A writ of habeas corpus was
applied for boforo Judge Grier, of the U.d. CHrouit.
Court, in this city, and District Attorney Ashmoad
asked that the prisoners be discbftrged, asserting that
no more foroo was used than was necessary—the fugi
tive being armed with a knife, given to him by a by
stander.
Judge Grier said that If habeas corpusca are to bo
taken out after that manner, I will uava an indict
ment sent to the United States Grand Jmy against
the person who applies for tho writ, or assists in get-
ing It, tho lawyer who defends it, and tlie sheriff who
surves tho writ, to seo whether the United States of
ficers aro tobu arrosted and harrassed whenever they
attompt to serve a process of the United States.
Mr. Drown, counsel for the, Abolition society, ask
ed for a delay of ono week to procure witnesses,

Tho Yellow Fever at Rio.

The Baptist Association, composed of sixty four
churches and ten thousand members, extending from
Pottsville, Pa., to Wilmington, Dot., bold Its 140th
anulversary at the Baptist Tabernacle, in this city
yesterday afternoon.
Rev. J. W. Hayhurst delivered tho opening sermon
from the 42d chapter of iB&lah and 4th verse. The
church was crowded to excess.
A letter from Itlo, received by tho Reindeer, dated
August 25th, represents tho fever as still raging to a
fearful extent.
Tbe Lake Brio Disaster-Five Lives Lost—
U. S. Steamer Mlohlgnn Ashore.
Buffalo, Oct-5.
The schooner lost on Lako Erlo yesterday was the
Oneida. She was ran down by the steamer Buck
Eye State, when about 12 miles from this port. She
had on board a cargo of 7.000 bushels wheat.
The captain and all of the crew, six In -number, t
were lost, except tho cook, who.was tnkon fVoin tlie

lie had been there for over twenty hours.

of the Savannah Medical College havo opened at the
College building, a Dispensary for the purpose of affording
Medical and Surgical aid to indigent persona who may
stand In need of It. Advice and Medicine will be turnlihed
gratuitously to all who apply.
