notified Ins passengers of the fact, and placing the

AN ACT to change and simplify the practice and pleadings
In this Stats, to provide for the servico of writs of scire
facia* in certain case*, and to regulate the udmissiou of
testimony iu certain cn«es :
Section 1st. He it enacted, <$■<■., That from and af
ter thu passage of this Act, parties, plaintifis and
defendants in the Superior. Inferior and Corporation
Courts o( this State, whether ut Law or hi Equity,
may iu any stage of the cause, as matter of right,
amend their pleadings iu all respects, whether iu
matter of form or matter of substance only, but i
case the party applying for leave to amend pleadings
or to open a default, shall have been guilty of negli
ge uce iu respect to tlio matter of amendment or de
fault, the Court may compel him to pay his adversary
the cost* of the proceeding for which he moves ami
may enforce other reasonable and equitaole terms on
him at discretion, uot touching tlio leul interests of
the causo iu controversy.
Section 2nd. And be it further enacted, That in all
coses where a defendant duly served with process or
subpoena in any cose, ut Law or in Enquity shall re
side out of this State or remove therefrom during the
pctiduucy of said cause, and the plaintiff or com
plaiuants shall die, his or iier legal representatives
may be made parties by scire facias, which scire
facia* shall be served by publication in some of the
public Gazettes of this State, once a month for four
moq^hs, previously to tlie time of the Court to which
said scire facias is made returnable, which public:
tlon made hy the Sheriff or other executing officer,
shall be good and valid to all intents and purposes.
Section 3kd. And be it further enacted. That all
appeal trials *or other trials, iu the last resort, all ex
ceptions to interrogatories, the execution of commis
sions or answers of witnesses, examined under com
mission, where the commission Las been duly return
ed, and tho sumo ordered or consented to bo opened,
and been for one day subject to Inspection, slinll he
taken and determined before tho case is submitted to
the jury; otherwise tlio testimony shall be received
Biibject only to the objections that may be made for
irrelevancy; all laws, usages and customs, to
contrary notwithstanding. Approved February 20th.

Tue People’s Bank.—At a meeting of the Stock-
older* of this institution, held yesterday morning,
all differences were compromised, and it was deter
mined to call in the whole ot the unpaid capital of
tho Hunk, between the present time and the first day
of November next; and that interest, at thu rate of
six per cent per annum, should lie charged on all
amounts unpaid, on and alter the 20th in-t. Under
this action tlio sum ot $10,000, we learn, was paid up
yesterday in the space of three-quarters of an hour
nftcr the adjournment of the meeting, (i. e. between
the adjournment aud 2 o’clock, I*. M.,) In anticipa
tion, by stockholder-*, aud their example will doubt
less be namcmuBly followed to-day, or speedily alter.
We congratulate the community on this auspicious
termination of an unhappy controversy, and on the
fair prospect that the People's Hank will soon be in
the full tide of successful experiment, discounting

