the claims of party, have rallied under the
Democratic flag. There la no man whose re-

of the Baltimore and Savannah Steam Naviga

Railuoad Meeting in Bainbridge—The
following cull appears iu the Bainbridge Argus
of last Tuesday:
There will be a meeting of the citizens of
Decatur county held in Bainbridge on Thursday
the 14th fast., at 11 o’clock, a. in., for the pur

ate passed the Houso bill providing for running
the boundary line betweeu Washington Terri
tory and the British possessions.
Mr. Seward presented a petition from Ex.

relief.
Tuo petition was referred to tho Judiciary
Committee.
Four river and harbor bills were passed and
the Senate adjourned.
House.— 1 The House considered bills relative
to the District of Columbia, and passed a bill
enlarging the rights and powers of the Alexan
dria Canal Company, assenting to an act passed
by the Virginia Legislature, which authorizes
the company to sell water privilgen along tho
line of their canal.

The Scuato passed to-day two more Internal
improvement bills; one for continuing certain
public works lu Massachusetts, tbe other for
coutinuiug Improvements at New Castle, Del
aware.
The fluauco Committee of tbe Senate have
struck from the Army Appropriation bill, Mr.
Shornjan’s revolutionary amendment, which
was tacked to it by the House, but which tho
Senate uonnot, of course, be induced to pans.
Each Houso will probably appoint a commit
tee of conference ou this vexed quealon. It is
not supposed that tho Houso will insist upon
any aotlou which will hiuder any rogular op*
propriation; but daring this session, at least,
they will uot take up the Senate Kansas bill,
so well suited to|»acify tho country, hut also
well suited and t sure to deprive agitators a of
good pretext for complaint

The National Intelligencer of to-day coutaius
an anonymous article, stated by the oditors to
bo from tho pen of one of the most eminent
jurists of thu Btate of Kentucky, on vacancies
in tho office of president, aud more particularly
ou the Constitutionality of the Aot of Cougress
or 1792, concerning the manner in which sucli
vacancies are to bo tilled. The sulject is ut all
times interesting, hut especially so utthis duy,
when the peculiar state of parties renders it
possibletif uot probablo,ltbut tho election of the
noxt President may devolve upon the House of
Representatives, under the Constitution. Tho
uuthor of the article named, questions the con
stitutionality of the law of 1792, and if his ar
gument to that effect is uot altogether souud,
it lias ut least great plausibility. It Is substan
tially as follows: The Constitution establishes
regular Presideutlal terms. It gives no power to
Cougress to order an election of Presidential
Eloctors at any time, merely empowering it to
“determine the time of choosing electors, and
the day on which they sliail give their votes,”—
that is, to determine the nine for the regular
quadiennial election previously provided far.

shall act as President iu case of vacancy, but
does not authorize any special election to till
his place ; evidently iuteuding, therefore, that
the officer designed by law to fill tbe vucauey
shull nil itduriug tbe residue of the term, thus
obviating any derangement of the regularly
established terms. But the act of 1792 provides
far the election of a President to fill a vacancy
occutriog during the regular term, and not
merely far the residue of tho term, but far a
full term, commencing tho next 4th of March,
l’he powor to order a special election for u
full term, if lutended by the drawers of the
constitution, would it is argued, have beou
specially and explicitly given, us it is in the
case ot vaoaucies in the Senate and House,
which aro directed to be liUcd by special elec,
turn. The constitution says the President shall
hold“offlcefduriug theism offauryears.” “For
the term ot four years is a technical expression,
unquestionably referring to unalterable and his
regularly succeeding terms. The terms of the
offices of Seuatura aud Representatives are pore
manent: this has never been questioned: yet
the Intended permanency of tne Presidential
term Is as clear ut least as that of the term of
Representatives. The writer concludes his
article with a reccommeudution to repeal so
muuh of the aot of 1792 as directs a special or
intermediate election of electors. The subject
is certainly deserving of immediate considera
tion by (Jougress.
In writing on this subject, 1 am reminded of
tbe speculations now made as to the force of
the different Presidential candidates iu the
i louse, iu case tbe election should go to that
body. There are thirty-one Htutea; sixteen of
these would be uecessury to elect, under the
provision of the Constitution, that each State
-ffiati have but uue vote ia such election. In
the present complexion of the House, there are
tuirteeu States taut are certain fur Fremont,
i'he rejection by the House of Hall of Iowa,
•»nd tut election in his stead of a Froesoiler—
which would be certain—and the election of
a Frecsoiler likewise to dll tne vacuucy in Sen
ator Trumbull’s d.stnct iu Illinois, would glee

