Trustee, ko.—Rule Nisi.—Upon the petition of Edward O.
Wilson, Treasurer of the Republican Blues Building and
Loan Association, praying tbe foreclosure of the equity of
redemption <J and in all that parcel or lot of land, situate,
lying and being in the city of Savannah, county of Chat-
bam, and State of Georgia, and known and distinguished in
the plan of said city a* Lot No. Fifty-six (60). Brown ward,
of Mordecai Myers, substitute trustee under the marrltge
settlement of Rob’t W. Pooler mod Mary J.. his wife, which
said property was mortgaged by tbe said Mordecai Myers,
trustee as aforesaid, (under and by virtue or a clause In
the said marriage settlement, author!tins: the trustees to
grant,-bargain and sell all or any part of the property upon
tho request of the aald Robert W. and Mary J. Pooler, and
their request that said mortgage should be made, being
erldenoea by their signing and sealing said deed or mort
gage,) to the said Edward G. Wilson, Treasurer as afore-
said, by deed bearing date the sixteenth day of December,
In the year one thousand eight hundred and flftv-two.to
secure tbe payment of the sum of two thousand dollars,
with Interest at the rat* of alt per cent, per annum, paya-
ble monthly, from the sixteenth day of Decomber. Anno
Domini, 1862, on demand, according to tbe tenor and effect
of a certain promissory note made by the said Mordecai
Myors, trustee as aforesaid, to the said Edward G. Wilson,
treasurer as aforessld, bearing even date with the said
mortage, and that there still remains unpaid thereon, the
srm of two thousand dollars:
On motion of Griffin & Gordon, attorneys for petitioner,
It Is ordered, that the said Mordecai Myers, trustee as afore
said, do pay Into this Court, on or before the first day of
the next term'ofthls Court, the principal aud interest due
on the said promissory note and mortgage, and the costa
of thla application, and in default thereof, that the equity
of redemption of tho said Mordecai Myers, trustee as afore-
said, and all claiming under said trust to the said mort
gaged premises be thenceforth and forever foreclosed:
And, It la farther ordered, that a copy of this rulo be pub
lished in one of the public garottes of this State, once a
month for four months, or served on the mortgagor or his'
special agent or attorney, at least three months previous
to the time the money Is directed to the paid, and that such
further and other proceedings be had as are prescribed by
the statutes of the Stal* of Georgia, in such cases made and
provided. 1