Consular Uecoonitions—The President of the
Unite 1 States has officially recognized the following
Mexican Vice-consuls nd interim : For the port of
Galvc-ton, Texas, H. do Saint Cvr; Charleston, S. (’,,
Francisco Montane ; and for Pcnmicola, Francisco
Morano.
The Mctliodi-ts are agitating the question of estab
lishing a lui 1 1 ■! il Seminary in New Yoik,
or some other central point, for the whole denomina
tion- No body of Christians in tho world has made
greater advancement In the means lor an educated
ministry, during the Inst quarter of a century, than
the Methodists, when it is considered that their views
in respect to this matter were originally so averse to
literary aud theological seminaries.
Heavy Contract-—Seth Wilmarth, of tho Union
Iron Works, South Boston, has closed a contract with
the New Yoik and Erin llailroa l Company, for tin-
building of 40 Locomotives,of the largest* lass. The
first is completed, and is the largest ami lieavi- st ever
built in New England—weighing 32 tons, four 5 feet
drivers, 18 inch cylinder, 20 inch stroke.
More Fihiiino Troubles Aukrehended.—A hill
lias passed the Legislature of New Hruuswick, and
received the royal sanction, which enable-* the coloni
al authorities to hoard American vessels in the fishing
grounds, when within three miles of land,and remain
on boad until they depart. It has oilier provisions for
the protection of the inshore fisheries, which arc
equally stringent and obnoxious'.
A letter to tlio Rochester Union states that Henry
O'Reilly, formerly of that city, has concluded a con
tract with the State of Iowa, to make a slack-water
navigation of 200 miles, in the iK-stnoinc* river, for
which he is to receive about a million acres of laud,
and a monopoly of the water power created hy thirty
dams, for forty years. It was reported that lie hud
disposed of his interest to a company who pay him u
liberal compensation.
Itcform of the Juillc-lnl System of tlie L'nl-
tetl States.
The plan which the Attorney General lias present
ed, through the President,to Congress for tlio reform
of the Judicial system of the United States, is thus
described :
To have, at present nine, and prospectively, ten
circuits; to rearrange the existing nine circuits, so as
to comprehend within them all tlie judicial district*
except those of California ; to appoint nine assistant
circuit judges, one for each circuit; to preserve unim
paired the jurisdiction of the circuit courts, in nil the
districts, as well those now within the circuits as
those without; to withdraw the circuit powers from
the district judges, and revest them iu tlie proper
circuit court exclusively ; to have the ordinary cir
cuit court lioldcn as it is in each judicial di-trict, ami
composed of the justice of thu Supreme Court residing
in the circuit, as now, hut to associate with him an
assistant circuit Judge, ho that the court shall ho bulli
on by a justice 01 tlie Supreme Court and thu assi >
taut circuit Judge, or either or them, instead of tlie
district judge, the latter being loft to Ills proper dis
trict duties, and there being a real ami effective cir
cuit court even in case of the necessary occasional
absence of tlio justice of the Supreme Court.
The Ttiinciiet,
This new and splendid steamship, built expressly
for the Charleston line, is now taking in freight for
that port and will sail on her llr«t voyage tomorrow
morning, with a full cargo and a fair complement of
passengers. Tho placing of this fine vessel 0 „ t| 10
Charleston line, may, we hope, is- justly regarlod
a favorable epoch in the history or our Southern const-
wise connections. The entire success which we r,. ( .|
confident this lino will Moore for Itself, will give con
fidence to projects for the further extension of our
ocean steam lines to other ports. Under circuinstan-!
r«s of considerable discouragement, and suffering
| til. tin her List outward trip it was a-ked for ami
waived, ami Capt. Hulloeh distinctly denies that he
xt,1* warned to have such a manifest ready on his re
turn voyage. When asked about his cargo he replied
" No." for tlie simple reason that his cargo was not
intended for Havana, but for New York ; and having
for thirty-five times before entered and cleared his ves
sel as in ballast, he did not dream of any change of
the custom of the port. His answer was intended,
and no doubt was understood, an referring to cargo
for Havana, of which lie hud not u single bale or
package.
The captain, officers and crew tlicn placed them
selves under tlie protection of our Hag, on hoard the
U. 8. steamer Fulton, lying iu the harbor. Captain
Watson, wlio commanded that ship, had already
steamed up, and not only offered hut desired to go
on board the Warrior anil demand that the American
ling be again hoisted. If refused, lie proposed to at
tempt doing it with his crew and if overpowered hy
force, lie would also abandon t iu ship iu tlie name of
tlie United States.
Such a procedure would have brought the question
to a war test, and I believe the whole American peo
ple would have approved or such a course. Unfor
tunately, the acting Consul, Mr. Robertson, the con
signee, Mr. lying, ami Capt. Hulloeh. disapproved of
tliis course, ami Captain Watson, a gallant and true
hearted sailor, was overruled, lie had, at first pro
posed to tow her out of the harbor, and put the au
thorities to the point, whether they would or would
not dare to lire upon an American vessel-of-war. This,
however, was soon withdrawn.
It was an opportunity ot which we have causes to
regret advantage was not taken. It was decided that
tilings should remain in statu <juo until the return of
the vessel about to be dispatched to tlie Uuite*States
for orders from Government.
Now for the real and incontrovertible act of oppres
sion. Presuming, for the sake of giving Spain all the
law aud custom on tier side, that she w.is light thus
far, tlie miration is materially altered when it is stated
iu the following light. It U a rule of the po»t of Ha
vana that a manifest can he amended any time within
twelve hours alter the arrival of a vessel. This is al
lowed to b« so on both sides. Another custom pre
vails there. Oa Sunday or a fete nay no husiues-. is
transacted at the custom house, nnd the custom has
obtained, and the law allows it, that a consignee ex
pecting a steamer t-» arrive on a Sunday or a fete
day, and desiring her to depart on the same day of
arrival, can enter and clear her the day before, al
though the vftssel has not yet actually arrived. This
is of frequent occurrence with the English and Ann r-
can atenim-rs. The Black Warrior was so entered
and cleared on Monday hy her consignee, Tuesday
being a fete day. I presume he entere d her, as lie
had always done before, as ill ballast, lie bail had
no advices from Mobile its to cargo, (even if such an
entry was necessary) and the Spanish authorities
knew that such advices were impossible. To resume.
Within six hours the captain umi consignee Hindu for
mal application to amend the entry and manifest, but
met with a distinct umi positive refusal. The reason
assigned was a true Spanish one. The ves.-el had en
tered and cleared (before her arrival) nnd she was
presumed to have finished nil lew business with
the custom-house, and having broken the regulations
the demand to aun-iid was not to be entertained ! It
was limn claimed by the consignee that the vesst-j
should be reinstated whore she would have been bad
notsiieli a theoretical entry and clearance been inadv.
This was also refused, as tlie effect would have been
to claim tiiu amend, uml thus give time to break tliu
confiscation.
Iu a word, tho authorities took advantage of their
own original wrong, (m the primary act of entry and
cleuratice,) uud for tlie sole purpose of divdilig a large
-..in of money amongst t mmselves. It is said that
the enruo alone of the Hit C i Warrior is valued at some
j I oil.linn. The ofiic- rs w ho made the seizure got two-
t.iirds, whilst the remaining one-third goes into tire-
1 oilers of the royal treasury. This is a nio-t sutinfne-
buy solution of the question ; and it only remains to
be seen whether our Government and people will pa
tiently submit to this, or make it a cause for war. All
who have lieen in Cuba f> rvciitly hope that war will
I hi i ie result, and the lending on the inland seems to
bo a prevailing one, that before twelve months roll
around we shall either acquire it by purchase or by
conquest.

