, year thereafter, by nn order to he
entered nn their loinutes, appoint five lit and proper
persons of their county, to net ns Comtnissionets of
the l’oor School Fuml in their respective,counties',
and it shall ho the duly of the del k ofs iid court
to give the Commissioners notice of their appoint
ment, in writing, within ten days idler the sumo is
made, nml the suid Commissioners shall have pow
er to fill all vacancies that muy happen in their bo
dy by death, resigiuitiun, or otherwise, nod such

ly aforesaid, That it shall he the duty of the Corn

court house in their respective counties, within fif

the Four School Fund, und the person so appointed,

tinners of the Four School Funds, or a majority of

fund to which they are entitled according to the

have been taught to report to the Commissioners of

lice, shall neglect or refuse to puy over any money
in his or thrlr hands, as authorized by till* act, shall
