whereof William It Lingo is and wu* lately master, that
ou ilu*-night of tho twenty-fourth day ot March,in tho
year eighteen hundred nnd fifty-five, the said schooner
John Boston, on a voyage from tho city of New York to
tho city of .Savannah, ami at that lime a staunch and well
built schooner ot tlio burtlu-n of four hundred tons or
thereabout*, an J sufficiently provided with apparel, tacklo
and furniture, and properly manned with a crew sufficient
to work and navigate said schooner, at about nine o’clock
at night, tbo said schooner in the prosecution of her voy
age. having arrived in tho river Savannnb. within the ebb
and flow of the tide, nnd within the admiralty and mari
time Jurisdiction of the District Court of the United Statos
of the Southern District or Georgia, and was pioceoding
up to the city of Savannah intovr of tire steamboat Thorn,
grounded ou the wrecks, about two miles f 0111 the city of
Savannah, the channel being to tho south of her. that
whilst the schooner John Boston was grounded on the
wrecks, and Hie steamboat Thorn safely fastened and
moored alongside of her, the steamship Florida, whereof
Merritt BWoodhull was master, on hor voyage from New
York to the city of Bnvannah, came up tho Savannah riv
er under full headway, on the north side of thu channel,
nnd thou and there with great force and violence, run into
and upon tho said steamboat Thorn, cutting ber bows di
rectly off. then striking the schooner Johu BoBton at her
fore rigging, on tbo starbonrd side; that the said steam
boat Thorn now lies sunk in from four to five Get
water nt high tide, that she must be brought to Savannah
to be repaired, nt great expense and loss of time, that tt
is impossible to ascertain exactly tho extent of the dam
ages. but ns far a.i calculation can bo made, tbe damage
occasioned by such collision to tho steamboat Thorn will
amount to tho sum of thfrty-flvo hundred dollars.
That the schooner John Boston has been brought to thu
city of Havanunh. where she mu-t lie repaired at great
expense and loss of time, that it la impossible to ascertain
exactly what will bo the extent of the damsgo. but as far
as calculation can be made thu enrage sustained by such
collision to the schooner Johu Boston amounts to the aura
of fifteen hundred dollars; that this occurred In the ad
miralty and maritime jurisdiction nf said Court—*11 of
which tho libellants pray leave to furnistr proof, and havo
also prayed a decreo for tho damages aforesaid and costa,
ami that tho otdlnary process may issue.
Au'l whereas.the Judge of tho District Court aforesaid,
hath ordered and directed that the nrdlnaty procS'ishouId
issue, returnable to tho United States Court Room, in the
city or Savannah, mi tlio eighteenth day of April next, at

and strictly enjoined, peremptorily to cite and admonish
