Mr. Jones said that the committee was equally divi
ded on the form of the report to accompany she hill.

Mr. Sumner presented a paper containing the views

organization of the regiment will take place at an

George W. Towns.
Our readers throughout the State will learn with
peculiar pain the death of this distinguished citizen
of Georgia. The sad event, though sudden, is hard
ly unexpected. For a long time his health ha* been
considered in a pccarious condition, notice of which ,
had been given in the public journals in excuse or
his inattention to a voluminous correspondence. He
i* now no more. In him Georgia loses a devoted son,
hi* country a warm and self-sacrificing patriot, a
large circle of society, a generous and disinterested
friend.
Gov. Towns was a native of Georgia, and was but
fifty years of age at his death, having been l>orn in
the county of Wilkes, the 4th of May, 18U2. The
family was of Virginia descent ami of revolutionary
fame. His father was at the battles of the Cow pens
and of Eutaw Springs, in botli of which ho distin
guished himself for coolness and bravery.
The subject of this sketch early gave promise ol
his future eminence. Prevented from receiving a
classical education, on account of the straitened cir
cumstances of his father, lie supplied the deficiency
by his own exertions. Books were his constant com
panions, study his delight. Having thus grounded
himself in the rudiments of science lie entered a law
office in Alabama, to the Bar or which State ho was
admitted to practice in 1824. Two years later he
removed to Georgia, settUng In Talbot county, where
be soon won his way to distinction by popular man-
ners and untiring attention to business. He repre-
fiented that county during many sessions in the Leg
islature. In 1834 he was elected to Congress, in
which service he continued for two successive terms.
He was again re-elected In 1846. In 1847 he became
Governor of the State of Georgia, to which high hon
or he was re-elected in 1849.
Gov. Towns wns in every respect a self-made nun.
thus adding another to the long list of illustrious
Georgians whose distinction cannot be credited to
factitious circumstances. Tho life and victories of
such a man are the best commentary on our institu-
ti ns. By unwearied and persevering labor, by gentle
winning manners, above all by tli" faithful perform
ance of every duty, lie lived honored and respected,
and leaves behind a name of which every Georgian is

Cant. Clifton. U. S. A., arrived in this city yester
day, from the Plains. Captain Clifton has been sta
tioned nt Fort Laramie lor several years. He is now
on leave of absence, and will remain in the States lor
Borne month*.
We learn, generally, that tho emigrants for Cali
fornia were getting on very well. The most of them
passed Fort Kearney before the 20th of June, and in
very good health. Some few cases of cholera, ora
disease partaking of its characteristics, had occurred
amoug them. The Mormons, no; so far advanced on
the mute, had experienced more sickness, but their
health was improving. It wa* estimated that some
twenty thousand head of stock were on the route,
hut the number of emigrants were limited, compared
with former years. The Indians wns somewhat trou
blesome, but except on one or two parties, no Herious
depredations bus been committed.
" Squatter Sovereignty." was going it quite exten
sively in the Kansas Territory. Pioneers had ap
peared aud staked out tl.eir claims on the Xemuhali,
aud in the neighborhood of Fort l/>avenworth great
nundiers of entries had been made.

rope performer died yesterday morning, at his resid
ence, after a sickness of only twenty-four hours dura
tion. Tho dlseaso which terminated his life was
cholera morbus, induced by imprudence in bis diet.
Tho deceased was well-known to the world as a mem
ber of the Ravel troup of pantomlmists, having been
connected with them for a series of years. His two
sisters married tho Ravels, Antoine and Jerome, from
which sprung tho union of Leon Javclii with tills
company. As a tight rope performer he was une
qualled by any iu tho world, and died lamented by a
large circle of friends.—N. Y. Herald, 14(5.

pondent of the New York Tribune says :
Advices have been received from Mr. Koulo tip to
tho 23d ult. At that time not the slightest evidence
had been shown by tho Bpauish Government^ of a
disposition to came to an arrangement on the Cuban
difficulty. No overtures whatever have been rnade
which could be accepted by the United States Gov-
vernment. If the administration had persisted in
the design of apointing two special commissioners to

A Fatal Proof of Inutility.—A man named
Leroy, in Paris, who had invented a steam carriage
for travelling on ordinary roads, was recently going
in it towards the English channel to ship it f<>r ex
hibition, when in descending a hill tin* carriage
struck some obstruction, topped over, and poured
the hot water from the boiler over Leroy, scalding
him so badly tlmt lie cannot recover. He had spent
ten years and all his means in perfecting his inven
tion. and had received flutering testimonials from

Rumored Outraok and Excitement.—We last
evening heard rumors of gross outrage and conse
quent excitement, in connection with an immigrant
ship from Liverpool, which arrived yesterday in the
Third District. The entire ship's company, with the
exception of the captain, mate and carpenter, are
said to lie negroes, and tiie black scoundrels me
charged witli tho most fiendish outrages upon tho
female passengers during the voyage. What renders
the ca*e more aggravating is tiie charge made by tho
poor victims, that these brutalities were perfectly
well known to tiie officers, who made no efforts to

A Burn 1 so Steamer.—Captain Plummer, of the
schooner Virginia Griffiths, arrived last evening from
Baltimore, reports that on Mondny night last, off
Gape Hattcras, saw a steamer ou lire, supposed to be
loaded witli cotton.
From the description of tho vessel, we think there
is a strong probability that it was tiie iron steamer
I). L. Adams, which put into this port on her voyage
from Savannah to New York,on Thursday. Gth inst.,

Legal Derision In regard to Fulst-I}’ i’nrlicd
Cotton.
We have often taken occasion to refer to the very
reprehensible practice of falsely packing Cotton,
which we arc sorry to find is continued to some ex
tent, as we have heard of many complaints nnd re
clamations Irom time to time during the past season.
Th- suit report' d 1 low, grew out of a case of this
kind, and it will he seen that the factors, though in
nocent parties,and acting in good faith,are held lia
ble for damages.

Court of New-Orleans,
Tiiis suit was brought before Richardson, Ju c tice,
to recover the ninnunt due for reclamation on two
bales of cotton sold by defendants.
It appeared in evidence that the cotton in question
wns sold, with many other bales, by sample.nnd that
the whole wns shipped to Barcelona. On being
opened it was found that two ol the bales were false
ly packed, tiie outside corresponding with the sample,
and the inside consisting of very inferior cotton.
The piniutiff proved the identity of the hales
with those purchased of defendants: also, the false
packing and the amount of damage. The defendants
offered no evidence, bat rested their defence upon
two points, viz: 1st. That as a false and fraudulent
packing was charged, they, as tho agents of the plan
ter, could not be held liable; and, 2d. That as the
planter's mark wus nn tho bales, recourse must be
had to the principal and not to them.
The court decided that the defendants, as cotton
merchants, selling cotton in one lot, which, perhaps,
had been received from many planters—selling it in !
their own name, without rc.'erence to any others as j
principals—and, selling it by samples, thereby war
ranting the whole to he equal to the sample in quart-1
titv, were clearly liable—that the charge, that the
bales were falsely packed, in no manner affected, nor
could it have been intended to affect the character