of Mr. Cullen, of Deluwure, never claimed by
tuo tirieuds of Fremont, but until yesterday,
supposed by some to be possible for Bucnauan,
could decide the coute.t. The vacancy in Illi
nois, however, will uot probably be filled before
that time, tne Governor uot having yet or
dered uu election, wutch neglect, I urn told, U
denounced by Senator Trumbull as uu outrage
upon the rights of the people. Mr. Cullen,
tuereforo, may uot be quite so important iu the
Presidential contest os Uud been supposed.
Yesterday, iu the House, Mr. Cullen called
upon Mr.Lobb,of Georgia, to explain a speech
iu which he was reported by the Savannah Re
publican as having mentioned his name in this
connection. Mr. Cobb explained that he nud,
lor tenuous theu given, expressed his unwilling
ness to place the p «wer of choosing President
in the hands of a single representative from
Delaware. Mr. Cullen declared himself an Am
erican, aud that, if the election of President
should come to the House, be should vote for
Fillmore first aud last, aud uot far Buebunau
or Fremont. So Mr. Cullen has I ully defined
his position. What cares he for a fat office,
from Fremont or Buchanau ? There’s no room
tor bargain and corruption in little Delaware.
Iu the Senate to-day an effort was made to
take up the Army appropriation bill, which
failed by a vote or 29 to 18. The Seuate then
proceeded with the consideration of its inter
minable list of internal improvement bills, tak
ing up the bill far improving tho harbor of
Dubugue, Iowa. Mr. Clay, of Aiabamu, moved
to uinend by striking out the words “harbor of,”
and inserting “Juudlng atcontending that a
place of stoppage two thousand miles from the
mouth of tho Mississippi river, far in the interi
or, is not properly a harbor. The amendment
was rejected. The friends of the bill treated the
amendment as an attempt to throw ridicule
upon the bill, by an alteration of its phraseol
ogy.
The House has been engaged throughout the
day iu District of Columbia business. A bill
muking an appropriation far coutinnuiug the
work on the Washington Aqueduct was referred
to the Committee ot tbe Whole. It is to be
honed that this great and necessary undertaking
will not be abandoned far want of necessary aid.

An Extraordinary Cose.
A recent case incur Police Courts, and which
it is likely , will be carried to a higher tribunal,
betrays what we should, from our information
call a scheme of a sharp, designing woman,
ouckcd by her frieuds, to obtained a support
from an easy-going, simple minded gentleman
with whom site met, which doubtless will as
tonish tho natives. We of course, for obvious
reasons, suppress names; but the facts ure briefly
A gentleman arrived in this country from
Germany ubout two years sluce. His education
wits excellent, but Iio was one of those ap
proachable good natured men, whose modera
tion roudera them familiar. He was, by pro
fession* a mechanical engineer, and so skilful
that he at onco acquired a large business. His
noxt adventure proved more disastrous to his
hapuiuess aud his liopse, and hu», besides,
made serious encroachments upon his fluances-
His susceptibility to punaiotial attraction be
came known to a family with a marriageable
daughter, who reside iu Secoud avenue. Our
huro was not muuh of a “gullant,” aud in per
sonal appearau o was not ol the dashing char-
acter which captivates tho eye aud Alls the
mind of the giddy, ignorant young women of
Now York; hut his earnings were considered
uud ou this score he was thought available
while his good qualities would rendor him an
easy victim far any scheme that might be
connected ugainBt him.
Appearance—so far as they are developed—
see into indicate, a plan was laid for the per-

which has uo parallel in any quarter. It was
uo less than that the daughter was to marry
him, quarrel with him, leave him and runaway
from him to her parents’ home, Hue him for a
divorce, obtaiu it with a handsome allowance
for support, and leave him to “chew the cud of
sweet and bitter fancy,” as best be might.

