repealed failures to run agreeably to contract; for disobey

ment ; for refusing to discharge a carrier when required by

out the assent of the I’ostmaster General ; for running nn
express as aforesaid ; or for transporting peraons or packa
ge* conveying mailing matter out of the mail.
fi. The I’ostmaster General may order an increase of ser-
vico on a route by allowing therefor a pro rata increase on
the conlraC pay. He nmv change tho schedule of arrivals
and departures, without increase of pay, provided he does
not curtail the amount of running time. Ifo may also or
der an increase of *|*ed, he allowing, within the restric
tions of the law. a pro rata increase of pay for the addi
tional stock of carrier*. If nny. The contractor mar. how
ever. in the case of Increase’ of speed, relinquish tlio con
tract by giving prompt notice to the department that he
prefer* doing so to carrying tlio order into effect. The
I’ostmaster General may also curtail or discontinue the
service at pro rata decrease of pay, allowing one month's
extra compensation on the amount dispensed with when
ever. in his opinion, the public interest* do not require the
same, or In case he desires to supersede It by a different
grad" of transportation.
7. Payments will be made for the service by collections
from, or drafts on. postmaster*, or otherwise, after the ex
piration of each quarter—say in February, May, August,
and November.
8. Tlie distances are given according to the best informa
tion ; bill no inrrensed liny will be allowed should they bn
greater than ndvrrtisi-d if the points to be supplied bo
correctly stated. Bidders must inform themselves on this
point.
9. Tlie Postmaster General Is prohibited by Inw from
knowingly .nuking a contract for the transportation of tho

posed to enter into, nny combination to prevent the mak
ing of any hid for a mall contract by nny other person or
person*, or who shall have made liny agreement, or shall

thing whatever, ill order to induce any other person or
persons not to bid for a mail contract. Particular atten
tion Is called to the 28th section of the net of 1086. pro
hibiting combinations to pn-vent bidding.

15. The contract* are to be executed and returned to the
department by or before tlie 1st of July, 1844.
Id. Section 18 of nn act of Congress, approved March 3.
1854. provides that contracts for the transportation of tho
mail shall be let. •• in every case, to the highest bidder ten
dering sufficient guarantees for faithful performance, with
out other reference to the mode of such transportation
than may he necessary to provide for the due celerity, cer
tainty, nnd security of such transportions.” Under this
Inw a new description of bids has been received. It does
not specify a mode of conveyance, but engages to take the
entire tnsll each trip with celerity, certainty and security,
using the terms of the law. These bid* are styled, from
the manner in which they are designated on the books of
the departments, “sfnr Mas,” and they will be construed
ns providing for the entire mall, however large, and what
ever may be the mode of conveyanre necessary to insure
its '‘celerity, certainty and security ”
Such bid* will therefore be accepted in preference to
higher bids for specific modes of conveyance on routes
where the lowest mode of conveyance (that is, on horse
back) Is known to be insufficient.
In all cases where the lowest grade of service is beliered
to be sufficient, the lowest bid will be accepted, if duly
guaranteed. In preference to a star” or specific hid.
When the lowest hid is not a star bid.and specifies either
no mode or an inait-ifuale mode of conveyance. It will not
be accepted, but act aside for a specific Lid proposing tho
necessary eervlco.
When the bid does not apecify a mode of conveyance.also
when it propose* to carry "according to the advertisement,”
but without such specification. It will be considered as a
proposal for horseback service.
18. A modification of a bid. In any of ita essential terms,
is tantamount to a new bid. nnd cannot bo received, so as
to interfere with regular competition, after the last hour
set for receiving bid*.
21. Postmasters are to be careful not to certify the suf
ficiency of guarantors or sureties without knowing that
they are persons of sufficient responsibility ; and nil bid
dcr*. guarantors.and sureties nro distinctly notified that
cii n failure to enter Into or perform the contracts for the
service proposed for In the accepted bids, their legal liabili
ties will be enforced against them.
19. The contracts will be substantially in the forms here
tofore used In this department, except in the respects par
tlcutnrly mentioned In those instructions; and on ail Rail-
road and steamboat routes the contractors will he required
to deliver the malls Into the post office* at tho end* of tho
routes and into all the intermediate post offices, not mo*
than 80 rods from the railroad or landing.
