Mr.'Cutlihcrtsnid this was one of those points ou
which ho would feel himself called upon by a sense
of duty to address the Senate more fully than lie
should now do, il'the state of bis health permitted
him. He could not, however, allow this oppor
tunity to pass without submitting a few remarks.

inevitably destroyed, if two important principles
were not introduced into it. One was, public

ky, [Mr. Clay,] that the commercial world wus not
prepared for such an innovation on the practice of
banning, and that the publicity required, if pnrt of
tho charter, would prevent subscription to make up
tho stork, was not, bo conceived, well founded.

of public inspection was wrong, bultliat public opi

ed error. What does this amount to, but that Con
gress ought not to lead straight fonvurd to right

apply to them if he knew his application must ho
made public; and why should such applications bo
encouraged!

this measure is accounted for. Inn few years no
snch charter as Uiis can he proposed to Uiis people.
Now, then, or never, is tho time to secure one for the
next twenty years. The urgency ofgotUng ahead
of more enlightened opinion* than now prevail who
f jreat, Umt you cannot even brook Uiu delay of id-
owing your nionsuro to ho fairly mid deliberately
discussed. He would siy to the Senator, I know
very well you have the power to curry Uirougliyour
bill now—but you have not tho power of perpetuat
ing it—not even of continuing its existence for Uio
twenty years you propose. You are conscious of
the rapid strides Uie publicmind is making townrds
correct principles. Why not then, so shapo your
chatter os to leave an opening for us to keep pace
wiUi Uio developments of those principles, and to
amend your charter inconformity with the advance
ment of the public mind, from lime to time?
Does the Senator from Kentucky wish to keep
hack the onward movement of the public mind by
an abridgement of discussion in Uiis chamber f—
forgetting nil that is due to a people jealous oflheir
liberties, and cherishing publicity and free and open
discussion, ns their best safeguards? What IniUi
con Uio people have in those measures which arc
attempted to be carried wiUioiit discussion? Is it
any rccomihcndatiou of them that they are forced
forward against opposing arguments, and without
justification ? Is it any recommendation of them

We are told Uiat this amendment, if adopted,
will bo an outrage on the feelings of individuals,
wlio are generally tho business customer* of hanks.
Will Uie gentlemen dura to tell the people Unit Uie
feelings of a favored few arc more weighty in their
estimation than the vital interests of the whole com
munity?—that they are more to bo respected and
protected?—Unit the feelings of a few needy, spec
tators lira to he put in competition with tho stabil
ity and uniformity of Uio currency of this great con
federation of Republics? If that is the case, the
institution is n bad one, and its establishment should
not he attempted; and he would tell the Senator,
Uie people are fust reaching Uiat maturity of judg
ment on this subject, which would result iu a ver
dict against this measure morn decided than they
had ever yet pronounced on any political measure.
This Bank is to iillbrd a sound and uniform cur
rency. Did any hank or system of bunking ever
yet effect that object? The time for dispelling all
delusions on Uuit point is fust approaching, and this
is batanoUier effort of Uiu paper inony power to
avert the crisis.

of reaching his object. Such reports, made only
yearly, and coining tardily before Congress, would

publicity. The true and only safeguard of pub
licity, is to be found iu the principle of laying
the offering hook open on the bnuk counter for
daily inspection. Any thing short o( that is but de
lusion.
The arguments on tho other side nrc now reduc
ed to this, that n National Bnnk is wanted to rive
the country a sound and uniform currency. Who
lias given Uie country the unsound cnrreccv thus re
quiring regulation? Wiio hut the hanks? And
now it is proposed to create an ndditioncl Bank to
lessenthe evil originating in thn system it isto aug
ment nnd support. II n Bank must bo mode, let
it be such a Bank ns will give n currency,
the vulue of which is in itself, and not to he ascer
tained merely l»y comparison. Mere paper Ins no

To-dny, it may suit Uieir speculations to make it
of one value, nnd, to-morrow, of another value.
And this np-and-dowij movement is to be coiled
“giving a sound and uniform currency." The
Senctor from Kentucky ha* bad much experi
ence in life; bnt it is singular his experience has
not tnnght him thnt n National Bank is not to be
trasted for Uie object he avows. Does ho not know
from the experience of Uie past, thnt when the
country is most affected by a disorganized cur
rency, banks are least able to afford assistance, be
cause it is Uie very time they themselves stand iu
need of it. At such a time, when Imnk directors
yield to thownnt* of others, they augment tho evil
and increase Uie difficulties by increasing the re
sponsibilities of Uieir own institutions. If some
merchant of hitherto high standing and extensive
business appeals to a bank director, and bis feel
ing* arn lunched, ho cannot resist the appeal, and
he make* ndvnnces which ho darn not make in tlio
fare of publicity. Publicity would save tho officer*
of such institution* from appeal* of this nature.
They would themselves lie relieved from tempta
tion to do what they conscientiously know they
ought not to do. No man of doubtful credit would

DUTIES OF MANAGERS IN MAKING
AND TRANSMITTING ELECTION RE-
TURNS.
Tbo superintendent* at the several precinct* in
each county, on Uio day of the elections by them
held, and nt Uie place* of holding *uch elections,
shall count out the voles by them taken in, and
make a fair statement of the poll, certified under
Uieir hand* in the character in which they presided,
which shall he scaled up togcUicr witli a list of Uie
name* of the voter*.
On Uie day following, one or more of the super
intendents at cuch of the respective prcciut* iu tho
several counties,shall assemble at tho courthouse,
(bringing np Uie returns from their respective pre
cinct*,) and. together with magistrate* wiio presi
ded at the court house, or u majority of them, count,
compare, and add together the several return*, and
certify to the governor Uie result of Uie election
for Uie county.
The returns brought to Uie court houses from Uio
precinct*, as well ns those made ut the place on the
day of the election, should lie transmitted to the
f jovernor wiUi the consolidated return. The fol-
owing may serve a* n form for die certificate to ac
company the consolidated return viz:—