chased quantities of clothing aud jewelry far
his iimmorata before their marriage; be rout
ed elegant apartments after tiioir nuptials, and

boileyed his happiness for life uow secured,
but th$ golden fault turned to aahes on his lips.
His wife at once began a career that would
have done credit to Xautimio. She would neith
er perfarm the slightest service far her bus-
hand, nor permit uer servants far to do no.
His wardrobe, etc., was utterly neglected, and
•t the same time sho was clamorous iu her de
mands for money. They thus lived for about
six months, she growing constantly more ob.

At lost about three mouths sluce, when sho
Imd put somo unusual grievious wrong upon
him, he chucked her geutly under tho dim uud
said she was a very strange young woman.
This was just wlmt sho wanted, to make out
a caso of assault and battery upun her, and
she would show him “ what's what” She pro
cured a warrant far his arrest on tho churge,
and ho wa9 arrested and held to bail.
She then returned to her parents’ house. Her
friends commenced a suit against him for aban
donment. and, oithor becuuso his counsel was
bribed, (as his frieuds suspected) or ho was
incompetent of presenting the facts of the cuse
with proper farco, ho was do tea ted, and was
mulcted sundry dollars per week far the sup
port of his truant wife. Tho assault and bat
tery case is still pending. Emboldened by suc
cess, her friends havo uow instituted proceed
ings far a divorce. These cases will come up
in our courts this, fall, aud cannot fail to pro
duce a sensation among tho gossips of the me

LATER FROM EUROPE.
Arrival of the Atlantic*
The steamer Atlantio with dutes from Liver
pool to the 23d ult, urrived at New York Mon
day afternoon, at 5 o’clock.
In Parliament the Earl of Malmesbury called
attention to the difficulties between Brazil and
England, arising from tbe treatment of the
British Minister at Rio, in the question con
cerning the slave trade ; aud he particularly
insisted on tbe value of retaining friendship
with Brazil iu case of war with the U. States.
Lord Clarendon explained thut Brazil hud no
ill will towards Greut Britain.
The failures alluded to in the advices by the
previous steamers are as fallows: John Nunns
cutton broker, L verpooi; Joseph Wright A Co.,
Bpiuuors; Stockport, Lane & Lane, commission
msrehanfa,Manchester, aud Maw* Baxter &
Co., aud lour other houses. Tne liabilities ure
large aud the assets but small.

the 29th.
The suspension of Hertford A Ware, bank era
is announced this morning.
■PAIN.
The latest accounts from Spain state that the
Courts had removed to Aragon, whore, under
General Entente, they intended to make war
upon Queen Isabella and her ministry in the
nume of liberty aud constitution.
The Loudon Times and other papers say that
the insurrection was being encouraged by the
O’Donueil party.
Espartero is in the very stronghold of the
liberals. It is believed that Geuerais Currea
und Fulcon. the tried purtisans of Espartero.
are at the head of the troops aud National
Guards of Saragossa. Eighty-five members of
the Cortes—more than one-third of the whole
body—hold formal meetings there.
A despatch, received at Paris, says that when
the news of O’Donnell's succession reached
Saragossa, the Captain General convened the
civil authorities aud the officers of tbe Nutiuual
Guard, and, after debate, they resolved on re
sistance.
Narvaez and other adherents of ex-Queen
Christina, were hastening to tbe frontiers.
A letter from the Spauisb Legation at Paris
says that the difficulty between Mexico and
Spuin has been honorably adjusted.
Tho statements in regard to the progress and
prospects of tbe insurrection are conflicting.
O’Donnell had made Buoh effectual moasurcs
for crushing the outbreak, should any occur,
that after thirty hours hard lighting at Madrid,
the citizens and Nutioual Guard surrendered,
and were Immediately disarmed, when Mudrid
