United States of America and the Mexican Bepubllc,
concluded at the city of Mexico, December 30,1853 :
JV the Senate of the Untied Stales :
I tranatnlt to tlte Senate for Ita consideration, with
a rlew to ratification, a treaty between the United
State* of America and the Mexican Republic, eigned
by the Pleuipotcutiarica of the respective partie*. in
the city of Mexico, on tho 30th day of lkxsember last.
Certain amendment* arc proposed In the Instrument,
aa hereinafter specified, ti* : In order to nfako the
duties and obligations, stipulated In the accoud arti
cle, reciprocal, it is proposed to add that article the
following : •• And tne government of Mexico agrees
that tbc stipulations contained in this article to bo per
formed by the United States shall bo reciprocal, and
Mexico shall be under like obligations to the United
States and the citixcns thereof, aa those herein above
imposed ni»on tbc latter in favor of tbe Republic of
Mexico and Mexican cititens.’’ It is also rdconnnend
that for the tliiid article of tbe origiunl treaty, the
following shall be adopted aa a substitute—
•• In conaideration of the grants received by the
United States, and tbe obligations relinquished by tbe
Mexican republic pursuant to this treaty, tbe former
agri?e to pay to the latter the sum of 15,000,000 of dol
lars In gold or silver coin, at the Treasury at Wash-I
iugton ; one fifth of the amount on the exchange of
the ratifications ol the present treaty at Washington. |
and the remaining four tiftlis in monthly instalments
of three millions each, with interest at the rate of six
I per cent per annum, until tbe whole be paid ; the
Government of tbe United States reserving tbe right
|to pay up the whole sum of 115,000,000 at an earlier
date, as may to it be cenvenient.
The United States also agree to assume sll the
claims of their citixens against the Mexican republic,
which may have arisen uuder the treaty, or the law
of n&tioQH. since the date of the signature of the I
treaty of Guadalupe. And the Mexican republic
agrees to exonerate tbe United States of America
from all claims of Mexico or Mexican citixcns which
may hare arslsen uuder the treaty of the law ol na
tions since tbc date of tho treaty of Guadalupe, so
that each government, in tbe most formal and effec
tive manner, shall be exempted and exbonerated of
all such obligations to each other respectively.”

Col. Fremont’s Land Claim.—Decision of the 17.
S. District Court of California.—The decision of
Judge Hoffman, in relation to the Fremont claim,
will hardly surprise any one. as it has been the very
common impression that the decision ol tbe Land
Commissioners was very wide of the mark. That
region of the mines covered bytlie Mariposa claim is
one of the richest raining sections in the world, and
had it been confirmed to Col. Fremont, would have
made him immensely rich. The condition it has been
in, however, has relayed ita development, as the
quartz mines upon it have been held in such a way
that capitalists have preferred to operate elsewhere to

Article 3. In consideration of the grant received by
the United State-, and the obligation n-linqui-hed by
the Mexican Republic, pursuant to this treaty, the
former agree to pay the latter the sum of fifteen mil
lions of dollars, in gold and silver coin, at the Treas
ury at VYa-hington—one-fifth of tbc amount on the
exchange of the ratifications of the present treaty at
Washington, and the remaining four-fifth- in month
ly instalments of three millions each, with iutere-t,
at the rate of six per cent, per annum, until the
whole is paid-the Government of the United States
reserving the right to pay op tbe whole sum of fifteen
millions at an earlier date as may be to ber conveni
ent. Tbe United States also agree to a-Mitne all
claims of their citizens of whatever right, title, or
or foundation, which may havo nri-en siuce the date
of tbe signature of thetreatvof Guadalupe, or which
may not have been provided for therein, or of any
corporation, company or citizen of the same, includ
ing the claim of the so-caUed concession to Garay,
without having previously delivered to the agent

holders ol said concession in establishing their rights
and claims legally relinquished in favor of Mexico by
such holders and claimants ; aud it is agreed in the
reciprocal release of obligation* that the Mexican
Republic exonerates the United States of America
from all claims of Mexico or Mexican citizens, which
may have arisen since the date of the treaty of Guad
alupe, so that each government, in the mo*t formal
