1st. That at a timo past, to wit, on eomn day to
the *uid attorney as yet nukuown.the said distilled
spirits were imported into some district of the Uni
tod States, to tbe said attorney as yet unknown,
from siiuto foreign port of place to hitnaeyetnn-,
known, and that they were not imported a* afore
said according to law, and that the duties there
upon were not paid or toeured, at he verily bb-
lievos. contrary tit the statutes of tho United Stales,
in that behalf provided. And the said attorney
further alleging that the said distilled apt Ala having
hdcn so* imported, were brought into the port of
Savannah, from the port of Philadelphia, in • cer
tain schooner or vessel, called the Lodemia & Eli
za,then and there belonging to a citizen or citizens,
inhabitant or itihabiianisofiheUnited States whose
hump or names ere to tho said attorney of the Uni
ted States ss yet unknown,to wit,bu the eleventh
day of the said September, and that the caslta or
vessels containing the smd distilled spirits wore
unaccompanied by the mark* end certificate* of
the officers, of Inspection at the portwnere the
same were imported, which ere required by law,
contrary to the statutes of the United Suites in
such c«*e made and provided.
2d. And also Tor that on a day past, to wit, on thn
said eleventh day of the said September, the a aid
spirits, being distilled spirits, were brought into the
said port of Savannah, from e district in the United
States,other than a district in ihe said State or an
adjoining State on the said saa coast or on a nav
igable river, td wit, front the port end distriot of
Philadelphia, in tho 8tato of Pennsylvania, in a
schooner or vessel, licensed to carry on the collat
ing trade, to wit, in a schooner or vessel called tho
Lodemia & Eliza, then olid there belonging to a
citizen nr citizens, iqoabitnnt o'r inhabitants,of the
United Slates, to tho Said attorney unknown,
and that the said distilled spirits wero found on
board the same, and that the said distilled spirits
wern not then and there certified In the mnnilast of
the cargo of the said schooner tir veteeliby the Col
lector or Surveyor of the said District, from which
she last sailed In manner and form a« required by
law, against the form of the statute in such caso
made and provided By reason of allwhich pre
mises,the said distilled spirits have become for
feited to the uses to tho stntuje* specified.
Now, therefore, you the said Marshal, urn here
by commanded to cite and admonish all and every
person or persons, having or pretonding to have,
any right, title, claim, or demand, in or to tho s dd
four half pipes of brandy, to be and appear at a
special Court of Admiralty, to be hold at the
Court House, in the oily of Savannah, on Toes*
d iy, the fifth day of October next, at eleven
o'clock, A. M., to’ show cause, if any th*y have,
why die said lour half pipes cf brandy should not
tin condemned and Hold, and the money arising
from tho sale be di«trihut«d according tfi law.