in conclusion, 1 bold that tire* technical evasion of
tli • Spaniards, in the ea-u of the Black Warrior, is a
most liagraut outrage, demanding speedy and instant
-atisfaciioii. let nur Government look to it, and em
brace t e‘ present opportunity to repay Spain for a
whole hecatomb of wrongs, injustice, insult aud inju
ries indicted upon Amcricau citizens.
A gentleman who was on board tells me that In-
stood by when the question was asked about cargo,
und lie di-dim tly heard Cupt. Hulloeh, atterwnrels
say, wln-n lie understood what was meant hy cargo,
that •• there were seven or eight hundred bales of cot
ton oil b mrd. and that the purser could give the ex
act quantity.'’ It is tube tinted,also, that the seizure
of the vessel did not take place till the following day,
without formal notice, and just ns the ship was pre
paring to go to sea.
It has been offered iu excuse that within a few days
all tlie old custom house officers have been removed,
an I that the new ones have received instructions
Iroui the Captain General to enterec the regulations
strictly an I to the letter. Till* may be so ; but should
not our American ship owners and muster- have been
notified (through the Spanish Minister at Washing
ton) <d the intention to enforce this almost obsolete
law? Common sense says yes.
Again, the seizure was uni only a violent one, but,
even admitting that the law was designedly and
willfully broken, the offence was so trilling and paltry
in its nature and the amount ol money (if any) in
volved, that the act of confiscation is an enormous
ono, nnd utterly disproportion^ to tlio offence.—
Among enlightened maritime nations a hail bond is
always accepted in case* of this nature, and the ves
sel, cargo and passengers uro allowed to proceed to
sea. A fine is then imposed, reu-ounhle and ju-t, the
money paid and nil parties satisfied, fn this case a
bond with suitable security was tendered, but would
not lie ncccptc I inth-s* the bond was signed in blank,
leaving the autli“ritR-s to till it up with any amount
they chose. This of course wus refused. The object
was a confiscation and a grand division of tlie spoil.
Mr. Rogers, of Jersey City, one of the owners of
the vessel, was onboard, and remains at Havana to
carry on further despatches to Washington hy the
Isabel, which steamer sails to day. He has been very
active ami efficient iu this business of renewed .Span
ish insolence aud outrage.
Mr. Wheeler, a lawyer of note from New York,
who was in Havana at the time, also attended the va
rious consultation* of the parties concerned, and his
opinion is most decided that the officials have ncithcr
law, custom, nor right on their side. He has been
very mu-h interested in tlio case, nnd tlie deliberate
opinion of tlie most celebrated Spanish lawyer in
Havana is in full accord with his.

The prevailing idea in this country in regard to the
government of Russia is that it is u despotism. Ii
was so till the year tell, when the late Emperor Alex
ander declared it to be • A Constitutional Monarchy,’

any ukase or edict contrary to law. There are minis
ters from the great departments who are responsible

of African descent.) the climate is one of unusual
